Abstract

Land disputes are a complex issue that frequently occurs in Serdang Bedagai Regency, rooted in unclear ownership status, overlapping certificates, and improper transfer of rights. These issues not only cause material losses but also trigger social tensions in the community. The problem faced by the community is a lack of understanding of the mediation process as a more effective and efficient alternative dispute resolution compared to litigation. People tend to choose the court route, which is time-consuming, expensive, and can worsen relations between parties. To address these problems, legal counseling activities were conducted in Pematang Kuala Village through a collaboration between the community service team of the Indonesian Community Development University (UPMI), Ismayani and Partners Legal Consultants, and media partner sinarsergai.com. The implementation methods included interactive lectures, group discussions, and presentations of real-life case studies. The material covered the legal basis for mediation based on Law No. 30 of 1999 and Perma No. 1 of 2016, the stages of the mediation process, the role of mediators, and the advantages of mediation over litigation. The results of the activities showed an increase in community understanding of mediation and the establishment of a sustainable referral system. This program is expected to reduce land conflicts through win-win solutions, accelerate the dispute resolution process, and improve social harmony in Serdang Bedagai Regency.

Abstract

Saksi memiliki posisi yang sangat penting dan strategis, namun hal ini juga membuatnya rentan terhadap situasi sulit dan berisiko tinggi. Khususnya sebagai saksi dalam kasus korupsi, yang termasuk dalam kategori kejahatan serius, posisi saksi menjadi sangat rawan terhadap ancaman dan intimidasi, baik selama proses penyelidikan hingga persidangan. Tindak pidana korupsi sering melibatkan individu dengan kekuasaan dan posisi penting di pemerintahan, yang dapat menyalahgunakan kekuasaannya untuk menekan atau membahayakan saksi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan hukum konseptual dan perundang-undangan. Sumber hukum yang digunakan meliputi bahan hukum primer, sekunder, serta bahan non-hukum. Hasil penelitian menunjukkan bahwa proses perlindungan terhadap saksi pelapor dalam kasus korupsi dilakukan dengan menyamarkan atau merahasiakan identitas saksi pelapor untuk memberikan rasa aman bagi saksi, keluarganya, serta asetnya. Namun, perlindungan ini belum optimal. Hambatan dalam pelaksanaan perlindungan hukum terhadap saksi pelapor meliputi kurangnya fasilitas dan infrastruktur yang memadai, kelemahan dalam regulasi Undang-Undang LPSK, minimnya sosialisasi tentang perlindungan hukum bagi saksi dan korban, serta inkonsistensi dalam penerapan sistem perlindungan yang diatur oleh Undang-Undang LPSK

Abstract

Pancasila as the foundation of the Indonesian state holds a vital position in shaping the character and national identity, yet the understanding of Pancasila values among the younger generation, particularly university students, tends to deteriorate in the era of globalization. The problem faced by students at the UPMI is that their understanding of Pancasila remains normative and limited to memorizing its principles without comprehending the elaboration of values contained in each principle and how to apply them in real life. Phenomena such as intolerance, discrimination, and declining nationalism indicate that a deep understanding of the elaboration of Pancasila values has not been optimal. To address this problem, socialization activities regarding the elaboration of Pancasila values were conducted through coordination with the UPMI rectorate and the student affairs division. Implementation methods included interactive lectures, group discussions, case study presentations, and question-and-answer sessions. The material covered Pancasila as the state foundation and the urgency of understanding its value elaboration, the elaboration of values in each principle of Pancasila and their implementation in student life, as well as the role of students in preserving and disseminating Pancasila values. The results of the activity showed an increase in students' understanding of the elaboration of Pancasila values and heightened awareness to practice them in daily life, thereby forming strong student character aligned with the Indonesian national identity.
