Abstract

Photographic works shared publicly on social media platforms, particularly Twitter, are not exempt from legal disputes, especially concerning copyright infringement. This research focuses on two central issues: first, the extent of copyright protection granted to photographs taken and uploaded by K-Pop fans on Twitter; and second, the legal remedies available to the rightful owners when their photographic works are used without permission. Using a normative legal research methodology, the study adopts a statutory approach, analyzing relevant legal rules and norms that apply to copyright protection. The research relies primarily on secondary legal sources, including laws, legal doctrines, journal articles, and relevant case studies. The findings indicate that photographic works shared via Twitter are protected under copyright law, which includes both moral rights—such as the right of attribution and integrity—and economic rights, including the right to reproduce and distribute the work. When such works are used without authorization, the original creators or rights holders have the option to pursue both litigation and non-litigation paths. Litigation may involve filing a civil or criminal case in the Commercial Court. Meanwhile, non-litigation solutions include various forms of alternative dispute resolution (ADR), such as mediation, arbitration, negotiation, conciliation, and consultation. This study highlights the legal vulnerabilities surrounding fan-created content in online spaces and underscores the importance of respecting copyright protections, even within fan communities. It also emphasizes the available legal pathways to protect the rights of content creators in digital environments.

Abstract

Perkembangan teknologi yang sangat cepat menyebabkan perlindungan data pribadi sangat penting untuk menjaga hak privasi individu, mencegah penyalahgunaan informasi, dan memastikan keamanan serta kepercayaan dalam penggunaan data. Penelitian ini bertujuan untuk menyelidiki kerangka hukum dan kebijakan yang mengatur perlindungan data pribadi di Indonesia, serta untuk mengevaluasi efektivitas perlindungan tersebut dalam menghadapi tantangan di era digital. Melalui metode penelitian yuridis normatif, penelitian ini mengeksplorasi konsistensi dan kesesuaian antara aturan hukum dengan norma-norma yang ada, serta mengkaji apakah tindakan yang diambil sesuai dengan prinsip-prinsip hukum yang berlaku. Pendekatan konseptual digunakan untuk menjelajahi kerangka hukum yang ada tanpa meninggalkan landasan hukum yang telah ditetapkan. Hasil penelitian menunjukkan bahwa Indonesia memiliki beberapa peraturan perundang-undangan yang berkaitan dengan perlindungan data pribadi, walaupun sudah ada undang-undang khusus yang mengatur secara komprehensif dalam hal ini masih diperlukan peraturan pemerintah yang lebih rinci untuk menjamin efektivitasnya. Penelitian juga menyoroti urgensi perlindungan data pribadi dalam konteks hak asasi manusia, mengingat adanya potensi risiko pelanggaran privasi yang semakin meningkat. Dengan demikian, penelitian ini memberikan kontribusi dalam memahami lanskap hukum perlindungan data pribadi di Indonesia dan memberikan landasan untuk penyempurnaan kebijakan yang lebih efektif dan sesuai dengan perkembangan zaman.

Abstract

The post-authoritarian reform era in Indonesia (starting in 1998) was characterized by a push to democratize the state system, leading to the adoption of several foreign, democratic, or "globalized" constitutional concepts. This process demonstrates legal isomorphism where Indonesia aligned its constitutional framework with prevailing international democratic standards. This article analyses the patterns of legal isomorphism in the Indonesian constitutional amendment by examining the dynamic interplay between foreign influence and national identity. For that reason, the research aims to determine a legal isomorphism that can harmonize and balance both foreign influences and the desire for a national identity in the constitutional amendment in Indonesia. To achieve these objectives, the study employed a qualitative research method with a socio-legal and comparative law approach. The research finds three distinct patterns of coercive legal isomorphism concerning the constitutional amendment process in Indonesia. Meanwhile, comparatively, a mimetic isomorphism regarding unamendable provisions of basic structure can be considered for harmonizing and making a balance between foreign influences and national identity in the constitutional amendment. The novelty of this research lies in its identification and classification of legal isomorphism patterns within Indonesia’s constitutional amendments, providing a new perspective on how external legal influences interact with national identity. This study contributes to the broader discourse on constitutional development by offering a framework for analysing the complex relationship between global legal trends and domestic constitutional transformations.
