Abstract

This article aimed to analyze the factors that influence the pros and cons of the community regarding the COVID-19 vaccine policy and discuss the formulation of the Indonesian Government's policy regarding the distribution of an effective vaccine to realize the right to life amid the COVID-19 pandemic. Furthermore, the methodology of this research is normative, in the hope that the research approach was carried out for researchers to obtain information from various aspects in order to find the issues to be addressed. Normative research uses legal materials obtained through scientific literature or the law. The results of the conclusion show that the factors influencing the pros and cons of the community regarding the fulfillment of the right to life through vaccine policies consisted of multicultural settings that affected the mindset and perspective of the community in perceiving the COVID-19 virus outbreak so that there were differences of opinion regarding government policies that echoed mass vaccines to aggravate the number of the positive cases. Besides, the government's consistency factor in the form of data disclosure regarding COVID-19 led the public to obtain inaccurate information from various sources, giving rise to diverse public opinions. The formulation of government policies related to the provision of effective vaccines to realize the right to life amid the COVID-19 pandemic was done through the 3S vaccine policy, namely before the vaccine, during the vaccine, and after the vaccine. These included campaigns of the main objectives of the COVID-19 vaccine, priority allocation of COVID-19 vaccinations, and efforts to supervise COVID-19 vaccinations.

Abstract

The right to control from the state is a right that at the highest level is controlled by the state as an organization of power for all the people. This right gives the state authority as stated in Article 2 paragraph (2) of the UUPA. However, these various regulations and policies at the level of implementation do not harm the principles of the rights of the Indonesian people. The presence of the Job Creation Law which regulates land acquisition for development is considered pragmatic, more oriented towards investment and economic interests so it is considered to ignore the ideals and rights as well as the spirit of agrarian reform that favours the interests of farmers. The right of control of this state builds relations between the state and the nation, namely a kind of customary rights relationship that is raised at the highest level, namely the level that affects the entire territory of the country. The meaning of being controlled by the state contained in Article 33 of the 1945 Constitution is not explicitly formulated in its explanation. This allows the emergence of various interpretations of the meaning of this service trying to socialize land acquisition policies in the context of agrarian reform.

Abstract

The problem in this research is whether the SPS Agreement actually becomes a barrier in trade? And what is the impact of the SPS Agreement on trade in Indonesia? The research method used is Normative Juridical. The results of the study concluded, first, the existence of the SPS Agreement can be a barrier to trade, but it is an obstacle that is excluded as long as it is done in accordance with the provisions contained in the SPS Agreement. Second, the existence of the SPS Agreement allows Indonesia to implement regulations that better protect its citizens from health risks that may arise from the import of certain products, especially food. These rules must still be in line with the SPS Agreement.

Abstract

This research raises issues, firstly, the direction of policies implemented by the Government of Indonesia to deal with dumping practices carried out by other countries against Indonesia. Secondly, the role of law in economic development in Indonesia related to preventing fraudulent dumping practices. The method used is normative legal research. The results of the study conclude that first, the policy directed by the Government of Indonesia in dealing with the fraudulent practice of dumping by other countries against Indonesia is carried out by ratifying the Agreement for the Establishment of the World Trade Organization (WTO). With this ratification, Indonesia must then adjust its policies in international trade to comply with WTO provisions, including implementing anti-dumping policies in accordance with the Anti-Dumping Agreement. Second, the law acts as a tool for carrying out economic development. The law acts as a tool to prevent dumping practices in order to support the implementation of economic development in Indonesia.Key Words: Dumping; law and economic developmentAbstrakPenelitian ini mengangkat permasalahan, pertama, arah kebijakan yang diberlakukan Pemerintah Indonesia untuk menghadapi praktek dumping yang dilakukan oleh negara lain terhadap Indonesia. Kedua, peran hukum dalam pembangunan ekonomi di Indonesia terkait dengan pencegahan praktek curang dumping. Metode yang digunakan adalah penelitian hukum normatif. Hasil penelitian menyimpulkan, pertama, arah kebijakan yang diberlakukan Pemerintah Indonesia dalam menghadapi praktek curang dumping oleh negara lain terhadap Indonesia dilakukan dengan meratifikasi Perjanjian Pembentukan Organisasi Perdagangan Dunia (WTO). Dengan ratifikasi tersebut Indonesia kemudian harus menyesuaikan kebijakannya dalam perdagangan internasional agar sesuai ketentuan WTO, termasuk menerapkan kebijakan anti-dumping sesuai dengan Anti-Dumping Agreement. Kedua, hukum berperan sebagai alat untuk melaksanakan pembangunan ekonomi. Hukum berperan sebagai alat untuk mencegah praktek dumping guna mendukung terlaksananya pembangunan ekonomi di Indonesia.Kata Kunci: Dumping; hukum dan pembangunan ekonomi

Abstract

This socialization activity was carried out aiming to provide direction and provide examples, how to implement Pancasila values ​​that must be applied in everyday life. This is intended to be able to create the next generation of people who are of high quality and have high integrity. So that it can make a positive contribution to the country and bring Indonesia to become a developed country. The existence of Pancasila in the environment can shape the ethics of this nation is really very necessary. With this socialization, participants are expected to be able to listen and receive well the various available information. So that the participants can apply what they have learned and can become a good example among the community, especially for the next generation of young people who will continue the leadership relay in Indonesia.

Abstract

There are three objectives in this research, namely to find out the concept of sharia economic law in financial institutions in terms of Law Number 21 of 2011 concerning OJK (Financial Services Authority), strengthening sharia economic law within the Financial Services Authority, and handling sharia economic law problems. by the Financial Services Authority. In this study through the stages of problem identification, preparation of activity proposals, and program implementation. By using a normative legal research method (juridical-normative) with a statutory approach and a concept approach. In terms of data collection, library research is the technique used in collecting our research data for content analysis in order to obtain normative data. The concept of sharia economic law at the Financial Services Authority is related to sharia economics, the strengthening of sharia economic law is contained in Law Number 21 of 2011 concerning the Financial Services Authority, if there are sharia banking problems this can be resolved by using a court or through an institution organized by the Authority. Financial Services, namely Alternative Dispute Resolution Institutions.

Abstract

This research is important to find out what system should be used to create legal certainty regarding the execution of transnational bankruptcy cases. The purposes to be achieved are, first, to know the system that works within the principles of the Model Law developed by the United Nations in handling transnational bankruptcy execution cases. Second, knowing how national law creates execution rules if the foreign debtor's bankruptcy assets are in Indonesia's jurisdictionUsing juridical-normative research methods, the author attempts to analyze transnational bankruptcy based on international and national regulations. International rules are regulated in UNCITRAL: Model Law created by the UN and is a legal reference for countries that have transnational bankruptcy legal instruments with reference to this Model Law. Meanwhile, the national regulations are in Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations, which became known as UUK-PKPU. Model Law regulations provide legal certainty regarding transnational bankruptcy. different from national legal rules which are limited by jurisdiction. The substance of the Model Law provides an opportunity for foreign parties to participate in solving problems. The conclusion of this research is that the adoption of the Model Law by several countries will provide greater convenience and legal certainty in the field of bankruptcy law, especially transnational bankruptcy.

Abstract

Indonesia dan Republik Rakyat Tiongkok (RRT) telah terlibat sengketa kedaulatan maritim atas Laut Natuna Utara sejak beberapa tahun lalu. Perselisihan tersebut berpusat pada persaingan klaim atas wilayah di Laut Cina Selatan, mencakup Zona Ekonomi Eksklusif (ZEE) Indonesia di sekitar Kepulauan Natuna (ditunjukkan di sini sebagai serangkaian garis putus-putus yang menciptakan huruf "U"). Indonesia telah lama mengklaim kedaulatan atas Kepulauan Natuna dan ZEE-nya sesuai dengan hukum internasional, khususnya UNCLOS 1982 yang sudah diratifikasi Indonesia melalui UU No. 17 Tahun 1985. Akan tetapi, Tiongkok juga memiliki klaimnya sendiri yang tumpang tindih di kawasan tersebut berlandaskan peta wilayah mereka yang disebut Nine Dash Line. Sengketa yang tak kunjung usai sebab bersikerasnya pihak Tiongkok pada klaimnya ini telah memunculkan ketegangan dan problematika di antara kedua negara alhasil menyebabkan krisis di Laut Natuna Utara pada khususnya dan Laut Cina Selatan pada umumnya belum menemukan titik terang. Penelitian ini tujuannya melaksanakan analisis hak dan kewajiban negara dalam upaya penyelesaian sengketa dan mekanisme penegakan hukum dari perspektif hukum internasional dan hukum nasional dengan memakai metode pendekatan yuridis normatif untuk memecahkan masalah dengan meneliti data sekunder berupa perundang-undangan, buku-buku serta dokumen-dokumen terkait. Hasil penelitian memperlihatkan pemerintahan Indonesia telah mempertahankan kepentingan nasional dengan menjaga kedaulatan dan stabilitas regional di kawasan Laut Natuna Utara dengan pengerahan kekuatan militer serta berupaya menyelesaikan sengketa melalui jalan damai berupa diplomasi preventif dan persistent objection. Indonesia and the People's Republic of China (PRC) have been involved in a maritime sovereignty dispute over the North Natuna Sea for several years. The dispute centers on competing claims to territory in the South China Sea, including Indonesia's Exclusive Economic Zone (EEZ) around the Natuna Islands (shown here as a dashed lines creating the letter "U"). Indonesia has long claimed sovereignty over the Natuna Islands and its EEZ in accordance with international law, especially UNCLOS 1982 which Indonesia has ratified through Law Number 17 of 1985. However, China also has its own overlapping claims in the area based on their territorial map called Nine Dash Line. This ongoing dispute due to China’s insistence on its claims has given rise to tensions and problems between the two countries, causing the crisis in the North Natuna Sea in particular and the South China Sea in general which has yet to find a solution. This research aims to analyze the rights and obligations of the state in dispute resolution efforts and law enforcement mechanisms from the perspective of international law and national law using a normative juridical approach to solving problems by examining secondary data in the form of legislation, books and related documents. The research results show that the Indonesian government has upheld national interests by maintaining regional sovereignty and stability in the North Natuna Sea area by deploying military force and trying to resolve disputes through peaceful such as preventive diplomacy and persistent objection.

Abstract

Mixed marriages raise several issues and have impacts related to legal relationships. Such as citizenship, marriage agreements, divorce issues, custody rights for children born in mixed marriages and inheritance rights for children arising from these marriages. This research uses a normative doctrinal approach. Because in concept this research is sourced from written norms. Therefore, the research is carried out through the analysis of laws and regulations related to inheritance rights for children who have been born from mixed marriages. Therefore, the study carried out is only “limited” to the (written) laws and regulations related to the object under study. The results show that children born from mixed marriages also have legal protection. The existence of universal citizenship principles contained in Law No. 12/2006 on citizenship, such as the principle of ius sanguinis; determining the citizenship of a child from his descendants; the principle of ius soli, determining the citizenship of the child from his birthplace; the principle of single citizenship, emphasizing that every child can only have one citizenship; and the principle of dual citizenship, providing dual citizenship for every child in accordance with the decision of the Act.
