Abstract

ABSTRAK Peraturan Menteri Pendidikan Kebudayaan Riset Dan Teknologi Nomor 55 Tahun 2024 diterbitkan sebagai respons terhadap meningkatnya kasus kekerasan di perguruan tinggi, terutama kekerasan seksual, yang mengancam keamanan dan kenyamanan civitas akademika. Penelitian ini bertujuan untuk mengkaji implementasi kebijakan tersebut dengan menggunakan pendekatan yuridis normatif, melalui analisis terhadap regulasi, prinsip hukum, dan teori yang relevan. Hasil kajian menunjukkan bahwa perguruan tinggi memiliki peran strategis dalam mencegah dan menangani kekerasan seksual. Meskipun regulasi telah diterbitkan, pelaksanaannya masih menemui berbagai kendala di lapangan. Diperlukan penguatan sosialisasi, pelatihan menyeluruh bagi sivitas akademika, serta penyediaan layanan pendampingan, konseling, dan mekanisme pelaporan yang aman dan terstruktur. Selain itu, prosedur penanganan kasus harus diperjelas untuk memastikan perlindungan korban dan keadilan dalam proses hukum. Penelitian ini merekomendasikan perlunya pendekatan sistemik dan berkelanjutan agar kampus menjadi ruang aman dan bebas dari kekerasan. ABSTRACT Regulation No. 55 of 2024 issued by the Ministry of Education, Culture, Research, and Technology is a policy response to the rising incidence of violence in higher education, particularly sexual violence, which threatens the safety and well-being of academic communities. This study aims to evaluate the implementation of the regulation using a normative juridical approach by analyzing relevant legal frameworks, doctrines, and theories. The findings reveal that universities play a critical role in preventing and responding to sexual violence on campus. Despite the existence of this regulation, its enforcement remains limited due to structural and operational challenges. There is an urgent need to strengthen awareness campaigns, conduct inclusive training for all academic stakeholders, and establish well-structured support services, including counseling and safe reporting mechanisms. Clear procedural guidelines are essential to protect victims and ensure fair legal proceedings. The study recommends systemic and sustained efforts to foster a campus environment that is safe, inclusive, and free from violence.

Abstract

ABSTRAKKekerasan seksual terhadap anak adalah ancaman serius yang berdampak pada kehidupan anak dan keamanan masyarakat. Pemerintah Indonesia telah mengambil langkah serius dengan menetapkan sanksi pidana berat, termasuk kebiri kimia, untuk memerangi kejahatan ini. Penelitian menggunakan pendekatan yuridis normatif dengan menganalisis bahan hukum dan teori terkait kebiri kimia terhadap pelaku kekerasan seksual anak, dengan tujuan memahami penerapan sanksi ini demi kepentingan terbaik anak. Penelitian menunjukkan bahwa kekerasan seksual anak memerlukan respons hukum yang tegas, termasuk sanksi tambahan seperti kebiri kimia. Namun, efektivitas sanksi ini masih diperdebatkan terkait pencegahan kekerasan seksual berulang. Prosedur pelaksanaan kebiri kimia melibatkan evaluasi klinis dan rehabilitasi setelah pelaku menyelesaikan pidana. Meskipun diatur sebagai respons hukum, implementasi kebiri kimia memerlukan pertimbangan medis, sosial, dan hukum yang matang. Tujuan utamanya adalah mencegah kekerasan seksual berulang dan memberikan efek jera. Diperlukan langkah-langkah preventif kuat serta dukungan medis dan psikologis untuk melindungi anak-anak dari kekerasan seksual. ABSTRACTChild sexual abuse is a serious threat that impacts the lives of children and the security of society. The Indonesian government has taken serious steps by imposing severe criminal sanctions, including chemical castration, to combat this crime. The research uses a normative juridical approach by analyzing legal materials and theories related to chemical castration against perpetrators of child sexual abuse, with the aim of understanding the application of this sanction in the best interests of children. The research shows that child sexual abuse requires a firm legal response, including additional sanctions such as chemical castration. However, the effectiveness of this sanction is still debated in relation to preventing repeat sexual violence. The procedure for implementing chemical castration involves clinical evaluation and rehabilitation after the offender has completed the sentence. Although regulated as a legal response, the implementation of chemical castration requires careful medical, social and legal considerations. The ultimate goal is to prevent repeat sexual violence and provide a deterrent effect. Strong preventive measures and medical and psychological support are needed to protect children from sexual violence.

Abstract

The purpose of this research is to examine criminal judgements made below the specific minimum threshold in regional head election cases that pose a dilemma between justice and legal certainty. This research uses secondary data collected from literature study; normative juridical method and descriptive analysis are used. The results show that the objectives of punishment are affected by verdicts below the specific minimum, especially in terms of public order and the integrity of the democratic process. Although this may override the principle of legal certainty, judges usually prioritise a sense of justice by considering the defendant's mitigating factors. In summary, a clearer revision of the regulations should be included with the penal policy and its implementation. This will help judges balance substantive justice and legal certainty.
