Abstract

Pengawasan dana desa menjadi fokus penting dalam pelaksanaan desentralisasi di Indonesia, mengingat tingginya alokasi anggaran dan potensi penyalahgunaan dana. Penelitian ini bertujuan untuk menganalisis efektivitas pengawasan dana desa oleh Inspektorat Kabupaten Cianjur berdasarkan Peraturan Pemerintah No. 12 Tahun 2017, mengidentifikasi kendala pelaksanaan, serta merumuskan strategi penguatan pengawasan. Metode yang digunakan adalah pendekatan kualitatif dengan studi kasus, melalui wawancara, analisis dokumen, dan observasi di lapangan. Hasil menunjukkan bahwa Inspektorat berperan tidak hanya sebagai pengawas, tetapi juga sebagai konsultan dan penjamin mutu melalui kegiatan reviu, monitoring, dan audit. Pemanfaatan teknologi informasi melalui sistem pelaporan pelanggaran (whistleblowing system) dan media sosial turut meningkatkan partisipasi masyarakat dalam pengawasan. Namun, keterbatasan sumber daya manusia dan cakupan wilayah pengawasan yang luas menjadi hambatan signifikan. Penelitian ini merekomendasikan penguatan kapasitas kelembagaan, digitalisasi sistem pengawasan, serta sinergi antara Inspektorat, desa, dan masyarakat untuk mewujudkan tata kelola dana desa yang transparan, akuntabel, dan berkelanjutan.

Abstract

The policy of mandatory relocation in post-disaster areas, particularly in Cianjur's red zones, plays a crucial role in mitigating risks associated with earthquakes and other natural disasters. This study analyzes the implementation of this policy from the perspective of local government tasks and functions, focusing on the coordination of various stakeholders, legal frameworks, and community involvement. The research uses a qualitative approach, combining legal-normative and sociological perspectives to explore the challenges and conflicts faced during the relocation process. Findings indicate that while the policy has been crucial in safeguarding public safety, its implementation has faced significant challenges such as budget constraints, community resistance, and logistical issues. The study highlights the importance of improving collaboration among local authorities, security agencies, and affected communities. The findings also suggest the need for a more transparent and inclusive approach to policy implementation, ensuring the protection of displaced populations' rights.

Abstract

The increasing involvement of children in narcotics abuse in Indonesia poses significant challenges for juvenile justice and child protection systems. This study examines the criminal responsibility of child offenders from a restorative justice perspective, focusing on the implementation of diversion and rehabilitative approaches. Using normative legal research and analysis of legislation, case studies, and court decisions, particularly case No. 53/Pid.Sus.Anak/2017/PN.Jkt.Brt, the research highlights the gap between progressive laws and their practical application. Findings reveal inconsistent diversion efforts and limited rehabilitation support, resulting in punitive rather than restorative treatment of child offenders. The study concludes that comprehensive reform is necessary to ensure a juvenile justice system that prioritizes the best interests and future well-being of children involved in narcotics offenses.
