Abstract

The emergence of AI-generated illustrations challenges copyright frameworks globally. This normative study compares Indonesia's static Copyright Law with Sweden's progressive EU-aligned system. While both jurisdictions deny copyright to purely AI-created works due to unmet originality requirements, Sweden's sophisticated approach through neighboring rights and AI Sweden's R&D initiatives demonstrates greater adaptability. Indonesia's rigid human authorship mandate under Article 1(2) UUHC 28/2014 risks technological irrelevance. The analysis recommends Indonesia establish specialized AI governance mechanisms and adopt tiered protection for human-AI collaborations, emulating Sweden's balanced approach under the EU AI Act. Strategic alignment with WIPO standards could bridge the growing regulatory gap while preserving creator rights. The findings highlight the urgent need for developing nations to modernize intellectual property systems in response to disruptive technologies. Sweden's dual strategy of legislative harmonization and research investment offers a replicable model for jurisdictions facing similar AI challenges. This comparative analysis contributes to global discourse on copyright adaptation in the age of generative AI.

Abstract

The development of information technology in healthcare systems has encouraged the digitalization of medical records, raising new legal issues concerning the protection of patients’ personal data. This study aims to analyze the legal responsibility of hospitals in securing electronic medical records and to evaluate whether existing Indonesian regulations provide adequate legal protection. This is a normative legal research using statutory and conceptual approaches, based on primary and secondary legal materials. The results show that hospitals hold clear legal responsibility to protect patient data security, as mandated by Law Number 17 of 2023 on Health, Law Number 27 of 2022 on Personal Data Protection, and other related regulations. The legal responsibility includes civil, criminal, and administrative aspects. Although a legal framework is in place, its implementation remains insufficient due to the lack of comprehensive sector-specific technical regulations. Therefore, operational derivative regulations, improved hospital information security systems, and stronger government oversight and public participation are necessary to ensure the effective protection of patients' privacy rights in the digital era.

Abstract

Trademark protection plays a crucial role in supporting the sustainability and competitiveness of Micro, Small, and Medium Enterprises (MSMEs), particularly in responding to developments in digital technology and artificial intelligence. This community service program was conducted to enhance the legal awareness and technical skills of MSMEs in Banyumas in the process of trademark registration and digital monitoring. The implementation methods included preliminary observation, problem identification, legal counseling, technical training on electronic registration through the Directorate General of Intellectual Property, and the introduction of digital-based trademark monitoring tools. The results indicate an increase in participants' understanding of the importance of trademark protection, their ability to prepare administrative documents, and their capacity to utilize technology for independent monitoring. The discussion demonstrates that an experience-based educational approach combined with structured mentoring effectively promotes MSME engagement in legal processes. This program contributes to strengthening the legal and digital capacity of MSMEs in addressing legal challenges within the context of digital transformation.
