Abstract

Interfaith marriage refers to a union between individuals adhering to different religious traditions. In Indonesia, characterized by its religious diversity, individuals generally maintain their commitment to their respective faiths. This research aims to present an in-depth exploration of interfaith marriage within the framework of Islamic law, serving as a valuable reference for legal and social studies. As outlined in Article 40(c) of the Compilation of Islamic Law (KHI), muslim men are strictly forbidden from entering into marriage with women who adhere to a different religion. Similarly, Article 44 of the same legal framework explicitly forbids Muslim women from entering into marriage with non-Muslim men. This research employs a normative legal method, relying on secondary data sources such as legislation, online resources, and scholarly literature. Data collection was conducted through a library research approach, involving the analysis and interpretation of relevant theories and literature. The findings suggest that interfaith marriages are influenced by the plurality of religions in Indonesia and by patterns of social interaction. Nonetheless, in Islamic teachings, Marriage is conceptualized as as a union that encompasses both physical and spiritual bonds between a man and a woman, aimed at forming a harmonious and enduring family founded upon faith in the One Supreme God

Abstract

The primary objective of this study is to highlight the importance of mediation as a more effective alternative method for resolving joint property disputes compared to conventional litigation approaches. Joint property disputes have become an increasingly pressing issue in the realm of family and civil law. These conflicts often arise in the context of divorce, which can cause tension and uncertainty for the parties involved. According to the decision directory of the Supreme Court of Indonesia, there were 2,316 cases of joint property disputes in 2023, indicating that joint property conflicts are widespread. This underscores the urgent need for a more effective alternative solution. The formal legal approach traditionally used in resolving joint property disputes has various limitations. One major constraint is the lack of integration among the various relevant approaches in the mediation process. This study employs three approaches: psychological, economic, and philosophical. Data collection is based on a literature review and utilizes a qualitative descriptive method for data analysis. The study's findings indicate that mediation offers significant advantages over conventional litigation for dispute resolution. The integrated mediation model developed in this study, which combines psychological, economic, and philosophical approaches, is expected to address the weaknesses of existing mediation approaches. With a holistic and adaptive approach to the complexities of joint property disputes, this model has the potential to improve the effectiveness and efficiency of dispute resolution and provide tangible benefits to the involved parties. Tujuan utama dari penelitian ini adalah menyoroti pentingnya mediasi sebagai metode alternatif yang lebih efektif untuk menyelesaikan sengketa harta bersama dibandingkan dengan pendekatan litigasi konvensional. Sengketa harta bersama telah menjadi isu yang semakin mendesak dalam ranah hukum keluarga dan perdata. Konflik ini sering kali timbul dalam konteks perceraian yang dapat menimbulkan ketegangan dan ketidakpastian bagi para pihak yang terlibat. Berdasarkan Direktori Putusan Mahkamah Agung Indonesia pada tahun 2023 terdapat 2316 kasus sengketa harta bersama, ini menunjukkan bahwa persengeketaan harta bersama ada sacara masif. Hal ini menunjukkan kebutuhan mendesak untuk solusi alternatif yang lebih efektif. Pendekatan hukum formal yang selama ini digunakan dalam penyelesaian sengketa harta bersama memiliki berbagai keterbatasan, Salah satu kendala utama adalah kurangnya integrasi antara berbagai pendekatan yang relevan dalam proses mediasi.  Penelitian ini menggunakan tiga pendekatan yaitu pendekatan psikologis, ekonomis dan filosofis. Metode pengumpulan data berbasis studi kepustakaan, dan menggunakan metode deskriptif kualitatif dalam menganalisis data. Hasil penelitian menunjukan bahwa Mediasi menawarkan keuntungan signifikan dari pada penyelesaian sengketa secara litigasi konvensional, Model mediasi terintegrasi yang dikembangkan dalam penelitian ini, yang menggabungkan pendekatan psikologis, ekonomis, dan filosofis, diharapkan dapat mengatasi kelemahan dari pendekatan mediasi yang ada saat ini. Dengan pendekatan yang holistik dan adaptif terhadap kompleksitas sengketa harta bersama, model ini berpotensi meningkatkan efektivitas dan efisiensi penyelesaian sengketa, serta memberikan manfaat nyata bagi para pihak yang terlibat.
