Abstract

The subject matter discussed is how the right to vote for people with mental / memory disorders in Law No. 07 of 2017 on General Elections and fiqh Siyasah's analysis of the law. The type of research method used is a method of literature research that is normative juridical, with a statute approach (statute approach) that is to examine all laws related to the subject that aims to see consistency and perness between one regulation with another. From the results of this study it can be concluded that Law No. 07 of 2017 on General Elections has differences regarding voting rights for people who are mentally disturbed / memory of the Constitutional Court Decision No. 135 / PUU / -XIII / 2015. This is because the general election law does not limit the right to vote for people who are disturbed by the soul / memory so that they experience legal vacancies and legal uncertainties that cause multi-interpretation of the law, while the Constitutional Court Decision No. 135 / PUU / -XIII / 2015 clearly and unequivocally ruled that people with mental disorders / memories cannot vote in general elections. and technically it is proven through the certificate of a health expert. Keywords: Consistency, Right, Vote, Siyasah.

Abstract

Abstract

The dismissal of State Civil Apparatus (ASN) without pension rights by the Head of the State Civil Service Agency (BKN) has raised complex legal issues, especially in the context of protecting ASN rights. This study aims to analyze the decision of the State Administrative Court (PTUN) Number: 85/G/2016/PTUN-BDG regarding the dismissal of ASN without pension rights and to assess the decision from the perspective of Siyasah Qadhaiyyah. Siyasah Qadhaiyyah, as one of the branches of science in Islamic fiqh that regulates public policy, provides a different perspective in assessing government policies, including in terms of dismissal of ASN. In this case, the Mayor's Decision Number 881/Kep.117-BKD/VI/2016 concerning the implementation of the Decree of the Head of BKN No. 04755/01/Kep/BHT/TT/2002 is also an important issue, considering that the Mayor's decision is based on the rules issued by the Head of BKN. This analysis shows that there is a discrepancy between the administrative decisions taken by the Head of BKN and the Mayor with the principles of justice in Siyasah Qadhaiyyah, which requires the protection of individual rights, including ASN pension rights. This article aims to provide recommendations regarding a more equitable ASN dismissal policy, by considering broader legal and policy principles

Abstract

The election of a village head is a manifestation of popular sovereignty at the village level, aiming to produce leaders who are just, have integrity, and prioritize the interests and welfare of the community. However, in practice, village head elections are often tainted by campaign violations, especially money politics. This phenomenon undermines democratic values, as people's votes can be bought, thus compromising the legitimacy of leadership. This study highlights the 2023 village head election in Medan Estate VIII, Percut Sei Tuan District, Deli Serdang Regency, where strong indications of money politics were found, including cash handouts, basic goods distribution, and promises of projects or positions. The research is analyzed through the perspective of Fiqh Siyasah Dusturiyah, which views leadership as a trust (amanah) and strictly prohibits risywah (bribery), as it contradicts the principles of justice and public interest. In Indonesia's positive law, money politics is considered a criminal act as regulated in various legal instruments such as Law No. 7 of 2017, Law no. 6 of 2014 on Villages, and Government Regulation no. 11 of 2019. This study aims to contribute both academically and practically in building a clean and fair electoral system aligned with Islamic principles, while also raising public awareness of the dangers of transactional politics.

Abstract

This study analyses changes in the authority of the Election Supervisory Agency (Bawaslu) in resolving administrative violations in regional head elections following Constitutional Court Decision No. 104/PUU-XXIII/2025 from the perspective of Siyasah Dusturiyah. Using a legal-normative approach and conceptual analysis, this study examines the shift in Bawaslu's position from a recommendatory supervisory body to a quasi-judicial body with the authority to issue final and binding administrative decisions. The results of the study show that strengthening Bawaslu's authority reinforces legal certainty, increases the effectiveness of supervision, and creates balance between election organisers. From a Siyasah Dusturiyah perspective, this policy reflects the implementation of the values of hisbah, ʿadl, and amanah in modern political governance. Normatively and empirically, the synergy between constitutional law and Islamic sharia values strengthens the moral and legal legitimacy of fair and integrity-based election supervision.

Abstract

This study aims to analyze the implementation of Article 41 of the Regional Regulation of Medan City Number 9 of 2016 concerning the Administration of Road Traffic and Transportation on the roadworthiness of city buses in Medan City, and to examine it from the perspective of siyāsah dustūriyyah. This research employs an empirical legal research method with a qualitative approach, conducted through interviews with the Medan City Transportation Agency, field observations, and the study of laws and regulations as well as fiqh al-siyāsah literature. The results of the study indicate that normatively, Article 41 has regulated the obligation to fulfill technical requirements and the roadworthiness of city buses through periodic KIR testing every six months. However, empirically, its implementation has not been optimal, as evidenced by the continued operation of city buses that are not roadworthy and a decrease in the number of buses passing the KIR test. These conditions are influenced by limited supervision, low compliance among transportation business operators, and a lack of socialization. From the perspective of siyāsah dustūriyyah, the policy on the roadworthiness of city buses constitutes part of the constitutional responsibility of local governments in realizing public welfare (maṣlaḥah ‘ammah), particularly the protection of life (ḥifẓ al-nafs). The suboptimal implementation reflects the failure to fully uphold the mandate of authority in accordance with the principles of justice, benefit, and public safety protection within Islamic constitutional law. This study emphasizes the need to optimize supervision, law enforcement, and legal awareness in order to achieve a safe, orderly, and equitable public transportation system in Medan City.
