Abstract

This research aims to compare the roles of notaries and advocates in Indonesia and Malaysia. The urgency of this research is to provide better insight into the topic. The novelty of this research lies in the comparative approach offered in this analysis in the legal context of Indonesia and Malaysia. This research uses a qualitative approach with data sources in documentation and observation. The analysis tool chosen is Nvivo 12 Plus. The findings of this study succeeded in identifying striking similarities and differences in the roles of these two professions. The main similarity in the role of notaries in Indonesia and Malaysia is the function of legalizing and enforcing the validity of legal documents. Notaries in both countries certify documents and ensure compliance with applicable laws. However, the most significant difference lies in the two countries' scope of duties, legal authority, and notary education systems. The main similarities in the role of advocates in Indonesia and Malaysia include legal representation, providing legal advice, and filing legal documents. However, the main differences relate to the scope of the case, legal system, educational requirements, legal language, and legal culture. This shows differences in the two countries' legal contexts and legal demands. Thus, the roles of notaries and advocates in Indonesia and Malaysia have basic similarities in legalizing documents and legal representation but significant differences in the scope of duties, legal authority, education system, and legal and cultural context.

Abstract

Platform work has gained significant recognition due to the rapid growth of the digital economy, which offers new opportunities for workers. However, inadequate regulatory frameworks in Malaysia have led to various human rights concerns, particularly regarding the protection of workers' rights, such as social security, fair remuneration and safe working conditions. Furthermore, the challenge of providing worker protections must be balanced with the flexible nature of the gig economy. Thus, this study explored the evolving legal landscape surrounding the protection of platform workers’ rights in Malaysia from both legal and human rights perspectives. It examines the role of business and human rights in finding the delicate balance between economic progress and protecting workers’ fundamental rights, emphasizing the role of regulation. This study adopts a qualitative approach through review of existing literature, including academic research, reports, and relevant legal documents, to provide a comprehensive understanding of the issue. Therefore, this study underscores the urgent need for robust legal frameworks and regulatory measures to safeguard the rights and welfare of platform workers in Malaysia through the integration of corporate responsibility to respect human rights and to establish mechanisms that guarantee fair remuneration, job security, social protection, and avenues for workers’ representation and collective bargaining. The findings of this study are expected to contribute to the growing body of literature on platform work and serve as a basis for policy recommendations and advocacy efforts to improve the rights and working conditions of platform workers in Malaysia.

Abstract

Penelitian ini membahas perbandingan regulasi cyber notary di Inggris dan Singapura, dengan fokus pada regulasi yang diambil masing-masing negara. Tujuan dari penelitian ini adalah untuk mengidentifikasi perbedaan signifikan di antara kedua negara tersebut, termasuk tantangan utama yang dihadapi, efektivitas dalam praktek, serta implikasi dan rekomendasi untuk negara lain. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus komparatif antara Inggris dan Singapura untuk menganalisis implementasi cyber notary. Analisis data dilakukan dengan pendekatan tematik, dibantu alat analisis Nvivo 12 Plus. Hasil penelitian menunjukkan bahwa perbandingan regulasi cyber notary di Inggris dan Singapura mengungkapkan perbedaan signifikan dalam pendekatan dan prioritas masing-masing negara. Inggris menekankan pengakuan hukum penuh terhadap tanda tangan elektronik dan melakukan penyesuaian regulasi pasca-Brexit, sementara Singapura lebih fokus pada keamanan transaksi dan perlindungan data. Meskipun Inggris lebih fleksibel dan inovatif, tantangan keamanan data dan ketidakpastian hukum pasca-Brexit menjadi isu utama. Sementara itu, Singapura menghadapi kompleksitas regulasi dan kesenjangan adopsi teknologi di kalangan populasi tertentu. Implikasi untuk negara lain mencakup perlunya regulasi yang jelas untuk mendukung penggunaan dokumen digital, investasi dalam infrastruktur dan keamanan siber, serta peningkatan pendidikan digital. Pengalaman kedua negara dapat menjadi pedoman bagi negara-negara lain, termasuk Indonesia, untuk mengembangkan regulasi yang terintegrasi dan meningkatkan infrastruktur, sehingga Cyber Notary dapat berkontribusi pada sistem hukum digital yang modern dan aman.

Abstract

This study investigates the adaptation of notary practices in Indonesia in response to digital transformation, focusing on implementing cyber notary systems. This research focuses on analyzing the opportunities, challenges, and integration of traditional legal principles in the implementation of cyber notaries in Indonesia. Furthermore, this study aims to formulate a framework that supports the effective, safe, and sustainable implementation of cyber notaries in accordance with applicable legal provisions. This research uses normative legal methods with a conceptual and legislative approach to analyze the suitability of existing regulations for the implementation of cyber notaries in Indonesia. Thematic analysis using NVivo 12 Plus was used to identify patterns and relationships between themes from secondary legal sources, which were then validated normatively. The findings reveal that while cyber notary adoption can enhance notarial service delivery, significant obstacles remain, including limited digital literacy, inadequate technological infrastructure, and insufficient legal frameworks. The research highlights the necessity of comprehensive legal reform and increased public awareness to ensure the legality, fairness, and transparency of electronic document management. By proposing a legal framework tailored to Indonesia’s civil law context, this study contributes to the discourse on legal modernization and offers policy recommendations to strengthen public trust in digital legal services. This research normatively contributes to formulating a clear, legitimate, and transparent legal framework for cyber notaries in Indonesia.

Abstract

This study examines the social challenges and technology adoption processes in online notarial practices in Indonesia and Malaysia during and after the COVID-19 pandemic. The study employed a qualitative approach, involving in-depth interviews and document analysis. The analysis tool used was NVivo 12 Plus for coding optimization. The novelty of this study lies in its cross-country comparative analysis, specifically examining the interrelationships between social dynamics, digitalization, and legal challenges in online notarial practices in Indonesia and Malaysia during and after the COVID-19 pandemic, a previously unstudied approach. The main findings of this study indicate that the transformation of notarial practices in Indonesia and Malaysia after the COVID-19 pandemic was significantly influenced by the interaction between social dynamics, digital literacy levels, and legal regulatory readiness. Indonesia faces challenges such as legal uncertainty, gaps in access to technology, and low trust in digital services. At the same time, Malaysia has demonstrated faster adaptation due to a clearer regulatory framework and greater acceptance of technology. Differences in legal systems (civil law and common law) also shape the flexibility with which online notarial practices can respond to digitalization, thereby affecting the validity, legitimacy, and sustainability of online notarial practices in both countries. The digital transformation of notarial practice demands greater legal certainty through clear, adaptable regulations to ensure the validity, security, and legitimacy of online notary services. Therefore, harmonizing cybernotary regulations and strengthening digital governance are necessary to ensure that technological innovation aligns with fundamental legal principles.

Abstract

The Omnibus Law on Job Creation is a significant piece of regulatory reform introduced by the Indonesian government to boost investment competitiveness and stimulate economic growth by streamlining cross-sector regulations, including labour law. However, the reform has sparked debate about whether workers, particularly contract workers who are vulnerable in the labour market, are adequately protected by the law. This research aims to analyse the complexities surrounding the implementation of the Omnibus Law on Job Creation and its implications for the welfare and legal protection of contract workers in Indonesia. This research employs a qualitative legal approach, using document analysis and network content analysis of industrial relations dispute decisions issued by the Supreme Court of the Republic of Indonesia between 2020 and 2024. NVivo 12 Plus was used to support systematic coding and visualisation. The results indicate that, while regulatory changes under the Omnibus Law increase labour market flexibility, they also create legal uncertainty for contract workers, affecting income stability, employment security and access to labour rights. It is concluded that the policy creates an imbalance between investment-oriented objectives and the constitutional mandate to protect workers' welfare. Therefore, a regulatory review and a more inclusive policy formulation process are necessary to ensure fair and sustainable labour protection.
