Abstract

Tujuan penelitian menganalisis efektivitas penyidikan tindak pidana pencemaran nama baik melalui media sosial di Polrestabes Makassar. Metode penelitian ini menggunakan tipe penelitian hukum normatif dan hukum empiris. Hasil penelitian ini menunjukkan bahwa penyidikan tindak pidana pencemaran nama baik melalui media sosial di Polrestabes Makassar kurang efektif dikarenakan terkendala oleh identitas beberapa terlapor yang menggunakan akun palsu atau identitas pemilik akun tersebut tidak diketahui. Faktor-faktor yang mempengaruhi efektivitas penyidikan tindak pidana pencemaran nama baik melalui media sosial di Polrestabes Makassar adalah faktor substansi hukum, faktor struktur hukum, faktor budaya hukum serta faktor sarana dan prasarana. The research objective is to analyze the effectiveness of investigating criminal acts of defamation through social media at the Makassar Police Station. This research method uses the type of normative legal research and empirical law. The results of this study indicate that the investigation of criminal defamation through social media at Polrestabes Makassar is less effective because it is constrained by the identity of several reported parties who use fake accounts or the identity of the account owner is unknown. The factors that affect the effectiveness of the investigation of criminal acts of defamation through social media at the Makassar Polrestabes are the legal substance factor, the legal structure factor, the legal culture factor and the facilities and infrastructure factor.

Abstract

This study explores the implementation of restorative justice as a form of efficiency in handling misdemeanor cases at the Makassar Police. The need for humane and efficient justice for the handling of minor crimes, where the restorative approach is an alternative that is increasingly encouraged. The purpose of this study is to analyze the handling of misdemeanor crimes through restorative justice as a form of efficiency in the Makassar Police by identifying the implementation of restorative justice for misdemeanor cases and the factors that hinder their success. The method used is a qualitative approach with a descriptive design, which involves data collection through literature studies and interviews related to the implementation of restorative justice in the institution. The results of the study show that the use of restorative justice is able to accelerate the resolution of minor criminal cases, increase the sense of justice for victims and perpetrators, and reduce the burden on the formal justice system. However, its implementation is still hampered by several factors such as abuse of authority from investigators and public resistance

Abstract

The absence of a clear time limit for criminal investigations under the Indonesian Criminal Procedure Code (KUHAP) has frequently resulted in protracted investigations, effectively keeping individuals in a state of perpetual suspecthood. Textually, Article 77 of KUHAP limits the scope of pretrial review (praperadilan) to a closed list, without explicitly including investigation delays as a reviewable matter. This limitation generates legal uncertainty for suspects and impedes the protection of fundamental human rights guaranteed in criminal proceedings. This study examines the urgency of expanding the scope of pretrial review to encompass unduly prolonged investigations. Using a qualitative method with a normative-juridical approach, it analyzes primary, secondary, and tertiary legal materials to identify legal gaps and propose normative solutions. The findings indicate that investigations prolonged without reasonable justification violate human rights and undermine the principles of prompt, simple, and low-cost justice. From a progressive law perspective, pretrial applications challenging undue delay should be admissible to prevent abuse of authority by investigators. Consequently, unreasonably prolonged investigations lacking active and genuine investigative measures should be construed as a form of material termination of investigation. The study recommends that pretrial judges apply progressive legal reasoning (rechtsvinding) to accept such applications, thereby ensuring legal certainty and restoring the rights of suspects affected by defective judicial administration
