Abstract

Divorce can be legally obtained through religious courts. However, many married couples still choose to divorce outside of court, a practice known as “illegal divorce.” As a result, the husband fails to fulfill his obligation to provide iddah and mut’ah maintenance to his wife. This study aims to investigate the impact of women's rights on iddah and mut’ah maintenance following illegal divorce in the village of Koto Panai. The research method employed is qualitative, utilizing a legal-empirical approach in the form of field research. The research informants include 5 families (husband and wife) post-illegal divorce, community leaders, and the Religious Affairs Office. Data collection methods include observation, interviews, and documentation. Data analysis was conducted through data reduction, data presentation, and conclusion drawing using triangulation techniques. The research results indicate that the impact of women's rights on iddah maintenance after illegal divorce is significant, both economically, psychologically, and socially. Illegal divorce can also have various negative impacts on women, men, and children. Illegal divorce can also have various negative impacts, not only on women and men, but also on children in families after illegal divorce. The causes are diverse, such as economic and communication factors. Meanwhile, the social impact of illegal divorce has negative consequences for women, such as loss of economic rights, child custody rights, and social stigma. Based on the results of this study, we identified the social impact of illegal divorce on women's rights, as well as an analysis of the factors that influence the social impact of illegal divorce on women's rights.

Abstract

Understanding customer switching behaviour patterns from conventional to Islamic banks forms the basis for analysing various motives or reasons. Essentially, the switching principle, whether in terms of savings, transactions, or investments, contributes to the emergence of the code of using Islamic banks as either a choice or in totality. This research is a phenomenological study with a descriptive qualitative analysis, which provides information on the direct pattern of customer switching behaviour. The study focuses on minority groups in the city of Padang, namely the Muslim and non-Muslim Chinese ethnic groups, who are predominantly entrepreneurs. The study results indicate that the switching behaviour of Chinese ethnic customers in Padang, who choose Islamic banks, is driven by various motives. Religious motives influence Muslim Chinese ethnicity due to fears about transactions prohibited by Islamic law, such as those containing ribawi elements. Other explanations include the need for Islamic banks, development and concern for Islamic banks, and commercial reasons like using cash flow transactions or inflows and outflows through interbank transfers using Islamic bank services, salary receipts, security, and service comfort. The final motive is the perception that Islamic bank products are more attractive and diverse. Non-Muslim Chinese ethnicity is influenced by security, especially from certain burdens, particularly on Wadi’ah Amanah savings products, which allow saving without incurring fees.

Abstract

Aturan Nagari Sungai Talang yang berbasis lisan mengalami penurunan efektivitas akibat lemahnya penegakan sanksi dan perubahan norma sosial. Latar belakang masalah ini terlihat dari banyaknya pelanggaran aturan, seperti ketidakpatuhan terhadap larangan keluar malam bagi perempuan dan pelonggaran sanksi bagi pelaku zina (dari pengarakan menjadi denda material). Permasalahan ini diperparah oleh kurangnya dokumentasi tertulis dan minimnya pemahaman generasi muda terhadap nilai adat. Untuk mengatasi hal ini, diusulkan tiga langkah solutif: (1) kodifikasi aturan lisan menjadi dokumen resmi yang terstandarisasi, (2) revitalisasi sanksi adat dengan menyesuaikan tingkat pelanggaran, dan (3) sosialisasi intensif melalui forum musyawarah dan media digital. Tujuan kegiatan ini adalah memperkuat legitimasi aturan Nagari, meningkatkan kepatuhan warga, dan mengembalikan fungsi aturan sebagai penjaga ketertiban sosial. Metode pelaksanaannya meliputi: pendokumentasian aturan dengan Nagari,tokoh adat, Pemuda, Bundo Kanduang dan Bamus, penyusunan pedoman sanksi berjenjang, serta kampanye melalui kanal komunikasi pemuda. Hasil yang diharapkan mencakup terciptanya payung hukum tertulis, penurunan angka pelanggaran, dan peningkatan partisipasi masyarakat dalam penegakan aturan. Kesimpulannya, pendekatan multidimensi ini tidak hanya mengatasi kelemahan aturan lisan tetapi juga memperkuat ketahanan budaya Nagari terhadap dinamika perubahan sosial. Implementasi kegiatan diharapkan mampu menjadi model tata kelola adat berkelanjutan bagi nagari lainnya di Sumatera Barat.
