Abstract

Masalah tanah merupakan isu penting yang berkaitan dengan berbagai aspek kehidupan masyarakat, terutama di negara-negara maju dan berkembang. Di Indonesia, di mana sebagian besar penduduk bergantung pada pertanian, kebutuhan tanah untuk pembangunan menjadi krusial. Undang-Undang Nomor 5 Tahun 1960 menegaskan bahwa semua hak atas tanah memiliki fungsi sosial, yang berarti penggunaan tanah tidak boleh hanya untuk kepentingan pribadi jika dapat merugikan masyarakat. Penggunaan tanah harus sejalan dengan Rencana Tata Ruang dan memperhatikan kesejahteraan bersama. Selain itu, Pasal 33 Ayat (3) UUD 1945 menyatakan bahwa sumber daya alam dikuasai oleh negara untuk kemakmuran rakyat. Pengadaan tanah untuk kepentingan umum diatur dalam UUPA dan UUP 2 Tahun 2012, yang menjamin hak-hak individu dan memberikan ganti kerugian yang layak bagi pemilik tanah yang terkena dampak. Dengan demikian, pengaturan ini bertujuan untuk mencapai keadilan dan kesejahteraan bagi seluruh rakyat.

Abstract

The land dispute between PT Freeport Indonesia, the Indonesian Government, and the Papuan community has been a long-standing issue with significant economic, environmental, and social implications. This analysis delves into the complexities of the conflict, exploring the historical context, legal frameworks, and the perspectives of all parties involved. It examines the root causes of the dispute, the environmental and social impacts of Freeport's operations, and the challenges in finding a resolution that balances economic interests with environmental protection and community rights. The analysis also investigates the role of the Indonesian Government as a mediator and regulator, and the efforts made to address the concerns of the Papuan community. Ultimately, this comprehensive analysis aims to provide insights and recommendations for a fair and sustainable resolution to this complex land dispute.

Abstract

Keywords: Abstract Intellectual Property Rights; Trademark Protection; Small and Micro Enterprises (SMEs)Finger Board; Intellectual Property Rights, particularly trademark rights, play an essential role for the Small and Micro Enterprise (SME) of “Mainan Papan Jari” located in Block A, Kebayoran Baru, Jakarta Selatan, which still faces the problem of limited understanding regarding the urgency of trademark protection and its registration procedures. The partner location was selected because the area serves as a center for creative SMEs that require enhanced legal literacy to strengthen their business identity. The implementation method involved legal counseling on the function and protection of trademarks, interactive discussions, and technical assistance in completing and submitting trademark registration documents to the Directorate General of Intellectual Property (DGIP). The results show that the partner experienced improved understanding of the legal and strategic benefits of trademark protection for business sustainability. Moreover, the provided assistance enabled the partner to complete the trademark registration process officially. This activity contributes to strengthening the legal protection of the business identity and enhancing the competitive value of the “Mainan Papan Jari” SME in an increasingly competitive market.
