Abstract

Perkembangan teknologi, informasi, dan komunikasi sudah tidak dapat dipungkiri kembali. Kini teknologi sudah terus berkembang sehingga menjadikannya bagian dari kehidupan sehari-hari. Salah satu bentuk perkembangan teknologi terkni adalah hadirnya Metaverse di tengah-tengah masyarakat. Merek-merek terkenal dan ternama pun kini berlomba-lomba memasuki dunia Metaverse untuk memasarkan produknya. Sayangnya, pelanggaran merek terkenal masih marak terjadi tidak di dunia nyata namun di dunia siber pun dialami oleh merek terkenal. Umumnya pelanggaran yang terjadi bersifat merusak reputasi merek terkenal di mata masyarakat, di mana hal ini tercerminkan melalui kasus Nike v StockX. Penelitian ini bertujuan untuk mengetahui perbandingan hukum merek Indonesia dan Amerika Serikat atas perlindungan sebuah merek terkenal di Metaverse beserta sanksi hukum yang dapat diberikan kepada pihak yang menggunakan merek terkenal tanpa izin dalam Metaverse. Metode penelitian yang digunakan dalam penelitian ini adalah Metode Yuridis Normatif yang dimana peneliti akan mengutip data yang bersifat sekunder seperti peraturan perundang-undangan, jurnal ilmiah, dan buku-buku hukum. Hasil penelitian menunjukkan adanya perbedaan antara perlindungan merek terkenal di Indonesia dan Amerika Serikat di mana Indonesia belum secara eksplisit dan menyeluruh memberikan perlindungan terhadap merek terkenal layaknya Amerika Serikat yang sudah memberikan perlindungan eksplisit dan menyeluruh terhadap merek terkenal.

Abstract

Deepfakes as a derivative subset of the use of artificial intelligence technology have the ability to manipulate images or videos that overlay faces on other people's bodies with the intention of creating new videos with false representations. Initially this deepfakes ability was used in filmmaking and has now been applied to the features of mobile applications, but in reality there is an abuse of its ability to make a video with pornographic content. In Indonesia, there have also been several cases of similar pornographic videos featuring Indonesian artists in their videos and have been spread on the internet. Indonesia itself does not have special regulations regarding artificial intelligence technology, only explicitly stated in Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE). This study was structured using normative juridical methods, using library data collection procedures, and document study data collection techniques. The study was conducted to discuss the legal basis for violations that occur when someone (the perpetrator) abuses the ability of deepfakes to make a video with pornographic content according to Article 29 jo. Article 4 paragraph (1) and Article 35 jo. Article 9 of Law Number 44 of 2008 concerning Pornography is an act that is prohibited and accompanied by criminal sanctions as a form of criminal responsibility for the perpetrators.

Abstract

Instagram platform is used as a media of promoting alcoholic beverages because of its low cost and rapid dissemination of information. However, uploading alcoholic beverage content is against the law because alcoholic beverages cannot be promoted in the mass media, including social media. This study aims to determine how the platform has responsibilities. This research was conducted using a normative juridical approach, that the research was conducted by conducting research through the literature as the main research material. Based on the research conducted, it was found that the legal liability of the Electronic System Operator for the Private Scope of the Instagram Platform is very limited if there is an upload of content that violates the provisions, so that sanctions that can be imposed to suppress the upload of illegal content must be applied to business actors as users of the electronic system.
