Abstract

Abstract. The duties and authority of the Indonesian National Police (Polri) as a law enforcement institution carry significant implications for accountability and integrity in fulfilling their role within society. However, in practice, abuse of power by Polri members is not uncommon and often contradicts the principles of fair law enforcement, as exemplified by the alleged extortion committed by police officers against attendees of the Djakarta Warehouse Project (DWP). This incident not only caused material harm to the victims but also damaged the image and public trust in the Polri institution. This research employs a qualitative method using a normative juridical approach. Data were collected through library research by examining relevant laws and regulations. The study concludes that the elements of the criminal offense under Article 369 of the Indonesian Criminal Code (KUHP) have been fulfilled, as the perpetrator used threats to unlawfully obtain personal gain. The offender may be subject to criminal sanctions, and ethical sanctions do not eliminate criminal liability. However, the enforcement of criminal punishment remains weak due to a lack of transparency and oversight. The author recommends that legal action against Polri members be balanced between criminal and ethical proceedings, and supported by independent supervision to safeguard institutional integrity. Tugas dan kewenangan Kepolisian Negara Republik Indonesia (Polri) sebagai penegak hukum membawa konsekuensi penting terhadap akuntabilitas dan integritas dalam menjalankan fungsinya di tengah masyarakat. Akan tetapi, dalam praktiknya tidak jarang ditemukan adanya penyalahgunaan kekuasaan oleh anggota Polri yang justru bertentangan dengan prinsip penegakan hukum yang berkeadilan seperti kasus pemerasan yang diduga dilakukan oleh anggota Polri terhadap penonton Djakarta Warehouse Project (DWP). Peristiwa ini tidak hanya merugikan korban secara materiil, tetapi juga merusak citra dan kepercayaan terhadap institusi Polri. Metode penelitian yang digunakan adalah metode kualitatif melalui yuridis normatif. Data dikumpulkan melalui studi kepustakaan dengan menelaah peraturan perundang-undangan yang relevan. Penelitian ini menyimpulkan bahwa unsur tindak pidana dalam Pasal 369 KUHP telah terpenuhi, karena pelaku menggunakan ancaman untuk memperoleh keuntungan secara melawan hukum. Pelaku dapat dikenai sanksi pidana, dan sanksi etik tidak menghapus pertanggungjawaban tersebut. Namun, pelaksanaan hukuman pidana masih lemah akibat kurangnya transparansi dan pengawasan. Penulis merekomendasikan agar penegakan hukum terhadap anggota Polri dilakukan secara seimbang antara pidana dan etik, serta didukung oleh pengawasan independen guna menjaga integritas institusi.

Abstract

Purpose: This study examines the implementation of Gross Split Production Sharing Contracts (PSCs) in Indonesia’s upstream oil and gas sector, with particular attention to whether the allocation of rights, obligations, and risks reflects the principles of balance and fairness in contract law. Research/methodology: The research adopts a normative juridical approach using qualitative analysis. Secondary legal materials are analyzed, including oil and gas legislation, government and ministerial regulations, and the contractual provisions of Gross Split PSCs. The analysis focuses on contractors’ obligations related to signature bonuses, firm commitments, and operating costs. Results: The findings indicate that Gross Split PSCs place excessive financial, operational, and technological burdens on contractors, while the government bears minimal risk. Contractors are fully responsible for signature bonuses, firm commitments, and operating costs without cost recovery mechanisms. This contractual structure creates an imbalance of rights and obligations and contributes to contractors’ difficulties in fulfilling firm commitments and achieving agreed production targets. Conclusions: Gross Split PSCs, as currently regulated, do not adequately uphold the principles of balance and fairness. The unequal distribution of risks and obligations undermines contractual justice and the sustainability of upstream oil and gas operations. Limitations: This study is limited to normative legal analysis and does not include empirical field data. Contribution: This research provides theoretical insight into the application of balance and fairness principles in energy contracts and offers practical considerations for improving the Gross Split PSC framework.
