Abstract

This research analyses how the state protects the existence of surat tumbaga holing institutions as a costitutional right of the Angkola Batak community. This research is a normative legal research that is normative empirical in nature which is legal research to find legal rules in the principle of surat tumbaga holing in accordance with the principles of the Indonesian legal system. Primary data used are legal materials from the library and laws and regulations related to legal protection, social structure and local wisdom. To support this data, secondary data is added from the behaviour and values that live in the Angkola Batak community as a living legal norm. The theory used as an analysis knife in this research is Eugen Erlich's legal sociology, where Erlich sees positive law on the one hand and the law that lives in society on the other. Erlich sees that positive law will be effective if it is in line with and incorporates the values and laws that live in society. The results show that the tumbaga holing letter also has a role in resolving problems or criminal acts that occur, such as adultery, domestic violence, verbal insults, defamation or slander, as well as other criminal acts such as theft that can disrupt public welfare. In addition, the sanctions given as punishment to perpetrators involve actions such as being expelled from their customary community, paying a fine to the victim, apologising to the victim or their family in the presence of customary elders, as well as being obliged to cover all food costs incurred during the settlement of the crime. This reality is guaranteed by the state through Article 18 B paragraph (2) which ensures that the state protects, respects and recognises customary law communities and their traditional rights if they are still alive, in accordance with the principles of the Unitary State of the Republic of Indonesia and implemented through legislation. While juridically, it is determined that judges and constitutional judges as law enforcers are obliged to always follow the development of legal values and community justice in adjudicating and deciding cases before them as contained in the judicial power law.

Abstract

Penelitian ini akan meneliti tentang bagaimana transformasi gerakan, ideologi dan pemehaman islam dari gerakan Salafi, Fundamentalis, Islamis hingga Post-Islamis. Peneliti juga ingin melihat bagaimana sirkulasi gerakan salafi fundamentalis hingga akhirnya menjadi islamis dan bagaimana perbedaan antara kedua gerakan tersebut. Kemudian peneliti ingin melihat dan menganalisis dimana posisi gerakan dan pemahaman islam di Indonesia antara Islamis dan Post-Islamis. Penelitian ini merupakan penelitian pustaka library research dengan mengumpulkan data dari pustaka baik itu buku dan artikel jurnal lainnya. Hasil penelitian menunjukkan bahwa pergeseran gerakan islam terbagi menjadi Salafisme, Fundamentalisme, Islamisme dan Post Islamisme. Awalnya gerakan Salafisme memiliki spirit yang sama dengan Fundamentalisme yaitu memurnikan ajaran islam dari segala bentuk amaliyah yang berbau bid’ah. Pada gerakan Islamisme kelompok wahabi ini mulai menyentuh sendi politik da kekuasaan dengan spirit mendirikan negara islam. Gerakan islam di Indonesia sudah mulai bergerak ke arah Post-Islamisme terbukti dengan evaluasi beberapa partai politik islam dan organisasi islam dengan memakai islam moderat sebagai ideologi partainya.

Abstract

This research wants to see how Article 463 in the New Criminal Code accommodates and protects the interests and rights of women's reproductive health. In addition to analyzing how it accommodates women, this study also analyzes how Article 463 of the New Criminal Code is viewed from the perspective of Jaser Auda's Maqashid Syari’ah. Before entering into the analysis, this research first compares Article 463 with the Health Law and the Law on criminal acts of sexual violence. This research uses normative legal research methods using a statutory approach or statute approach. Data sources are obtained from literature including laws and regulations and other internet sources. Primary data sources in this study are Article 463 of Law Number 1 of 2023 concerning the New Criminal Code and Law Number 36 of 2009 concerning Health. The theory used is comparative legal theory and Jaser Auda's Maqashid Syari’ah theory as an analysis knife in solving problems. The results showed that Article 463 of the New Criminal Code compared to the health law is more accommodating to women's interests is the health law because it more broadly explains what is included in sexual violence which is not only focused on three dimensions, namely forced prostitution, rape and sexual slavery. In addition, in terms of considering the health of pregnant women, the health law is more accommodating because it provides exceptions to abortion for pregnant women who have emergency health conditions that endanger themselves and their babies. In Jaser Auda's perspective, this article is not in line with Maqashid Syari’ah because it does not interpret wisdom and justice for all universally, in this case, the woman.
