Abstract

Alternative Dispute Resolution (ADR) has increasingly gained attention as an efficient method for resolving conflicts outside formal litigation channels. This study aims to analyze the advantages of ADR compared to court litigation through a normative juridical approach, using data collected from literature review. The findings indicate that ADR offers several advantages, including time and cost efficiency, procedural flexibility, privacy protection for the parties involved, and the ability to preserve relationships after disputes. In Indonesia, ADR has received legal recognition through Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. However, its implementation still faces challenges such as limited public awareness of ADR, a shortage of competent practitioners, the dominance of litigation culture, and limitations in infrastructure and technological access. To overcome these obstacles and enhance the effectiveness of ADR, systematic efforts are needed, including practitioner competency development, regulatory strengthening, supporting infrastructure development, legal culture transformation, and international cooperation. These findings affirm that, with strategic optimization, ADR has the potential to become a primary solution for establishing faster, more cost-effective, and restorative justice–oriented dispute resolution mechanisms in Indonesia.

Abstract

Komisi Pengawas Persaingan Usaha (KPPU) merupakan lembaga independen yang dibentuk berdasarkan Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Peran KPPU tidak hanya sebatas pengawasan terhadap perilaku pelaku usaha, tetapi juga menjadi instrumen penting dalam mewujudkan prinsip good governance di sektor ekonomi. Artikel ini bertujuan untuk mengkaji fungsi KPPU sebagai instrumen tata kelola pemerintahan yang baik dalam penegakan hukum persaingan usaha. Melalui pendekatan yuridis normatif, penelitian ini menemukan bahwa KPPU berperan penting dalam menjaga transparansi, akuntabilitas, dan keadilan dalam praktik bisnis nasional. Namun, sinergi dengan pemerintah pusat dan daerah masih perlu diperkuat agar penegakan hukum persaingan usaha dapat berjalan efektif dan berkelanjutan. Kata kunci: KPPU, Good Governance, Hukum Persaingan Usaha, Akuntabilitas, Penegakan Hukum Abstract The Business Competition Supervisory Commission (KPPU) is an independent institution established under Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. The KPPU's role extends beyond overseeing business behavior and serves as a crucial instrument in realizing the principles of good governance in the economic sector. This article aims to examine the KPPU's function as an instrument of good governance in enforcing competition law. Using a normative juridical approach, this study finds that the KPPU plays a crucial role in maintaining transparency, accountability, and fairness in national business practices. However, synergy with the central and regional governments still needs to be strengthened to ensure effective and sustainable competition law enforcement.
