Abstract

Purpose: This study analyzes the decision of the Honorary Council of the Constitutional Court Number 02/MKMK/L/11/2023 regarding ethical violations by the Chairman of the Constitutional Court. The Constitutional Court's ruling on the age limit for presidential and vice-presidential candidates sparked public debate and raised concerns about democratic principles in Indonesia. Method: This research uses normative legal methods focusing on coherence among legal principles, concepts, and applicable rules. Results: The findings show that Anwar Usman was proven to have seriously violated the code of ethics and behavior of constitutional judges. In a state governed by law, rulers and citizens are equal before the law. Judges must not abuse their authority for personal or group interests. The MKMK decision seeks to uphold judicial ethics and restore public trust in the Constitutional Court. Conclusion: The findings confirm that violations of judicial ethics at the highest level of the Constitutional Court undermine the principles of impartiality and democracy. The MKMK's decision provides a legal and moral corrective that reaffirms the importance of integrity and judicial independence, with the aim of restoring institutional legitimacy ahead of the 2024 general elections. Limitations: This research is limited to analyzing MKMK Decision Number 02/MKMK/L/11/2023 and the applicable judicial code of ethics. Contributions: The study contributes to strengthening judicial accountability, offers insights for legal scholars, and supports public confidence in constitutional justice.

Abstract

Salah satu fungsi kepala desa adalah menerapkan hukum sebagai sarana untuk mengendalikan dan memperbaharui masyarakat desa atau yang biasa disebut sebagai hakim perdamaian desa. Dalam penyelesaian sengketa warisan ini kepala desa biasanya tidak mengambil keputusan sendiri tetapi bersama para tokoh masyarakat, dan pamong desa lainnya ataupun sesepuh desa tersebut yang mengetahui riwayat dari antara ahli waris yang bersengketa tersebut dan harta peninggalan dari pewaris agar keputusan yang diambil dapat ditaati oleh para pihak dan tidak melenceng dari adat kebiasaan yang hidup di daerah tersebut. Penelitian ini merupakan penelitian empiris yaitu penelitian hukum yang menganalisis tentang penerapan hukum dalam kenyataannya terhadap individu, kelompok, masyarakat, lembaga hukum dalam masyarakat dengan menitikberatkan pada perilaku individu atau masyarakat, organisasi atau lembaga hukum dalam kaitannya dengan penerapan atau berlakunya hukum. Dalam penelitian ini menggunakan data primer dan data sekunder. hasil penelitian bahwa,  Cara penyelesaian sengketa tanah sebagian besar mengadopsi cara mediasi, yaitu cara rekonsiliasi yang diajukan oleh kedua belah pihak yang bersengketa. Cara ini paling berhasil, karena mempunyai akibat hukum, terutama tanah dapat dipidana dengan sertifikat.

Abstract

The digital change in Indonesia's court system has led to the use of electronic court services, known as e-court, to make the legal process more efficient, open, and easier to access. This study looks at two main questions: (1) how the e-court system is used to handle civil cases at the Kefamenanu District Court Class II, and (2) what difficulties come up during its use. The goal of this research is to check how well e-court is working and to find out both technical and non-technical problems faced by the court and the people using it. The research uses a legal method that combines looking at laws with real data collected from the field. Information was gathered directly through conversations with judges, court workers, lawyers, and people who use the courts. Other information came from books and legal rules. The data was studied using a method that describes what is found in detail. The results show that the e-court system at the Kefamenanu District Court Class II is mostly being used as it should, following the Supreme Court's rules from 2022, and helps make the court system simpler, faster, and cheaper. However, there are still some problems, like poor internet connections, system issues, and not enough knowledge of digital tools among the public. These results show that even though e-court makes handling civil cases more efficient, there is still a need to improve the system and help people better understand how to use it.

Abstract

This research is motivated by the failure of the Regent of South Central Timor to implement the decision of the Surabaya Administrative High Court regarding the postponement of the Bileon Village Head election, despite the decision having permanent legal force. This action contradicts the rule of law principle stipulated in Article 1 paragraph (3) of the 1945 Constitution, which requires all government actions to be based on law. The study aims to analyze the legal considerations of the Regent in issuing Decree Number 13/KEP/HK/2022 on the election postponement, examine the legal reasoning of the Administrative High Court judges, and assess the effectiveness of enforcing administrative court decisions in ensuring legal certainty and administrative justice. The research employs a normative juridical approach using statutory and case approaches, with descriptive qualitative analysis based on primary, secondary, and tertiary legal materials. The findings indicate that the Regent’s decree lacks a valid legal basis and violates Law Number 30 of 2014 on Government Administration and Law Number 6 of 2014 on Villages, breaching principles of good governance, particularly legal certainty, proportionality, and justice. The court determined that the Regent’s action constituted abuse of authority. The failure to implement the decision highlights weaknesses in administrative court enforcement mechanisms, emphasizing the need for stricter regulations and sanctions for public officials who disregard court rulings to ensure compliance and uphold legal certainty.
