Abstract

Kupang District is ranked 5 with the highest number of infant mortality in East Nusa Tenggara Province. The total infant mortality 86 and 96 cases in 2018 and 2019, respectively. The purpose of this study was to analyze the risk factors influencing infant mortality in West Kupang Subdistrict. This study used a case-control study design and the respondents were mothers who had babies aged one year old in 2020 with a sample size of 42 people. Data collection used a questionnaire from each variable under the study. The data were analyzed using the chi-square test to see the OR value in order to determine the risk of exposure. The results showed that there was a significant relationship between maternal age during pregnancy (OR= 351; p= 0.000), socioeconomic status (OR= 10.8; p= 0.006) birth weight (OR= 8.2; p= 0.005), premature abnormalities (OR=36; p= 0.000), parity (OR= 5.4; p=0.033), congenital diseases or disorders (OR= 6.6; p=0.000), birth spacing (OR= 8.3; p=0.008), participants in the family planning program (OR= 7.5; p=0.01), antenatal check-up (OR= 8.3; p=0.008), delivery complications (OR= 15; p= 0.000 ), husband's support (OR= 3.8; p= 0.01) with infant mortality. Education and information communication strategies should be improved to create behavior supporting the health of pregnant women and to prevent infant mortality.

Abstract

Stunting toddlers have a risk of decreased intellectual ability, productivity, and an increase in degenerative diseases in the future. The results of the 2018 Riskesdas show that East Nusa Tenggara Province is the province with the highest proportion of of short and very short nutritional status of children under five, which is 42.4%. The purpose of the study was to analyze the risk factors for stunting in children under five in the working area of the Batakte Health Center. The research design was a case-control study. The research subjects were toddlers aged with the case group being stunted toddlers while the control sample was normal toddlers with a ratio of 1:1 as many as 48 toddlers and mothers of toddlers as respondents. Data analysis used the chi-square test and OR calculation to assess risk factors. The research was conducted in the working area of the Batakte Health Center from August-October 2021. Research variabels are history of infectious disease, low birth weight, maternal education, parenting style,maternal occupation age at pregnancy and gestational age. The results showed that there was a relationship between a history of infectious disease (OR=5,000; 95% CI 1,165-21,459), low birth weight (LBW) (OR=5,909; 95% CI 1,546-22.580), maternal education (OR=4,491; 95% CI 1,260-16,006) and parenting style (OR= 6,000; 95% CI 1,711-21,038) with stunting in children under five, while maternal occupation, age at pregnancy and gestational age were not associated with stunting in children under five in the region Batakte Health Center

Abstract

Kejaksaan Negeri Timor Tengah Utara merupakan salah satu unit kerja Kejaksaan Republik Indonesia yang berkedudukan di Kabupaten Timor Tengah Utara yang melalui seksi Intelejennya secara nyata telah melakukan usaha pemberantasan tindak pidana korupsi di wilayah hukumnya. Meskipun demikian dalam pelaksanaannya tidak mudah bagi Intelejen Kejaksaan Negeri Timor Tengah Utara untuk mendapatkan temuan-temuan tindak pidana korupsi dan masih terdapat dugaan-dugaan tindak pidana korupsi yang belum tuntas diselesaikan. Penelitian ini merupakan yuridis empiris yakni penelitian yang mengacu pada efektifitas hukum. Jenis dan sumber data yang diperoleh adalah melalui wawancara sebagai data primer dan didukung dengan data sekunder yang berasal dari buku, peraturan perundang-undangan dan lain-lain. Data yang diperoleh akan diolah dan dianalisis secara dekskriptif-kualitatif. Hasil penelitian ini menunjukan bahwa (1) Kejaksaan merupakan satu landasan dalam pelaksanaan tugas dan wewenangnya di bidang penuntutan, tidak ada lembaga lain yang berhak melakukan penuntutan kecuali yang berada di bawah kendali Jaksa Agung sehingga dimanapun jaksa berada baik jaksa yang dikaryakan Komisi Pemberantasan korupsi (KPK) maupun jaksa yang ditugaskan di daerah merupakan bagian yang tidak terpisahkan dari lembaga kejaksaan. (2) Melakukan kegiatan penyelidikan, pengamanan, dan penggalangan untuk melakukan pencegahan tindak pidana guna mendukung penegakan hukum dan memberikan dukungan intelejen kejaksaan bagi keberhasilan tugas dan kewenangan kejaksaan, melakukan koordinasi serta pemantapan kesadaran hukum masyarakat. (3) Melakukan kegiatan penyelidikan sejak dikeluarkan surat perintah dimulainya penyelidikan kemudian hasil temuan dari penyelidikan diolah dan dianalisis kemudian diberikan kepada pimpinan untuk dipelajari.

Abstract

This study aims to determine the implementation in electronic trials, to determine the impact of technical and substantive constraints on the quality and fairness of electronic trials, to find out whether electronic trials can uphold material truth in special criminal cases of child molestation. In data collection, the authors used interviews and informants. For data analysis techniques, the author uses qualitative descriptive analysis, which in this study uses the results of interviews with six (6) informants. From the results of the study, it can be said that the implementation of electronic trials according to PERMA No. 4 of 2020 in child molestation cases is no different from child molestation trials as usual, the trial procedures are the same as those contained in the Criminal Procedure Code which are different only the location of the parties concerned. The technical obstacles faced are communication network disruption, lack of infrastructure; and lack of human resources Substantive obstacles faced in electronic trials are: relatively closed trials; difficulty of proof; and the judge's difficulty in using the judge's conviction. The impact of technical and substantive constraints is that electronic trials become longer and judges cannot be sure that the evidence presented is legitimately seized. Electronic trials can uphold material truth as the Code of Criminal Procedure was created with the aim of obtaining material truth.

Abstract

The purpose of this research is to analyze the application of the customary sanction "Lais Palolit" in the settlement of theft cases in Boti Village, Kie Subdistrict, South Central Timor District. The type of research used is empirical research. Empirical research can be interpreted as an approach that looks at a legal reality that exists in society. Based on this type of research, the data sources in this study are primary data and secondary data. The data collection techniques used are interviews, observation and documentation. The data collected will be processed through editing, coding and tabulation stages and data analysis is carried out descriptively, qualitatively and completely. Based on this research, several conclusions can be made, namely that all theft cases that occur within the scope of Boti Village must be resolved through the customary law that applies there by carrying out the customary sanction "Lais Palolit". The form of this customary sanction is the provision of additional property to the perpetrator based on what he took. This customary sanction is considered effective in resolving theft cases in Boti village. This customary sanction is different from the provisions stipulated in article 362 of the Criminal Code, but in its application so far the settlement of all theft cases in Boti village has always used the provisions of customary law and has not used the provisions of national law.

Abstract

Along with the development of criminal acts more prevalent time occurs not only adults but also children can also be perpetrators and victims of criminal acts. This is because every child has a different condition from adults, children have physical and mental immature and are very easily influenced by other parties. Forms of legal protection from the government for children who are victims of criminal acts include compensation, compensation, and restitution. Restitution is the payment of compensation charged to the perpetrator based on a court decision with permanent legal force for material and/or immaterial losses suffered by the victim/his heirs. In this writing, the main focus will be restitution. Based on the case, the researcher formulated the main problems, namely: (1) How is the process of giving restitution to children as victims of sexual violence based on the decision of the judge in the Atambua District Court? (2) What are the supporting and inhibiting factors in the process of giving restitution to children as victims of sexual violence based on the decision of the judge in the Atambua District Court? This study uses empirical legal research methods that researchers conduct interviews with the parties concerned. Aspects of the study examined the process of restitution and the factors supporting and inhibiting the application of restitution. The results found that: (1) in terms of efforts to fulfill the right of restitution to children victims of sexual violence, law enforcement officers and victims have a role in pursuing the right of restitution. The investigator and the public prosecutor are obliged to inform the victim about the rights obtained by the victim. The victim can apply for restitution which can be done during the investigation process, prosecution, or after a decision with permanent legal force is read. (2) there are two factors that become obstacles in its implementation, namely legal factors and community factors.

Abstract

Confinement still often occurs until now, especially to people with mental disorders (ODGJ), but ODGJ have the same rights as normal people in general. Some of their rights are the right to be free from torture or cruel treatment, free from exploitation and free from violence. Therefore, the act of shackling is not in accordance with our positive law. The main problems of this research are: (1) How is the juridical review of sanctions against perpetrators of shackling people with mental disorders (ODGJ)? (2) How is the ideal arrangement related to legal protection of victims of shackling people with mental disorders (ODGJ)? This research is a normative research using library research techniques and the results of this research are analyzed qualitatively.This research found several things: (1) The juridical review of the provisions of criminal sanctions for perpetrators of shackling people with mental disorders (ODGJ) has not been regulated in detail in Law Number 18/2014 on Mental Health. However, it is related to Article 333 of the Criminal Code on Deprivation of Independence, where individuals who act to confine or perpetrators of shackling can be subject to criminal sanctions in the form of 8 years imprisonment with the element of intentionally depriving someone of their freedom or acting unlawfully, a maximum of 9 years imprisonment if the action causes serious injury, and 12 years imprisonment if the victim dies. (2) The ideal arrangement related to the legal protection of victims of ODGJ confinement has been regulated in Law Number 18 Year 2014 on Mental Health which ensures that everyone has a high quality of life, mental health, free from stress, and other conditions that exacerbate mental problems. In Article 4 paragraph 1 of the Mental Health Law, legal protection of ODGJ as victims of confinement in stocks is carried out through several actions, namely: promotive, preventive, curative and rehabilitative.

Abstract

A traffic violation is an act or action carried out by a person driving a motorized vehicle or a pedestrian which is contrary to the laws and regulations in the field of traffic and road transportation. Therefore, traffic management and engineering is needed so that every motorized vehicle user has regulations in traffic so that they understand the use of road directions and lanes and the law is a guide to the rules and regulations of a society and must be obeyed. The main problems in this research are: (1) What is the process for resolving traffic violation cases committed by TNI-AD soldiers in the Legal Area of ​​Military Court III-15 Kupang? (2) How are criminal sanctions imposed on TNI-AD soldiers who commit traffic violations in the Legal Area of ​​Military Court III-15 Kupang?. This research is empirical normative research, so the data sources used are primary data sources, secondary data and tertiary data. Primary data was obtained from interviews, secondary data was obtained from libraries, journals and the internet, and tertiary data was obtained from dictionaries, Wikipedia and encyclopedias. Data were analyzed descriptively-qualitatively. The results of this research show that (1) The process of resolving cases of road traffic violations committed by the TNI-AD was examined using a rapid examination process based on Law Number 31 of 1997 concerning Military Justice and Law Number 22 of 2009 concerning Traffic and Transport Roads. (2) The criminal sanctions imposed on the TNI-AD who commit traffic violations are fines and imprisonment.

Abstract

Restorative justice is often understood as a form of approach in resolving a criminal case involving the perpetrator, victim, and other parties such as family, or the community and does not focus on imprisonment, but rather on restoring the victim's condition after the crime has occurred. The Indonesian government has implemented restorative justice in the criminal justice system. Explicitly, restorative justice is stated in Law of the Republic of Indonesia Number 11 of 2012 concerning the Juvenile Criminal Justice System and Regulation of the Republic of Indonesia National Police Number 8 of 2021 concerning Handling of Criminal Acts based on Restorative Justice, recorded in the State Gazette of the Republic of Indonesia in 2021 Number 947. This study aims to determine the model of approach and inhibiting factors in the application of restorative justice in resolving criminal cases. This research is an empirical legal research. The data collection technique was by interviewing informants, and the data analysis used was qualitative analysis. The results of the study show: (1) The restorative justice approach has been implemented at the Kupang City Police by paying attention to values ​​and based on the Pancasila ideology. (2) The implementation of restorative justice in the police is carried out in two models, namely victim offender meeting and Conferencing. (3) the implementation of restorative justice in the police found 3 inhibiting factors, namely legal factors, law enforcement factors themselves and community factors.
