Abstract

Penelitian ini membahas tentang Putusan Pengadilan dengan Tedakwa Ferdy Sambo berdasarkan Putusan Pengadilan Nomor 796/Pid.B/2022/PN Jkt.Sel Jo 53/PID/2023/PT DKI jo 813/K/Pid/2023. Dalam Putusan tersebut terdapat permasalah dimana Mahkamah Agung menganulir Putusan Pengadilan Negeri dan Pengadilan Tinggi yang menjatuhkan Pidana Mati kepada Ferdy Sambo yang menggantinya dengan Pidana Seumur Hidup.Putusan Mahkamah Agung menuai kritik mengingat Mahkamah Agung merupakan Peradilan Tertinggi yang bertugas sebagai Judex Juris dan bukan Judex Factie. Penelitian ini bertujuan untuk menguraikan beberapa Permasalahan dari Putusan Mahkamah Agung nomor 813/K/Pid/2023 yang menganulir Pidana Mati bagi Ferdy Sambo dan menggantinya dengan Pidana Seumur hidup. Metode yang digunakan dalam penelitian ini ialah Yuridis-Normatif dengan menggunakan data sekunder atau data kepustakaan (library research) dengan pendekatan Perundang-undangan (The Statute Approach) dan Studi Kasus (Case Study)

Abstract

This study discusses the obligation to provide child support by ex-husbands after divorce, which is reviewed from a criminal law perspective. The obligation to provide child support is part of the protection of children's rights as regulated in laws and regulations in Indonesia, Law Number 1 of 1974 concerning Marriage, Law Number 35 of 2014 concerning Child Protection, and The Criminal Code (KUHP). Problems arise when ex-husbands do not carry out these obligations, which has the potential to cause legal consequences. This study aims to examine the legal form of criminal responsibility for ex-husbands who are negligent or intentionally do not provide support to their children. The method used in this study is the normative legal method with a statutory approach and case studies. The results of the study indicate that the non-compliance of ex-husbands in fulfilling their child support obligations can be categorized as a form of child neglect which has criminal implications. Law enforcement in this case still faces various obstacles, both from normative and implementative aspects. Therefore, it is necessary to strengthen regulations and increase legal awareness for the community to ensure the fulfillment of children's rights after divorce

Abstract

Micro, Small, and Medium Enterprises (MSMEs) play a significant role in the Indonesian economy, as they can absorb a large workforce and contribute significantly to the Gross Domestic Product (GDP). However, many MSMEs still face significant challenges, particularly regarding legal aspects, lack of market access, and inefficient business management. This study aims to evaluate the impact of government support, business legitimacy, and market access on improving the level of Micro, Small, and Medium Enterprises (MSMEs) in Bekasi Regency. This study employs a quantitative approach using a survey method involving 120 micro, small, and medium enterprise (MSME) actors participating in a capacity-building program. Data were analyzed using the Partial Least Squares–Structural Equation Modeling (PLS-SEM) approach. The research findings indicate that government assistance has a positive and significant impact on improving the level of Micro, Small, and Medium Enterprises (MSMEs). Similarly, access to the market has been proven to have a significant positive impact on the advancement of MSMEs. Conversely, business legitimacy does not have a significant impact on increasing MSME levels.
