Abstract

This paper provides an in-depth review of the economic anthropology of farmers and Islamic values in the context of Sabapadang community life. The Sabapadang community, which is characterised by agricultural activities as one of the main sources of their economy, is also reflected in their views on Islamic values in their daily lives. This research uses a descriptive qualitative approach to describe the patron-client relationship that occurs between rubber tree penderes and sap tauke in the Sabapadang community. The main objectives of this study were to reveal the economic living conditions of the rubber tree penderes in Sabapadang village, identify the patterns of patron-client relationships underlying their interactions with the sap tauke, and analyse the factors that maintain the sustainability of these relationships. The results show that rubber tree penderes are continuously involved in economic interactions with the sap tauke. The Sabapadang community is highly dependent on the tauke in their economic aspects. One prominent form of interaction is when penderes experience financial difficulties and borrow money from the tauke. In return, penderes are required to sell their sap to the tauke, often at a lower price than the market price, with no fixed timing. The patron-client relationship between the rubber tree penderes and the sap tauke is maintained smoothly because both parties need each other, both economically and socially.

Abstract

This article analyzes how state hegemony operated in the unification of Islamic law in Indonesia through the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI). Using legal-historical research with a legal-political approach, it reads the legal instruments of the KHI together with the documents and published accounts of the compilation project (1985-1991) through Antonio Gramsci’s theory of hegemony. The findings show that the KHI was not merely an administrative response to the absence of uniform substantive law in the Religious Courts. It was a hegemonic project in which the New Order state organized the production of religious consent, through the four-track compilation project, the 1988 national workshop of ulema, and the mediation of jurist-bureaucrats such as Busthanul Arifin, so that state-selected fiqh opinions came to be accepted as Indonesian Islamic law. This consent was negotiated and uneven rather than total, as the debates over inheritance and the persistence of unregistered marriages show. The article contributes the concept of “frozen hegemony” to explain how the consensus of 1985-1991 was fixed in a text of ambiguous legal status that remains insulated from both judicial ijtihād and parliamentary contestation.
