Abstract

One of the discussions of ulumul qur'an which has a very important position in the study of Islamic science is the Science of Qira'at. Qira'at Science is a scientific fan that concentrates on examining the validity of the text of the Qur'an, both in terms of pronunciation and writing. According to scientific terms, qira'at is one of the madhhabs (schools) of pronunciation of the Qur'anic recitation chosen by one imam qurro' as a school that is different from other schools. Differences in reading the Qur'an in general can affect changes in meaning, including the implications for legal istinbath. However, is the taking of Istinbath law from a madzhab adopted by a country in harmony with the qira'at that is popular in that country? This research is in the form of library research (literature study), literature study can be interpreted as a data collection technique by conducting a study of books, literature, notes, and reports that have a relationship with the problem being solved. The object of observation in the research is the diversity of qira'at and its implications for Istinbath law in a madzhab. After analysis, it was found that a recitation of qira'at that is popular in a country does not have to be in line with the method of Istinbath law carried out by the imam of the madzhab that applies in that country. The results of this research are expected to provide a new perspective in the study of Ulumul Qur'an as well as knowing the values that are an inspiration for the community.

Abstract

Abstrak. Kecanduan judi online tidak hanya menyebabkan kerugian ekonomi, tetapi juga menimbulkan masalah psikologis, merusak hubungan suami istri, dan menghambat pemenuhan hak anak dalam keluarga. Dalam praktik peradilan agama, kondisi tersebut semakin sering dijadikan dasar pengajuan perceraian. Artikel ini bertujuan menelaah legitimasi hukum kecanduan judi online sebagai alasan perceraian dengan mengkaji Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, Peraturan Pemerintah Nomor 9 Tahun 1975, dan Kompilasi Hukum Islam. Kajian ini juga menganalisis pola penafsiran hakim serta dampaknya terhadap perlindungan hak anak dan pembagian harta bersama. Penelitian menggunakan metode hukum normatif dengan pendekatan studi kasus melalui analisis kualitatif deskriptif terhadap putusan pengadilan agama. Hasilnya menunjukkan bahwa kecanduan judi online dapat dikategorikan sebagai kebiasaan buruk yang sulit disembuhkan dan pemicu konflik berkepanjangan, sehingga memenuhi dasar hukum perceraian. Selain itu, pengadilan mulai mengakomodasi bukti digital sebagai alat pembuktian yang relevan. Temuan ini menegaskan urgensi penguatan perlindungan hukum bagi anak dan pihak rentan serta perlunya respons regulatif yang adaptif terhadap dinamika sosial digital. Abstract. Addiction to online gambling results not only in financial losses but also in psychological distress, strained marital relationships, and the neglect of children’s rights within the household. In the practice of religious courts, this issue is increasingly cited as a basis for divorce. This article aims to examine the legal legitimacy of online gambling addiction as a valid reason for divorce by analysing the provisions of Law No. 1 of 1974 on Marriage, Government Regulation No. 9 of 1975, and the Compilation of Islamic Law, while also examining judges' interpretation patterns and their implications for the protection of children's rights and the division of joint property. This study employs a normative legal method with a case study approach through qualitative-descriptive analysis of religious court decisions. The results indicate that online gambling addiction can be classified as a difficult-to-cure bad habit or a cause of prolonged conflict, thereby fulfilling the legally recognised grounds for divorce. Additionally, courts are beginning to accommodate digital evidence as a relevant means of proof. These findings emphasise the urgency of strengthening legal protection for children and vulnerable parties, as well as the need for adaptive regulatory responses to digital social dynamics.
