Abstract

ABSTRAK                                                          Prajurit Tentara Nasional Indonesia (disingkat TNI) telah dipersiapkan secara khusus untuk menjaga, melindungi dan mempertahankan keamanan serta kedaulatan Negara Kesatuan Republik Indonesia (NKRI). Dalam pelaksanaan tugasnya, anggota TNI dibatasi oleh undang-undang dan peraturan militer, sehingga semua perbuatan yang dijalani harus berlandaskan pada undang-undang dan peraturan yang berlaku. Dalam menjamin dan mendukung terlaksananya peran serta tugas penting TNI maka telah dibuatkan peraturan-peraturan khusus yang berlaku bagi anggota TNI, disamping aturan yang sifatnya umum. Dalam melaksanakan tugas dan kewajibannya terhadap negara, seorang anggota TNI tidak luput dari permasalahan hukum, misalnya terdapat oknum TNI yang melakukan tindak pidana, yaitu tindak pidana desersi. Desersi merupakan  perbuatan menarik diri dari pelaksanaan kewajiban dinas TNI yang diatur dalam Pasal 87 Kitab Undang-Undang Hukum Pidana Militer (KUHPM). Penerapan sanksi pidana dalam tindak pidana desersi yang dilakukan oleh prajurit TNI secara sengaja dalam waktu damai lebih lama dari 30 (tiga puluh) hari, maka terhadapnya dapat dijatuhi hukuman sebagaimana diatur dalam Pasal 87 ayat (1) ke-2 juncto ayat (2) KUHPM dengan ancaman maksimum pidana penjara selama 2 (dua) tahun 8 (delapan) bulan.  Kata kunci: Sanksi Pidana; Desersi; Tentara Nasional Indonesia ABSTRACT Soldiers of the Indonesian National Army (abbreviated as TNI) have been specially prepared to guard, protect and defend the security and sovereignty of the Unitary State of the Republic of Indonesia (NKRI). In carrying out their duties, TNI members are limited by military laws and regulations, so that all actions they carry out must be based on applicable laws and regulations. In order to guarantee and support the implementation of the TNI's important roles and tasks, special regulations have been made that apply to TNI members, in addition to general regulations. In carrying out their duties and obligations towards the state, a member of the TNI is not free from legal problems, for example there are members of the TNI who commit criminal acts, namely the crime of desertion. Desertion is the act of withdrawing from carrying out TNI service obligations as regulated in Article 87 of the Military Criminal Code (KUHPM). The application of criminal sanctions in criminal acts of desertion committed by TNI soldiers intentionally during peacetime longer than 30 (thirty) days, then they can be sentenced as regulated in Article 87 paragraph (1) 2nd in conjunction with paragraph (2) of the Criminal Code with a maximum threat of imprisonment for 2 (two) years and 8 (eight) months. Keywords: Criminal Sanctions; Desertion; Indonesian national army

Abstract

 Abstract  The purpose of this legal research is to elaborate and explain fundamentally the judge's legal considerations in Decision Number 337/Pid.Sus/2020/PN. Jkt.Sel related to the application of the provisions of the Money Laundering Crime (TPPU) and its relation to the Criminal Code (KUHP). Based on the verdict, the defendant Ir. Roni Wijaya was proven to have legally committed a tax crime as stipulated in Article 39A letter a of Law Number 28 of 2007 jo. Article 64 paragraph (1) of the Criminal Code and the crime of money laundering as stipulated in Article 3 of Law Number 8 of 2010. This type of research is a normative legal research that is descriptive and analytical, with a statutory approach and a case approach, using secondary data through literature studies and qualitative analysis. The results of the study show that the application of the TPPU article in this decision has reflected the double track system of criminality, where the predicate crime in the form of tax violations is the basis for proving TPPU. The merging of the provisions of the Anti-Corruption Law and the Criminal Code shows the application of the principle  of lex specialis derogat legi generali in criminal law. Thus, this decision affirms the consistency of the application of the law to economic crimes that have a systemic impact on state finances. Keywords: Money Laundering Crime, Decision Number: 337/Pid.Sus/2020/PN.
