Abstract

Penelitian ini bertujuan menganalisis kebijakan pendidikan inklusif di Indonesia berdasarkan perspektif hukum positif serta implikasinya terhadap pemenuhan hak penyandang disabilitas. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, serta analisis deskriptif-analitis terhadap efektivitas implementasi kebijakan. Hasil penelitian menunjukkan bahwa meskipun kerangka hukum nasional telah memberikan jaminan pendidikan inklusif, implementasinya masih menghadapi berbagai kendala, seperti lemahnya peraturan pelaksana, keterbatasan pendanaan afirmatif, kurangnya tenaga pendidik khusus, dan minimnya fasilitas ramah disabilitas. Kesenjangan antara norma hukum dan realitas lapangan menandakan bahwa hak pendidikan bagi penyandang disabilitas belum terwujud secara substantif. Diperlukan pembentukan regulasi teknis yang mengatur standar layanan, pembiayaan, dan mekanisme pengawasan agar prinsip kesetaraan dan non-diskriminasi benar-benar terimplementasi.

Abstract

This study aims to analyze inclusive education policies in Indonesia from the perspective of positive law and their implications for fulfilling the rights of persons with disabilities. The research employs a normative legal method using statutory and conceptual approaches, combined with descriptive-analytical analysis of policy implementation effectiveness. The findings reveal that although Indonesia’s legal framework guarantees inclusive education, its implementation remains hindered by weak technical regulations, limited affirmative funding, a shortage of special education teachers, and inadequate disability-friendly facilities. The gap between legal norms and practical realities demonstrates that the right to education for persons with disabilities has not been substantively realized. Therefore, detailed technical regulations governing service standards, funding mechanisms, and supervision are urgently needed to ensure the effective implementation of equality and non-discrimination principles.

Abstract

This study aims to analyze the implications of the absence of fiscal guarantees on the effectiveness of fulfilling the rights of persons with disabilities under Regional Regulation of Gorontalo Province Number 4 of 2023. The research employs a normative juridical method using statutory, conceptual, and analytical approaches. The rights of persons with disabilities are categorized as social rights whose realization requires active fiscal intervention within the framework of a welfare state. The findings indicate that although the regional regulation has incorporated progressive norms concerning the protection and fulfillment of rights, the provisions on financing remain general and do not contain explicit fiscal guarantee schemes, such as minimum budget allocations or binding affirmative mechanisms. The absence of such fiscal guarantees results in the implementation of rights being highly dependent on the annual regional budgeting policy through the Regional Revenue and Expenditure Budget (APBD), which is political and dynamic in nature. This condition creates the risk of symbolic regulation, weakens legal certainty, and reduces the practical effectiveness of the norms. Therefore, an integration between substantive norms and a structured and sustainable fiscal design is required to ensure that the protection of the rights of persons with disabilities does not remain merely declaratory, but is realized concretely and consistently in accordance with the principles of the welfare state.
