Abstract

Abortion in Indonesia is a complex legal issue involving moral, religious, and human rights dimensions. Regulations in the Criminal Code, Health Law, and Government Regulation No. 61 of 2014 demonstrate tension between protecting the right to life of the fetus and respecting women's rights to bodily autonomy and reproductive health. This research analyzes abortion regulations from legal philosophy perspectives—natural law, legal positivism, and progressive law—and assesses the extent to which regulations reflect substantive justice. The method employed is normative legal research with statutory, conceptual, and theoretical approaches. Research findings indicate that natural law emphasizes the fetus's right to life as a natural right, legal positivism focuses on the certainty of written rules, while progressive law encourages responsiveness to social needs, particularly protecting women from the risks of illegal abortion. The perspectives of major religions in Indonesia generally reject abortion, although positive law provides limited exceptions for medical emergencies and pregnancies resulting from rape. Abortion regulation in Indonesia faces a normative dilemma as the law tends to be repressive while social reality demands greater protection for women. Regulatory reform that is more humanistic and progressive is needed, emphasizing balance between protecting the fetus's right to life and fulfilling women's rights to achieve substantive justice in accordance with Pancasila legal ideals and the constitution.

Abstract

Abstrak Pengujian Undang-Undang terhadap Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan melalui mekanisme judicial reviewyang diputus dalam Putusan Mahkamah Konstitusi Nomor 13/PUU‑XV/2017 merupakan peristiwa penting dalam perkembangan hukum ketenagakerjaan di Indonesia. Permohonan tersebut lahir dari adanya konflik antara norma ketenagakerjaan dengan jaminan hak konstitusional pekerja, khususnya hak untuk membentuk keluarga melalui perkawinan. Artikel ini bertujuan untuk menganalisis secara yuridis perlindungan hak konstitusional pekerja dalam konteks hubungan kerja serta mengkaji pertimbangan hukum Mahkamah Konstitusi dalam menilai konstitusionalitas norma yang melegitimasi pemutusan hubungan kerja akibat perkawinan antarpekerja. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Pembahasan difokuskan pada analisis ratio decidendi Mahkamah Konstitusi, terutama terkait penafsiran terhadap frasa pengecualian dalam Pasal 153 ayat (1) huruf f Undang-Undang Ketenagakerjaan yang dinilai bersifat diskriminatif dan bertentangan dengan prinsip hak asasi manusia. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi menegaskan batas penerapan asas kebebasan berkontrak dalam hubungan kerja serta mendorong pergeseran paradigma hukum ketenagakerjaan menuju perlindungan hak pekerja yang lebih berkeadilan. Putusan tersebut memiliki implikasi normatif yang signifikan dalam membangun relasi kerja yang lebih seimbang dan memperkuat peran negara dalam menjamin perlindungan hak konstitusional pekerja. Kata kunci: hak konstitusional pekerja, judicial review, Mahkamah Konstitusi, hukum ketenagakerjaan, kebebasan berkontrak.   Abstract The judicial review of Law Number 13 of 2003 concerning Manpower, as decided in Constitutional Court Decision Number 13/PUU-XV/2017, represents a significant milestone in the development of labor law in Indonesia. The petition arose from a conflict between labor norms and the guarantee of workers' constitutional rights, particularly the right to form a family through marriage. This article aims to legally analyze the protection of workers' constitutional rights in the context of employment relations and examine the Constitutional Court's legal considerations in assessing the constitutionality of norms legitimizing termination of employment due to marriage between workers. The research method used is normative legal research with a statutory and conceptual approach. The discussion focuses on the Constitutional Court's ratio decidendi analysis, particularly regarding the interpretation of the phrase "exception" in Article 153 paragraph (1) letter f of the Manpower Law, which is deemed discriminatory and contrary to human rights principles. The research findings show that the Constitutional Court affirmed the limits of the application of the principle of freedom of contract in employment relationships and encouraged a paradigm shift in labor law toward more equitable protection of workers' rights. This ruling has significant normative implications for building more balanced employment relations and strengthening the state's role in guaranteeing the protection of workers' constitutional rights.
