Abstract

Speedy trials in regional election criminal cases are essential for maintaining democratic integrity, but they raise concerns about balancing efficiency with substantive justice. This study examines the implications of implementing speedy trial principles on evidence quality, access to justice, human rights protection, and judicial system integrity through normative legal analysis of primary sources. The research reveals that accelerated judicial processes create tensions between procedural speed and thoroughness, potentially compromising the examination of evidence, disadvantaging resource-limited defendants, and risking due process violations. The findings demonstrate that expedited timelines may undermine comprehensive legal reasoning in judicial decisions. A balanced framework is essential to achieve both procedural efficiency and substantive justice in electoral criminal proceedings.

Abstract

Constitutional Court Decision Number 20/PUU-XII/2023 states that article 30C letter h and explanation letter h of Law Number 11 of 2021 concerning the Prosecutor's Office of the Republic of Indonesia are contrary to the Constitution of the Republic of Indonesia Year 1945 and have no binding legal force. So this is considered contrary to the purpose of law and legal principles, namely the principle of equality before the law and the principle of equality of arms principle. Therefore, this encourages the author to analyze the concept of judicial review carried out by the Public Prosecutor who actually represents the victim and even the state. The writing of this thesis uses normative juridical research methods with methods of approaching laws and regulations,cases, historical and conceptual. This legal research found that the Criminal Procedure Code for victim protection has not been optimal compared to perpetrators of crimes, where the Criminal Procedure Code only identifies or tends to lead to perpetrators only. Then, with the decision of the Constitutional Court No. 20/PUU-XII/2023, it has the effect of closing the prosecutors authority to be able to apply review as a return of position to the convict.

Abstract

Euthanasia in positive criminal law regulations in Indonesia has not been regulated firmly and specifically. And according to human rights, the act of euthanasia is a violation of a person's right to life. The act of euthanasia itself occurs because of the unbearable suffering a person experiences due to a disease that has no hope of being cured. The patient or family will ask the doctor to carry out euthanasia because they have lost hope or the opportunity to be cured with other alternatives. Juridically, criminal law, the act of euthanasia is indirectly regulated in articles 304, 344 and 345 of the Criminal Code as well as articles 461 and 462 of Law number 1 of 2023 and in human rights the act of euthanasia is very contrary to a person's right to life, the emergence of the act of euthanasia It has become a demand that euthanasia is part of human rights, namely the right to die. This right to die is not regulated either in the 1945 Constitution, Law Number 39 of 1999, and the Universal Declaration of Human Rights. The new thing that can be stated is that the process of legislation and legal reform, especially regarding this action, must continue to be carried out based on Pancasila and the 1945 Constitution of the Republic of Indonesia, taking into account the religious and cultural norms that apply in Indonesian society.

Abstract

An official order is an order given by someone who has power and position in an institution or institution. A valid official order is an official order given by someone who has the authority and the order is still in the realm of his work. The article governing official orders is contained in Article 51 of the Criminal Code. Obstruction of justice is an act that harms many parties, therefore anyone involved in obstruction of justice deserves to be punished according to applicable law. The research method used in writing this thesis is normative, namely examining laws and examining scientific papers that are in accordance with the problems that are the topic of making a thesis. The result of this research is that a person who commits an act of obstruction of justice in an official order can be given a penalty according to the provisions if with full awareness knows that the act is an act that has elements of a criminal offense and cannot be said to be obstruction of justice if the person concerned does not know at all that the order contains elements of a criminal offense.

Abstract

Penelitian ini menguraikan tentang kriteria objek tanah landreform dan pelaksanaan redistribusi tanah objek landreform di Kabupaten Kolaka. Tujuan penelitian adalah untuk mengetahui kriteria objek tanah landreform dan pelaksaan redistribusi tanahobjek landreform di Kabupaten Kolaka. Metode yang digunakan pada penelitian ini adalah penelitian normatif-empiris yaitu penelitian yang penggabungan antara pendekatan hukum normatif dengan penambahan berbagai unsur empiris. Hasil penelitian menunjukkan bahwa kriteria objek tanah landreform di Kabupaten Kolak adalah tanah pertanian, tanah non pertanian (yang berasal dari pelepasan kawasan hutan/penurunan hak), tanah eks HGU yang berakhir haknya, dengan lebih spesifiklagi bahwa kriteria tanah objek Landerform di Kabupeten Kolaka yaitu tanah pertanian lahan kering yang menjadi sumber mata pencarian masyarakat setempat. Pelaksanaan redistribusi tanah objek landreform di Kabupaten Kolaka, secara garis besar adalah: a. persiapan dan perencanaan, bertujuan untuk mengetahui potensi, permasalahan dan kebutuhan para penerima tanah melalui pemetaan sosial tentang sumber-sumber ekonomi yang tersedia dan dapat diakses oleh penerima tanah; b. melakukan penyuluhan yang mencakup pembentukan organisasi yang efektif, ketersediaan sumber-sumber ekonomi, mekanisme pendampingan dalam memperoleh akses dari pemilik sumber-sumber ekonomi; c. membentuk organisasi penerima tanah yang efektif; d. melakukan fasilitasi dan rapat koordinasi dengan para pemangku kepentingan; e. Kerjasama kemitraan.

Abstract

Corporations play a significant role in the economic development of society, but they not only have positive impacts, but also cause negative, deviant impacts. where the characteristics and movements are different from conventional crimes in general. Unclear regulations on corporate criminal liability are a major obstacle in eradicating criminal acts committed by corporations. Although corporations have been designated as legal subjects. This research focuses on the study of the regulation of corporate criminal liability based on Law Number 1 of 2023 and to determine the concept of criminalization of corporations as perpetrators of criminal acts. This research uses a normative research method, which focuses on collection and analysis with a statutory approach, a case approach, and a conceptual approach. The results of the study concluded that in Law Number 1 of 2023 concerning the Criminal Code, in addition to two forms of error (intentional and negligence), it also regulates unlawful acts that can be held criminally accountable to corporations and shareholders where each article formulation requires that every act and the consequences of the act must be intended by the perpetrator to be held criminally accountable. The imposition of corporate criminal liability is regulated in Articles 45-50 of Law Number 1 of 2023 concerning the Criminal Code, strengthening the teaching/doctrine of piercing the corporate veil in imposing criminal liability on shareholders who commit crimes.

Abstract

The arrest procedure has been regulated in the Criminal Procedure Code. However, in practice, it is possible that in the arrest process there may be wrongful arrests. In legal terms, wrongful arrests made by police investigators are called errors in persona. The purpose of this study is to determine the accountability of police investigators when making wrongful arrests based on the law and legal remedies carried out by suspects in the event of an error in persona. In this study, the author used a normative research method which is research conducted by literature study or document study. The data analysis technique used is a qualitative normative analysis, namely by interpreting or drawing conclusions about the legal materials that have been processed. The results of the study show that the responsibility of police investigators when making wrongful arrests based on the law can be in the form of civil liability, criminal liability, and ethical and administrative liability. The legal remedies taken by the suspect in the event of an error in persona are in the form of pretrial legal remedies which are judicial legal remedies, and the victim of wrongful arrest can also take non-judicial legal remedies (out-of-court settlement) in the form of a complaint to the National Human Rights Commission (Komnas HAM), or a complaint to the nearest Police Service Center (SPK).
