Abstract

Domestic violence (DV) is a form of human rights violation that remains prevalent in Indonesia. Legal protection for victims of domestic violence has been regulated in various laws and regulations, but its implementation still faces a number of obstacles. This article aims to analyze the forms of legal protection provided to victims of domestic violence in Indonesia and examine the extent to which these regulations are effectively implemented. This research uses a qualitative method with a normative juridical approach sourced from secondary data in the form of laws, journals, and relevant literature. The results of this study indicate that despite the existence of an adequate legal framework, challenges in the form of a patriarchal culture, a lack of understanding among law enforcement officials, and limited access to protection services are the main obstacles to providing optimal protection for victims.

Abstract

Status hukum anak di luar nikah di Indonesia telah menjadi isu kompleks yang melibatkan aspek hukum, agama, dan sosial. Anak di luar nikah sering kali mengalami diskriminasi dalam memperoleh hak-hak perdata, terutama terkait nasab, nafkah, dan warisan. Penelitian ini bertujuan untuk menganalisis kepastian hukum bagi anak di luar nikah yang diakui sah oleh orang tua biologisnya, dengan fokus pada pengaturan hukum positif Indonesia, perspektif agama Islam, dan peran Mahkamah Konstitusi. Kajian ini juga menawarkan solusi komprehensif untuk mengatasi hambatan hukum dan sosial dalam implementasi kebijakan perlindungan anak di luar nikah. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan multidisipliner, memadukan analisis hukum positif, kajian agama Islam, dan aspek sosial-budaya. Hasil penelitian menunjukkan bahwa Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 merupakan langkah maju dalam memberikan pengakuan hukum bagi anak di luar nikah, namun implementasinya masih menghadapi tantangan signifikan. Dalam hukum Islam, status anak di luar nikah cenderung terbatas pada hubungan nasab dengan ibu biologisnya, meskipun terdapat alternatif seperti wasiat wajibah untuk melindungi hak-haknya. Penelitian ini merekomendasikan revisi regulasi, sosialisasi kepada masyarakat, penguatan peran lembaga perlindungan anak, optimalisasi teknologi pembuktian seperti tes DNA, dan harmonisasi antara hukum positif dan hukum Islam. Dengan pendekatan holistik, diharapkan perlindungan hukum bagi anak di luar nikah dapat diwujudkan secara adil, inklusif, dan sesuai dengan prinsip kemanusiaan.

Abstract

One of the most significant forces behind this change is digitalization. While facilitating a wide range of direct information and commercial transactions through digital platforms, these procedures also pose new challenges for the rules and laws governing the operations of global companies. In addition to discussing the difficulties and tactics involved in developing a current and flexible legal framework, this essay also examines how globalization and digitalization have impacted commercial law. Its primary focus is on how commercial law can foster inclusive economic growth, address the digitalization of trade, and resolve regulatory disparities. Trade law must be able to lower trade barriers in the context of globalization that prevent poor countries from accessing international markets. Case studies and a literature review are among the research techniques used. While case studies offer a practical dimension by examining actual examples of the application of commercial law in the context of globalization and digitalization, the literature review seeks to explore sources of information that discuss changes in commercial law with the advent of globalization and digitalization. The study's conclusion highlights the importance of cross-sector engagement and successful tactics in creating an appropriate legal framework considering the evolving realities of international trade in the digital age. As a result, this essay provides a comprehensive understanding of the regulatory nuances surrounding international trade alongside legal remedies and appropriate approaches to address the difficulties that arise in the digital age.
