Abstract

This study aims to analyze Legal Protection for Consumers in Sharia E-Commerce Transactions in the Era of Economic Digitalization. The research explores issues related to consumer legal protection within Sharia-based e-commerce transactions amidst the digital economic transformation. This study employs a qualitative research method with an exploratory approach. The researcher utilizes secondary data from online media, social media, and relevant journals by examining materials related to consumer legal protection in Sharia e-commerce transactions in the era of digitalization. The data analysis technique employs the NVivo 12 Plus software, a computer-assisted qualitative document analysis tool. This user-friendly software can process words, exploring word frequency, attributes, and cases derived from large datasets. Research findings indicate that Sharia e-commerce has significant potential to grow in Indonesia. The realization of this potential largely depends on the ability to address existing consumer protection issues. If the recommendations of this study are implemented, a safe and fair digital transaction environment, fully aligned with Islamic values and principles, can be established. Despite its rapid growth, Sharia e-commerce still requires substantial improvements to ensure consumer protection. To create a secure, just, and Sharia-compliant transaction environment, a holistic approach supported by the collective commitment of stakeholders is necessary. The ability to periodically address literacy, regulation, and technology issues, conduct regular audits, apply blockchain and AI for halal certification, and detect non-Sharia practices are key factors for success. The government, industry, and academia must collaborate to build an ideal ecosystem.

Abstract

Jambi City Regional Regulation Number 2 of 2014 concerning the Eradication of Prostitution and Immoral Acts is implemented as an effort by the local government to suppress the practice of prostitution, which is considered a form of social pathology. This policy has had a significant impact, including the closure of the two largest localizations in Jambi City, namely Payo Sigadung (Pucuk) and Langit Biru. However, its effectiveness is still debatable because the practice of prostitution still occurs covertly in various places. This study aims to juridically analyze the substance and implementation of Jambi City Regional Regulation Number 2 of 2014 and to assess its effectiveness in preventing social pathologies. The research method used is qualitative with an exploratory approach. The data used are secondary sources from legal documents, online media, and relevant scientific journals. Data analysis was conducted using NVivo 12 Plus to explore themes, word frequencies, and relationships among legal concepts related to the implementation of local regulations. The results of the study show that this regulation has a strong legal basis and has contributed to suppressing the practice of prostitution administratively. However, its implementation still faces various obstacles such as weak legal sanctions, limited inter-agency coordination, and suboptimal rehabilitation and economic empowerment programs for former sex workers. Juridically, Regional Regulation Number 2 of 2014 plays a vital role in preventing social pathologies. However, it still requires a more comprehensive legal approach and synergy with social, economic, and cultural strategies to create a sustainable moral order in Jambi City.

Abstract

The development of the digital economy has introduced affiliate marketing as a key strategy for expanding Indonesia's e-commerce market. This study aims to analyze the legal status of contracts (akad) within affiliate schemes in accordance with the principles of fiqh mu'āmalah and to examine their implementation in the digital ecosystem. The research employs a normative method with a literature review approach, analyzed descriptively and qualitatively using Nvivo 12 Plus to trace secondary data from journals, online media, and relevant regulations. The findings indicate that affiliate practices can be classified as ju‘ālah, wakālah, or ijārah contracts, provided the essential elements and requirements of the agreement are met. However, in practice, several issues remain, including unclear commission calculation systems, delayed payments, bonus mechanisms that may resemble maysir, and the risk of riba in payment processes handled through third parties. These findings underscore the importance of transparency, fairness, and Sharia compliance in the implementation of digital affiliate schemes. The study concludes that affiliate systems have a valid sharia-based legal basis but require specific regulations to ensure legal certainty and protection for all parties involved.

Abstract

This study aims to analyze the Model of Regulation for the Protection of Personal Data of Online Loan Consumers Based on Maqasid Syariah and the No. 27 Of 2022 Personal Data Protection Law. This research employs a qualitative method with a normative juridical approach, utilizing primary data in the form of the PDP Law, as well as secondary data from social media and relevant journals. The analysis was carried out using NVivo 12 Plus to systematically process qualitative data through word, frequency, and attribute analysis. The study's results demonstrate that the PDP Law provides a robust legal framework for protecting the rights of data subjects, including the right to privacy, security, and control over their personal data. This law emphasizes that online loan providers are required to obtain the user's explicit consent before processing their data (Articles 15–20) and provide consumers with the right to access, correct, or delete their personal data (Article 16). The PDP Law also provides for administrative and criminal sanctions for violations, including hefty fines and imprisonment (Articles 57–63), to ensure transparent, fair, and accountable data management. From the perspective of Maqasid Sharia, the protection of personal data aligns with the principles of hifz al-nafs (protection of life), hifz al-'aql (protection of reason), and, in particular, hifz al-'irdh (protection of honor). Violations of personal data are viewed as a violation of human honor and dignity, which is contrary to the values of Justice and benefit in Sharia. Thus, the protection of personal data of borrowed consumers reflects the synergy between positive law and Islamic ethical principles.

Abstract

This study examines the impact of the Iran-Israel conflict on government communication narratives and crisis communication strategies in Southeast Asia, with a particular focus on Indonesia and ASEAN. The study is qualitative with an exploratory approach and uses secondary data obtained from online media, official government social media accounts, and relevant academic journals. Thematic coding and content categorization were performed using NVivo 12 Plus. These procedures include word frequency analysis, clustering of diplomatic themes and mapping of crisis communication narrative patterns.The results show that Indonesia has developed a unique crisis communication strategy in response to the Iran-Israel conflict, which is different from Indonesia’s response to previous geopolitical conflicts. The content analysis of government social media reveals three prevailing patterns: (1) humanitarian framing that emphasizes the suffering of Palestinian civilians; (2) sovereignty and non-intervention narratives as the foundation of diplomatic communication; and (3) multilateral platforms (ASEAN, the UN and the OIC) as amplification platforms for messages. Indonesia’s humanitarian diplomacy is acknowledged as a soft power strategy to cultivate a regional leadership image and facilitate balanced relationships with Western partners by means of principle-based rhetoric instead of bloc alignment. Conversely, ASEAN’s official statement is usually neutral and procedural because of the divergence of interests among its member states. Indonesia, in contrast, consistently positions itself as a proactive communication actor through humanitarian, multilateral, and bilateral channels, exhibiting a crisis communication pattern that is notably different from other ASEAN nations. Keywords: Iran-Israel conflict, government crisis communication, humanitarian diplomacy, soft power, ASEAN–Indonesia diplomacy.   ABSTRAK Penelitian ini mengkaji dampak konflik Iran–Israel terhadap narasi komunikasi pemerintah dan strategi komunikasi krisis di Asia Tenggara dengan penekanan khusus pada peran Indonesia dan ASEAN. Penelitian menggunakan pendekatan kualitatif eksploratif dengan memanfaatkan data sekunder yang bersumber dari media daring, akun media sosial resmi pemerintah, serta jurnal akademik yang relevan. Analisis dilakukan menggunakan NVivo 12 Plus untuk melaksanakan proses pengodean tematik dan kategorisasi konten. Prosedur analisis mencakup analisis frekuensi kata, pengelompokan tema-tema diplomatik, serta pemetaan pola narasi komunikasi krisis. Hasil penelitian menunjukkan bahwa Indonesia mengembangkan strategi komunikasi krisis yang khas dalam merespons konflik Iran–Israel, yang berbeda dari pola respons Indonesia terhadap konflik geopolitik sebelumnya. Analisis terhadap konten media sosial pemerintah mengidentifikasi tiga pola utama: (1) pembingkaian humaniter yang mene-kankan penderitaan warga sipil Palestina; (2) narasi mengenai kedaulatan dan prinsip non-intervensi sebagai landasan komunikasi diplomatik; serta (3) pemanfaatan platform multilateral, seperti ASEAN, PBB, dan OKI, sebagai sarana untuk memperkuat dan memperluas pesan diplomatik. Diplomasi humaniter Indonesia dipandang sebagai strategi soft power yang bertujuan membangun citra kepemimpinan regional sekaligus mempertahankan hubungan yang seimbang dengan mitra-mitra Barat melalui penggunaan retorika berbasis prinsip, bukan melalui keberpihakan pada blok tertentu. Sebaliknya, komunikasi resmi ASEAN cenderung bersifat netral dan prosedural sebagai konsekuensi dari adanya perbedaan kepentingan di antara negara-negara anggotanya. Indonesia, berbeda dengan pola tersebut, secara konsisten memosisikan dirinya sebagai aktor komunikasi yang aktif melalui saluran humaniter, multilateral, dan bilateral. Hal ini menunjukkan adanya pola komunikasi krisis yang secara signifikan berbeda dari pola komunikasi negara-negara ASEAN lainnya. Kata Kunci: Konflik Iran-Israel, komunikasi krisis pemerintah, diplomasi kemanusiaan, kekuatan lunak (soft power), diplomasi ASEAN-Indonesia.
