Abstract

Reducing losses from natural disasters is an essential component of effective recovery and resilience building. Recognizing this, the Indonesian government has allocated a dedicated budget for disaster management through the State Budget (APBN) and Regional Budget (APBD), as stipulated in Law No. 24 of 2007 concerning Disaster Management. This allocation aims to ensure that resources are available for immediate response and long-term recovery efforts. However, the increasing frequency and severity of natural disasters, exacerbated by climate change, underscore the need for more substantial and adaptive financial mechanisms to address the growing demands for catastrophe funding.Funding mechanisms must extend beyond immediate needs such as emergency response and recovery. They should also encompass disaster risk transfer and mitigation initiatives, which include preventive measures, community preparedness, and investments in rehabilitation and reconstruction. Such an integrated approach not only addresses the consequences of disasters but also reduces risks and vulnerabilities over time.Individual risk insurers play a pivotal role in this framework by providing insurance solutions to help manage potential losses. In this context, the agreement between the insured and the insurer is formalized through a policy. This policy defines the insurer's obligation to cover specific risks that the insured may face in the future, in exchange for regular payments known as premiums. This system of risk transfer is a vital component of a comprehensive disaster risk management strategy, enabling both individuals and institutions to recover more swiftly from the financial impacts of disasters.

Abstract

World Trade Organization dalam kompleksitasnya, membangun sebuah sistem hukum perdagangan yang lengkap dengan berdasar kepada konsensus sebagai metode pengambilan keputusan. Dalam kapasitas tersebut, WTO membagi kekuasaannya ke dalam fungsi-fungsi yang dijalankan oleh alat kelengkapan tersebut. Peristiwa penolakan penunjukan anggota Appellate Body oleh Amerika Serikat menjadi fenomena bom waktu yang mengungkap adanya celah dalam pembagian dan pemisahan kekuasaan tersebut, yang dapat disebut permasalahan prosedural dalam tubuh WTO. Tulisan ini bertujuan memberi analisa terhadap posisi Appellate Body dalam WTO secara struktural dan normatif, serta mengenai sebab dan akibat hukum penolakan Amerika Serikat terhadap penunjukan anggota Appellate Body. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan konseptual dan pendekatan perundang-undangan, menggunakan prinsip dalam konstitusionalisme dan hukum organisasi internasional untuk sampai pada kesimpulan bahwa WTO perlu mereformasi bentuk ajudikasi Appellate Body menjadi ajudikasi penuh dan pemilihan hakim Appellate Body yang dijalankan dengan konsensus terbalik

Abstract

The development of information technology provides wide access to information and digital interaction. However, the lack of legal literacy among the younger generation often leads to violations that have negative impacts, such as the spread of rights, violations of privacy and cyberbullying. This community service activity aims to improve the understanding of junior high school students about the ITE Law, digital literacy and media ethics. The socialization methods used include interactive presentations, group discussions and legal case simulations. Pre-test and post-test evaluations showed an increase in understanding of digital law by up to 80%. This activity succeeded in equipping students with basic knowledge about digital ethics, data security and the legal implications of online activities.

Abstract

Kegiatan pengabdian kepada masyarakat bertajuk Law in a Day diselenggarakan oleh Program Studi Hukum Bisnis Universitas Sugeng Hartono sebagai bentuk kontribusi dalam memperkuat integritas akuntabilitas dan kepercayaan publik terhadap lembaga peradilan. Tema kegiatan mengangkat pendekatan hukum pidana dalam menanggulangi tindak pidana suap yang marak terjadi di lingkungan peradilan. Seminar ini dilaksanakan secara hybrid dan melibatkan pelajar tingkat SMA mahasiswa akademisi serta praktisi hukum dari unsur hakim dan advokat. Metode kegiatan mencakup ceramah diskusi interaktif dan simulasi akademik yang bertujuan membangun kesadaran hukum generasi muda sekaligus menguatkan implementasi tridharma perguruan tinggi. Hasil kegiatan menunjukkan peningkatan literasi hukum di kalangan pelajar penguatan keterampilan mahasiswa dalam pembelajaran berbasis proyek serta terciptanya forum edukatif yang menjembatani akademisi praktisi dan masyarakat dalam isu reformasi hukum. Kegiatan ini menjadi langkah progresif yang patut direplikasi dalam penguatan budaya hukum yang bersih dan bermartabat.

Abstract

The development of lifestyles and the complexity of human problems have led to changes in the concepts of sovereignty and national boundaries. One such complexity is environmental issues, the implications of which are not limited to one or a few countries but to the entire global community. Therefore, regulations aimed at environmental sustainability and preservation have become a primary objective of transnational activities. Deforestation is an international concern that requires serious attention. This spirit is manifested by the European Union in the European Union Deforestation-Free Regulation, which ensures that export products to the EU market are not made from materials derived from or through deforestation. This paper describes how the EUDR uses extraterritorial jurisdiction to strengthen a green economic climate, but at the same time, opens up weaknesses in sovereignty for developing countries that are exporters. This paper uses the theory of state sovereignty and the fundamental principles of international contract law as references. The research method used is a normative research method with a conceptual approach and a legislative approach.
