Abstract

Peraturan Menteri Perdagangan terkait kewajiban untuk menggunakan kapal nasional dalam pengangkutan komoditas tertentu dalam perspektif hukum progresif perlu untuk diperbaiki terutama terkait hubungan antara aturan dan fakta di lapangan. Penelitian ini menggunakan metode pendekatan socio-legal yang disandingkan dengan teori hukum progresif untuk melihat hukum dari aspek manusia dan perilakunya. Hasil penelitian menunjukkan bahwa pemerintah belum siap untuk menerapkan kebijakan penggunaan pelayaran dalam negeri dalam ekspor impor komoditas tertentu yang lebih karena kurangnya dukungan pemerintah dari segi kebijakan hukum untuk dapat menyokong subyek yang dikenakan dalam kebijakan tersebut, oleh karenanya secara normatif perlu diperjelas mengenai penerapan asas cabotage yang disesuaikan dengan kebijakan kewajiban dalam Permendag tersebut.

Abstract

Trade cooperation is a part of contract law within the scope of Indonesian civil law, which often involves both written and unwritten agreements. Business disputes in trade cooperation arising from unwritten agreements are unavoidable risks that can be resolved through arbitration or court proceedings. This study aims to examine the resolution of disputes in unwritten agreements from the perspective of Indonesian civil law. The findings indicate that all types of agreements, whether written or oral, are considered valid as long as they meet the requirements stipulated in Article 1320 of the Indonesian Civil Code. Furthermore, dispute resolution in trade cooperation relationships can be conducted through litigation or non-litigation mechanisms, including arbitration.

Abstract

The research examines consumer protection due to losses from grilled meatball poisoning in terms of Law Number 8 of 1999 concerning Consumer Protection. The legal problem was caused by consumers experiencing health losses due to poisoning caused by grilled meatballs in Padang City. The aim of the research is to examine the protection and resolution of consumer losses due to grilled meatball poisoning. The method used is a literature study with data collection through document review appropriate for normative legal research. The approaches applied include a statutory approach, a conceptual approach, and a case study approach. The research is expected to provide knowledge of protection and legal certainty for consumers if losses occur due to negligence or deliberate intent of producers in the business field.

Abstract

This research discusses the comparison of the form of flexible work agreement between Indonesia and the UK in the perspective of labor law. Flexible work is a work arrangement that provides flexibility in determining the time and location of work to create a balance between work and personal life. In Indonesia, flexible work agreements have not been comprehensively regulated in labor regulations, causing legal uncertainty for workers. In contrast, the UK has established a clear legal framework through the Employment Rights Act 1996 and Flexible Working Regulations 2014 that provides stronger protection to workers. This difference in regulatory approach indicates the need for labor law reform in Indonesia to provide justice for flexible work workers. This research aims to analyze the form of flexible work agreements and the level of legal protection received by workers in both countries.

Abstract

The Supreme Court as the executor of judicial power has made various efforts to prevent these problems, including by increasing the number of justices from academics and other legal practitioners besides career judges, revamping the organization internally, empowering the oversight function to enforcing one roof for all matters. financial, organizational and administrative under the Supreme Court itself, but these efforts have not yet shown significant results. This condition certainly cannot be allowed to occur because it can trigger vigilante actions and can cause chaos in society. The solution to this problem is to develop alternative dispute resolution outside the court through non-formal channels, one of which is through mediation. Bale Mediasi is an institution that facilitates dispute resolution outside of court based on local wisdom, so that it can resolve various legal issues faced by the community without having to end up in court. The establishment of this institution is a form of government acknowledgment in providing protection, respect and empowerment for the existence of local wisdom through customary institutions in carrying out mediation functions, preventing and reducing conflicts or disputes in the community earlier, and holding dispute resolution in the community through mediation in order to create peaceful, orderly and harmonious atmosphere.
