Abstract

This study aims to analyze the methods and schemes for industrial relations dispute resolution (PPHI) in order to improve the productivity of the labor law system in Indonesia. Unresolved industrial relations issues can negatively impact employment stability and national productivity. This study uses a qualitative approach with juridical-normative and juridical-sociological methods to examine laws and regulations and dispute resolution practices in the field. Data were collected through literature studies and interviews with legal practitioners, employers, and labor unions. The results indicate that an ideal PPHI scheme should be fast, fair, affordable, and easily accessible to the parties. In addition, increasing the capacity of dispute resolution institutions, such as mediation at the Manpower Office and arbitration institutions, significantly influences the effectiveness of labor law. Therefore, comprehensive improvements to the PPHI system are essential to create harmonious and productive industrial relations.

Abstract

Artikel ini mengkaji peran hukum sebagai instrumen strategis dalam perencanaan dan pelaksanaan pembangunan ekonomi di Indonesia. Sebagai negara hukum yang tengah mengalami transformasi ekonomi secara pesat, Indonesia membutuhkan sistem hukum yang tidak hanya konsisten, tetapi juga adaptif terhadap tantangan global dan kemajuan teknologi. Melalui pendekatan yuridis normatif dan penerapan Economic Analysis of Law (EAL), studi ini menunjukkan bahwa optimalisasi fungsi hukum khususnya dalam mendorong kejelasan regulasi, keadilan, dan efisiensi sangat penting untuk menciptakan iklim investasi yang stabil dan pertumbuhan yang inklusif. Lebih jauh, konsistensi dan kemampuan adaptasi kerangka hukum Indonesia berpengaruh langsung terhadap pencapaian tujuan pembangunan nasional. Temuan ini menekankan pentingnya reformasi hukum dan kolaborasi lintas disiplin, khususnya antara pembuat kebijakan dan akademisi, guna mewujudkan ekosistem hukum yang adaptif dan mendukung kemajuan ekonomi berkelanjutan.

Abstract

The primary factor posing a challenge to the implementation of environmental policies in Indonesia is weak law enforcement. Well-formulated environmental regulations are rendered ineffective when enforcement is weak and inconsistent. Numerous pollution cases end without meaningful legal consequences, either due to inadequate supervision or conflicts of interest between regulators and business actors. This study employs a normative–juridical approach with a normative legal research specification. Data analysis is conducted using a qualitative juridical method focusing on environmental law and sustainable development. The findings indicate that the implementation of environmental law in Indonesia has not been effective in supporting sustainable development. The main weaknesses lie in institutional limitations, inadequate supervision, and low levels of public participation. In addition, regulatory ambiguity and weak political commitment further hinder effective law enforcement. Therefore, strengthening institutional capacity, harmonizing regulatory frameworks, and integrating environmental considerations into development policies are essential to enable environmental law to function optimally.
