Abstract

Corruption is an extra ordinary crime which is very detrimental to the Indonesian nation and state. For this reason, the Government has issued or made a law, namely Law number 31 of 1999 in conjunction with Law number 20 of 2001 concerning the Eradication of Corruption Crimes. That in article 2 paragraph 2 of the Law it is said that the death penalty can be applied if Indonesia is in certain circumstances. This particular situation means if Indonesia is in a state of disaster emergency, a state of war or a disaster emergency. However, the problem that often arises is that a prosecutor does not dare to enforce the charges under Article 2, paragraph 2 of the Corruption Eradication Law. Keywords: corruption Tindak Pidana Korupsi merupakan suatu tindak pidana extra ordinary crime yang sangat merugikan bangsa dan negara Indonesia. Untuk itu Pemerintah telah menerbitkan atau membuat suatu Undang-Undang yaitu Undang-Undang nomor 31 tahun 1999 jo Undang-Undang nomor 20 tahun 2001 mengenai Pemberantasan Tindak Pidana Korupsi. Bahwa di dalam pasal 2 ayat 2 Undang-Undang tersebut dikatakan bahwa Pidana Mati dapat diterapkan bila Indonesia dalam keadaan tertentu. Keadaan tertentu tersebut maksudnya apabila Indonesia dalam keadaan darurat bencana, keadaan perang atau darurat bencana. Akan tetapi permasalahan yang sering muncul yaitu tidak beraninya seorang jaksa memaksukan dakwaan pasal 2 ayat 2 Undang-undang Pemberantasan Tindak Pidana Korupsi. Kata kunci: korupsi

Abstract

The rapid advancement of information technology has brought significant challenges, one of which is the risk of personal data leakage due to cybercrime. In response to this, Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) was enacted as a legal foundation that comprehensively regulates the protection of personal data in Indonesia. This law contains the main principles of personal data protection, including the rights of individuals as data owners to receive protection, the obligations of data controllers and processors to maintain information security, as well as the obligation to conduct risk assessments in processing data that has the potential for high impact. The PDP Law also explicitly prohibits the collection and dissemination of personal data without a legal basis, which could harm the data owners, with criminal sanctions including imprisonment of up to five years and fines of up to IDR 5 billion for offenders. Moreover, this law establishes a personal data protection authority tasked with supervising the implementation of the provisions and receiving and following up on public reports of alleged violations. Victims of data leakage have several legal avenues available, such as filing civil lawsuits, reporting to the Ministry of Communication and Information Technology for administrative resolution, or reporting to the police for criminal prosecution. With this regulation, the state provides strong legal protection guarantees and structured enforcement procedures to prevent and address incidents of personal data leakage resulting from cybercrime, while also encouraging increased awareness and responsibility among data managers in today’s digital era.

Abstract

Addressing the challenges faced by housewives in Pabuaran, Banyumas, this study focuses on the pressing need to empower them with digital marketing knowledge and the integration of Islamic values into their business endeavors. In many rural areas, including Pabuaran, traditional business practices often encounter obstacles in reaching broader markets and adapting to the rapidly evolving digital landscape. Despite being skilled entrepreneurs, housewives may lack access to resources and knowledge regarding effective digital marketing strategies. Additionally, there is a growing recognition of the importance of incorporating ethical and moral principles, such as those derived from Islamic teachings, into business practices. However, there is a gap in understanding how to effectively integrate these principles into modern business operations. Thus, this study aims to bridge these gaps by providing participants with practical knowledge and skills in digital marketing while exploring the application of Islamic values in entrepreneurship. By addressing these challenges, the study seeks to empower housewives in Pabuaran to overcome barriers to market access and enhance the sustainability and ethical integrity of their businesses. Through this empowerment initiative, participants will be equipped to leverage digital marketing tools effectively and align their business practices with Islamic principles, thereby fostering economic growth and social development within their community.

Abstract

Perkembangan teknologi digital telah meningkatkan intensitas interaksi masyarakat, khususnya mahasiswa, dalam ruang digital. Namun, rendahnya literasi hukum pidana menyebabkan banyak aktivitas sehari-hari berpotensi menimbulkan konsekuensi hukum tanpa disadari. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan literasi dan kesadaran hukum pidana mahasiswa melalui penyuluhan yang dilaksanakan secara daring dan/atau hybrid. Metode pelaksanaan kegiatan menggunakan pendekatan edukatif dan partisipatif melalui ceramah interaktif, diskusi, dan tanya jawab dengan mengangkat contoh-contoh kasus sederhana yang relevan dengan kehidupan mahasiswa. Hasil kegiatan menunjukkan bahwa penyuluhan hukum pidana mampu meningkatkan pemahaman mahasiswa mengenai perilaku yang berpotensi melanggar hukum pidana serta mendorong kesadaran akan pentingnya etika dan tanggung jawab dalam aktivitas digital. Kegiatan ini diharapkan dapat menjadi upaya preventif dalam meminimalkan pelanggaran hukum pidana di lingkungan akademik

Abstract

Micro, Small, and Medium Enterprises (MSMEs) managed by PKK women in Rakit District, Banjarnegara Regency, still face limitations in utilizing digital technology, particularly in supporting marketing and business communication activities. Low digital literacy and limited assistance have become major challenges in optimizing the role of PKK in community economic empowerment. This community service program aims to enhance the digital literacy of PKK women’s MSMEs through training and assistance in using ChatGPT as a business marketing support tool. The methods employed include pre-test, material presentation using PowerPoint, hands-on practice in using ChatGPT, and post-test as an evaluation tool. The results indicate an improvement in participants’ understanding after the training, as reflected by higher post-test scores compared to pre-test scores among all participants. Furthermore, participants were able to produce simple product descriptions and promotional content relevant to their respective businesses. These findings suggest that ChatGPT can serve as a practical solution to improve digital literacy and support MSME management and marketing at the local level.

Abstract

Asset seizure in corruption cases is an important instrument in efforts to recover state financial losses. However, in law enforcement practice, seizures are often carried out against goods or property that have no causal relationship with the alleged criminal offense. This condition creates tension between the interest of eradicating corruption and the protection of human rights, particularly the right to property and the guarantee of due process of law. This article aims to analyze pretrial remedies against the seizure of property unrelated to corruption offenses from the perspectives of law enforcement and human rights protection in Indonesia. This study employs a normative legal research method using statutory, conceptual, and case approaches, particularly through an examination of pretrial decisions of the Pekanbaru District Court concerning asset seizures in alleged corruption cases. The results indicate that seizures not supported by evidence of a direct connection to the criminal offense potentially violate the principle of legality, the principle of proportionality, and the protection of human rights as guaranteed by the 1945 Constitution of the Republic of Indonesia and national human rights instruments. Pretrial mechanisms play a strategic role as a form of judicial control over arbitrary coercive measures. Therefore, reforms are required in the seizure application mechanism by emphasizing strict substantive review and strengthening the role of pretrial proceedings to create a balance between the effectiveness of corruption eradication and the protection of citizens’ constitutional rights within the Indonesian criminal justice system.
