Abstract

AbstractThis study wants to see how the legal problems in determining the factors that adjust the BMD rental and legal politics of norms in the future. This research uses normative legal research. The results of the study show that there is a legal discovery at the level of Permendagri 19/2016. As an implementing regulation for BMD and becoming an NSPK by the local government, Permendagri 19/2016 still does not have a rigid norm regulating the rent-adjusting factor. Legal reforms need to be carried out, among others, by: 1. to provide legal certainty for the separation between the BMD and BMN regimes firmly; 2. strengthening the role of the central government as a supervisor for local governments; 3. Local governments are free to seek legitimate financial opinions through (PAD). The advice given to the Ministry of Home Affairs is to revise Permendagri 19/2016 by incorporating the norms for rent-adjusting factors by adopting the norms contained in the Regulation of the Minister of Finance Number 115/PMK.06/2020 concerning Utilization of State Property.Keywords: Legal update; Regional Property Rental; Local government.AbstrakPenelitian ini ingin meilihat bagaimana permasalahan hukum dalam penetapan faktor penyesuai sewa BMD oleh pemerintah daerah dan politik hukum pembaharuan norma di masa mendatang. Pengkajian hal mengenai hal tersebut tergolong baru, karena belum pernah ada penelitian sebelumnya yang mengkaji pengaturan sewa BMD khususnya dalam Permendagri 19/2016. Penelitian ini menggunakan penelitian hukum normatif. Hasil penelitian menunjukakan bahwa terjadi kekosongan hukum dalam level Permendagri 19/2016. Sebagai peraturan pelaksana BMD dan menjadi NSPK oleh pemerintah daerah, Permendagri 19/2016 masih belum memiliki norma yang rigid mengatur tentang faktor penyesuai sewa. Permendagri 19/2016 tidak sampai mengatur tentang peruntukan hingga penghitungan terhadap jenis-jenis kegiatan usaha yang memanfaatkan BMD. Pembaruan hukum perlu dilakukan antara lain dengan adalah: 1. memberikan kepastian hukum pemisahan antara rezim BMD dan BMN secara tegas; 2. memperkuat peran pemerintah pusat sebagai pembina pemerintah daerah; 3. Pemerintah daerah bebas untuk mencari pendapat keuangan yang sah melalui (PAD). Saran diberikan kepada Kementrian Dalam Negeri untuk melakukan revisi terhadap Permendagri 19/2016 dengan memasukkan norma faktor penyesuai sewa dengan mengadopsi norma yang ada dalam Peraturan Menteri Keuangan Nomor 115/PMK.06/2020 Tentang Pemanfaatan Barang Milik Negara.Kata Kunci: Pembaruan Hukum; Sewa Barang Milik Daerah; Pemerintah Daerah.

Abstract

Tindak pidana yang bersifat ringan harus diselesaikan dengan mekanisme yang sama seperti tindak pidana yang berat, adalah salah satu bentuk ironi keadilan. Untuk mengurangi persoalan ironi keadilan tersebut, beberapa negara telah mengembangkan berbagai mekanisme penyelesaian perkara di luar persidangan untuk perkara-perkara yang bersifat ringan. Selain itu,  sistem peradilan pidana di setiap negara secara umum juga hanya mampu memproses sebagian kecil dari seluruh  tindak pidana yang terjadi sehingga penuntut umum harus melaksanakan diskresi dalam memutuskan perkara mana yang akan dilanjutkan atau dihentikan penuntutannya atau diselesaikan dengan mekanisme penyelesaian perkara pidana yang bersifat ringan di luar persidangan. Isu hukum yang dianalisis dalam tulisan ini adalah bagaimana ratio legis pengaturan mekanisme penyelesaian perkara pidana di luar persidangan di Belanda dan Inggris. Hasil dari analisis tersebut adalah ratio legis pengaturan penyelesaian perkara pidana di luar persidangan adalah untuk mewujudkan keadilan melalui penyederhanaan sistem peradilan pidana dan penerapan asas kelayakan. Keadaan berbeda terjadi pada sistem peradilan pidana Indonesia karena sangat tidak efisien, tidak sesuai dengan asas peradilan cepat, sederhana, dan biaya ringan. Berdasarkan kesimpulan  diatas, maka dapat disampaikan  rekomendasi bahwa asas kelayakan perlu segera diterima dalam sistem peradilan pidana di Indonesia dengan cara mengadopsi teori subsosialitas sebagaimana tercantum dalam Pasal 9a Sr. dan mengadopsi mekanisme penyelesaian perkara tindak pidana yang bersifat ringan di luar persidangan dalam bentuk transaksi dengan model komposisi, dengan disertai adanya modifikasi penambahan pokok-pokok pemikiran adaptasi bagi sistem hukum Indonesia.Keywords: penyelesaian; perkara; pidana

Abstract

The advocate profession as an officium nobile is required to carry out their duties professionally in the real terms of the implementation for the community. However, various professional advocacy organizations currently influence the effect of professionality ethical values. In this regard, it is necessary to conduct a study on how advocates' professionalism in Indonesia in accordance with the value of Pancasila as contained Law No. 18 of 2003 on Advocate (Advocate Law 2003) and Indonesian Advocates' Code of Ethics (KEAI). The research aims to harmonize KEAI and Advocate Law 2003 and create a Professional Committee for the advocate in Indonesia. This research used normative legal research with comparative and historical approaches. The result showed that the improvement of current KEAI as mandated by Advocate Law 2003 by confirming the position of the Supervisory Commission and the Honorary Council and further involving external elements, as well as elements of the state as controllers will avoid the advocate profession from the involvement of unethical behavior, slaves by the client and its involvement to the criminal offences.

Abstract

The state's right to control land as a principle is often problematic in practice. The problem generally lies with the state which tends to use land only for economic and oligarchic interests. As a result, the right to control the state whose function is to prosper the people cannot be realized. This research will reveal and analyze the background of the causes of the agrarian conflict in the village of Tegalrejo, Malang Regency, and provide an overview in a reflection of the state's right to control land. This research uses normative juridical research with statutory, historical and case study approaches which in this case are agrarian conflicts. The results of the research show that the state's right to control over land sometimes becomes a tool for state legitimacy to carry out land grabs. The right to control the state, which essentially serves as a legal framework to protect the public, has not been able to fully function ideally and properly. There is no significant difference between the New Order regime and the Reform Government regime in the management of state control rights, because both have a mode of appropriation by granting status of land rights and compensation. This is similar to what happened in the agararia conflict in Tegalrejo Village, Malang Regency, where legal appropriation was formulated in the form of Cultivation Rights. Compensation that has not been resolved to date has also led to the creation of structural agrarian conflicts that have disrupted the socio-economic life of the surrounding community. In the future, it is necessary to think about the rejuvenation of the concept of the state's right to control so that state control over land is no longer hegemonic and can be on a par with the protection of citizens' rights to land.

Abstract

Suspects have the right to obtain legal assistance, especially for suspects who are classified as economically disadvantaged in accordance with Article 56 of the Criminal Procedure Code (KUHAP). The facts show that there are many irregularities in the implementation of legal aid, therefore it is necessary to know about the implementation of free legal aid for suspects who are incapacitated at the level of investigation and the factors that become obstacles in the implementation of legal aid. This legal research is an empirical legal research and this research is descriptive in nature. The data used are primary data and secondary data. The techniques used to collect data were document study techniques and interview techniques. Inhibiting factors affecting the implementation of free legal aid for suspects who are unable at the level of investigation can be classified and differentiated into 3 factors, namely, legal substance, legal structure, and legal culture).Keywords: Legal Aid, Criminal Cases
