Abstract

Purpose of the study:This study aims to solve the problem of citizens who refuse funerals/bodies of Covid-19 patients.Methodology The method used in this study is a normative juridical method using statutory, conceptual and case approaches.Results This study found that it is necessary to socialize, educate and communicate to the citizens that the Covid-19 bodies have gone through stages in accordance with medical protocol and WHO in the treatment/repatriation of bodies so that there should be no need for excessive fear while if residents refuse funerals Covid-19 patients' bodies there are sanctions including moral sanctions, fines and criminal confinement.Applications of this studyThis research can be used by academics and practitioners in health law, so that they can create an instrument to socialize the acceptance of Covid-19's bodies in the community.Novelty/ Originality of this study The bodies of Covid-19 patients have been carried out the repatriation (management) of the bodies in accordance with the standards of who's health protocol (World Health Organization), namely the bodies wrapped in three layers of shrouds and linen and two layers of body bags. then the body in Tayyamum using dust, the body and then placed into the coffin that was placed typical and has been sprayed disinfectant liquid, then the coffin closed tightly using silicone glue and then given nails on each side of the coffin.

Study This give deep insight about protection law for doctor in practice medical based on Constitution Number 17 of 2023 concerning Health and its derivatives . Focus main study This is For highlight challenges and dilemmas faced by doctors in operate his profession , including problem protection law for doctor in report incident safety patients , with hope can increase quality service health in a way overall , which at the moment This Still referring to the Minister of Health Regulation no. 11 of 2017 concerning safety patient . One of the the most crucial aspect in study This is analysis to Article 189 of the Health Law , which regulates importance effective communication between House sick and patient . Article This underline obligation doctors and institutions health For build transparent , clear , and interest - oriented communication patient . In context this , good communication can reduce potential misunderstanding and avoidance problem the law that arises consequence lack of information or ambiguity in service medical . Abstract

Background: Fraud in the National Health Insurance (JKN) program managed by BPJS Kesehatan poses a serious challenge to maintaining the sustainability of healthcare services in Indonesia. This study aims to analyze the forms of fraud, their impact on the healthcare system, and prevention strategies based on ethical and regulatory perspectives, specifically Health Law No. 17 of 2023 and Minister of Health Regulation No. 16 of 2019. Methodology: This study uses a normative legal approach with a descriptive-qualitative analysis method. Data were obtained through a literature review of applicable regulations, academic literature, and document analysis related to fraud in BPJS health. Primary legal sources include Health Law No. 17 of 2023 and various related regulations, while secondary sources consist of journal articles and research reports. The analysis was conducted by identifying fraud patterns, evaluating the effectiveness of supervision and administrative sanctions, and reviewing the role of technology in fraud mitigation. Results: Research shows that BPJS health fraud occurs due to weak supervision, minimal participant literacy regarding rights and obligations, and gaps in the claims and verification system. Implementing an information technology-based anti-fraud system, participant education, and increased oversight are strategic steps to minimize fraud. With a multidisciplinary approach, it is hoped that the JKN system can function optimally, ensure transparency, and increase the accountability of healthcare providers

Abstract

Pembatasan praktik aborsi dalam Undang-Undang Nomor 17 Tahun 2023 membawa konsekuensi serius bagi tenaga medis, terutama dokter dan bidan yang terlibat dalam pelayanan kesehatan ibu. Meski aborsi diperbolehkan dalam keadaan tertentu, seperti darurat medis atau akibat pemerkosaan, aturan hukum yang berlaku sangat ketat. Jika tenaga medis melakukan aborsi di luar batas yang ditetapkan, mereka bisa terancam pidana, meskipun niatnya adalah menyelamatkan pasien atau atas dasar kemanusiaan.Dalam praktiknya, aturan yang belum sepenuhnya jelas ini bisa membuat tenaga medis ragu mengambil tindakan, karena takut berhadapan dengan hukum. Hal ini tentu bisa membahayakan pasien dan mengganggu pelayanan kesehatan. Karena itu, pemerintah perlu segera memberikan pedoman yang lebih rinci dan jelas, agar tenaga medis bisa bekerja dengan tenang, sesuai dengan hukum, tanpa takut dikriminalisasi. Penegakan hukum di bidang kesehatan harus adil, manusiawi, dan tetap melindungi hak semua pihak—baik pasien maupun tenaga medis.
