Abstract

Halal tourism is one of the fastest-growing sectors, driven by the increasing needs of Muslim travelers for services that comply with Islamic principles. Indonesia, as a country with a Muslim-majority population, has significant potential to develop this sector, particularly in the hotel and restaurant industries, which play an important role in supporting tourism activities. This study aims to analyze the implementation of halal tourism concepts in the hotel and restaurant sectors and to identify the challenges and development strategies in Indonesia. The method used is a literature review by examining various sources such as scientific journals, books, and relevant reports published within the last five years. The results show that the implementation of halal tourism has been carried out through the provision of prayer facilities, assurance of halal food and beverages, and services that support the comfort of Muslim travelers. However, its implementation still faces several challenges, including limited human resources, uneven halal certification, lack of public awareness, and suboptimal regulatory and infrastructure support. In addition, promotion and branding of halal tourism still need to be strengthened to reach a wider market. Therefore, integrated development strategies are needed, including improving human resource quality, strengthening regulations, accelerating halal certification, and optimizing promotion and collaboration among stakeholders. The findings of this study are expected to serve as a reference for the government and business actors in developing halal tourism that is more competitive, inclusive, and sustainable in Indonesia.

Abstract

Perkembangan industri perhotelan di Indonesia memicu keresahan umat Muslim terkait potensi penyalahgunaan fasilitas untuk perbuatan yang bertentangan dengan syariat Islam. Penelitian ini bertujuan menganalisis penerapan konsep halal dalam sektor pariwisata dan perhotelan serta meninjau hukum penggunaan jasanya dalam perspektif Islam. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan studi pustaka (library research) yang mengkaji berbagai data sekunder dari buku teks fiqh muamalah, jurnal ilmiah terakreditasi, dan dokumen hukum Islam yang relevan. Hasil penelitian menunjukkan bahwa penerapan konsep halal pada hotel mampu memberikan rasa aman bagi wisatawan Muslim karena seluruh operasionalnya memperhatikan prinsip syariah, seperti penyediaan makanan halal, fasilitas ibadah, dan pemisahan fasilitas rekreasi berbasis gender. Selain mendukung pertumbuhan ekonomi, konsep hotel halal juga efektif meminimalisasi praktik kemaksiatan di lingkungan perhotelan. Dalam perspektif hukum Islam, penggunaan jasa hotel pada dasarnya diperbolehkan di bawah akad ijarah (sewa-menyewa manfaat). Namun, praktik penyewaan kamar yang diketahui secara sadar digunakan untuk perbuatan zina dinilai haram karena termasuk bentuk tolong-menolong dalam berbuat dosa (ta'awun 'ala al-itsmi). Kesimpulannya, penguatan regulasi perhotelan berbasis syariah sangat diperlukan untuk menjaga kemaslahatan umat dan mendukung ekosistem pariwisata halal.

Abstract

The Kerapatan Qadi is a judicial institution during the Banjar Kingdom era. This institution not only served as a place for those seeking justice but also symbolized the implementation of Islamic law in Kalimantan. The purpose of this study is to analyze and explore the Kerapatan Qadi as a manifestation of the enforcement of Islamic law in Kalimantan. This research falls under the category of empirical legal research using a historical approach. The data sources for this research can be classified into three categories: primary, secondary, and tertiary data, which are then analyzed using the theories of living law and the applicability of law. The results of this study indicate that, first, the Kerapatan Qadi as a judicial institution has existed since the establishment of the Banjar Kingdom in Kalimantan, and during the Dutch colonial era, it received legitimacy through Stbl. 1937 No. 116 and 610 regarding Religious Courts in Java and Madura, which confirmed Stbl. 1882 No. 152, as well as Stbl. 1937 Nos. 638 and 639 regarding the establishment of judicial institutions for South and East Kalimantan. The Kerapatan Qadi in Kalimantan is divided into two levels. The First-Level Kerapatan Qadi was spread across several important regions, including Negara, Kandangan, Barabai, Amuntai, Tanjung, Rantau, Pelaihari, Martapura, Banjarmasin, and Marabahan. Meanwhile, the Appellate level was held at the Kerapatan Qadi Besar in Banjarmasin. Second, the enforcement of Islamic law in Kalimantan, particularly during the Banjar Sultanate era, can be observed from the existence of the Kerapatan Qadi as an official judicial institution that upheld Islamic law. This study examines the rulings issued by the Kerapatan Qadi and demonstrates that the institution had broad jurisdiction, covering family law (ahwal syakhshiyah), criminal law (jinayah), and issuing fatwas.

Abstract

Fikih Qada Murafa’at is a branch of Islamic law that focuses on the judicial process and procedural law in Islamic courts. This study examines the fundamental concepts related to procedural law, including principles of justice, the rights of the parties involved, and fair trial procedures from the perspective of Islamic sharia. This study aims to analyze the application of Fikih Qada Murafa’at in the context of modern Islamic adjudication, with a focus on court procedures, the presentation of evidence, and the rights and obligations of the disputing parties. This study employs a qualitative approach using a case study method through in-depth interviews and analysis of legal documents and court decisions. Furthermore, this article highlights the challenges encountered in harmonizing Islamic legal rules with national legislation. The findings indicate that the principles of Fikih Qada Murafa’at remain relevant in the procedural law process of Islamic courts, although adjustments to the contemporary legal system are necessary. The proper application of these principles can ensure both procedural and substantive justice for all parties involved in legal disputes.
