Abstract

Dalalah al-mahfûm al-muwâfaqah is one of the methods of understanding texts in ushul fiqh which plays an important role in exploring the legal meaning of the syar'i text. This study aims to analyze the concept of mahfûm al-muwâfaqah, its basis in the syar'i text, and how it is implied in determining Islamic law. The methodology used is qualitative-descriptive with a normative analysis approach. The results of the study show that mahfûm al-muwâfaqah has strong legitimacy in the Qur'an and Sunnah, and is an important instrument in building legal analogies and ijtihad. The implications are very broad, especially in responding to modern legal problems that are not explicitly mentioned in the text.

Abstract

Studi ini bertujuan untuk mengkaji ulang konsep wasiat berdasarkan literatur klasik dan pemikiran kontemporer guna menilai relevansinya dalam konteks modern sebagai bagian dari Islamic estate planning. Dengan menggunakan pendekatan kualitatif berbasis studi pustaka, penelitian ini menganalisis teks-teks fikih klasik seperti al-Mughni, al-Majmu’, dan Bidayah al-Mujtahid, serta referensi kontemporer berupa jurnal, regulasi hukum positif, dan fatwa DSN-MUI. Temuan menunjukkan bahwa wasiat berfungsi tidak hanya sebagai pelengkap sistem faraidh, tetapi juga sebagai mekanisme untuk menjembatani kebutuhan sosial-keluarga yang tidak terakomodasi dalam hukum waris baku. Reinterpretasi terhadap ketentuan klasik melalui pendekatan maqāṣid al-syarīʿah diperlukan untuk menyesuaikan praktik wasiat dengan realitas sosial modern, seperti dalam kasus anak angkat dan keluarga jamak. Dengan demikian, wasiat dapat diperkuat sebagai sarana distribusi kekayaan yang adil, kontekstual, dan selaras dengan nilai-nilai keadilan Islam.

Abstract

This study examines the tradition of wearing Mispa among the Bugis community in Bulu-Bulu Village, Tonra District, following the performance of the Hajj, from the perspectives of Islamic law and the sociology of religious law. The study aims to explore the social, cultural, and religious foundations underlying the persistence of the Mispa tradition among female pilgrims, as well as to analyze the normative tension between customary practices and Islamic legal prescriptions regarding aurat (modesty requirements). This research employs a qualitative field research method using normative-juridical and empirical approaches, with data collected through observation, in-depth interviews, and documentation. The findings reveal that the tradition of wearing Mispa functions not merely as an item of clothing but as a symbol of honor (siri’), spiritual commitment, and a marker of social identity within Bugis society. The tradition also encompasses socio-economic and cultural dimensions through the involvement of local artisans and constitutes an integral part of post-Hajj cultural expression. However, from the perspective of Islamic law, the practice of wearing Mispa, particularly the use of transparent fabric, raises normative concerns, as it potentially contradicts Islamic prescriptions regarding the covering of aurat. These findings highlight the existence of a dynamic negotiation between customary law and Islamic law, underscoring the importance of cultural and contextual approaches in responding to local religious practices within the demands of Islamic normative frameworks.
