Abstract

The transformation of BUMN is an important part of national development that is oriented towards the welfare of the people. Perum Danareksa was appointed as the holding company in the financial sector through Government Regulation Number 113 of 2021. This transformation is strengthened by Law Number 1 of 2025 concerning SOEs which adopts the principleĀ  of business judgment rule. The Holding structure is expected to be able to create efficiency, synergy, and increase the competitiveness of state corporations. However, when viewed from the perspective of sharia business law, BUMN governance is not enough to only emphasize profits, but also must fulfill the principles of justice (al-'adl), trust, usefulness (maslahah), and avoid the practice of riba, gharar, and maysir. This research uses a normative juridical approach with a legal and conceptual approach. The results of the study show that Danareksa's holding model is legally positive and benefits the efficiency of state assets. However, part of the portfolio is still placed in conventional interest-bearing instruments, which in sharia it is considered problematic. This poses a challenge so that the management of state assets is in line with Islamic values that emphasize justice and benefits. By strengtheningĀ  the Sharia Governance framework, increasing transparency, and expanding sharia instruments such as sukuk and sharia mutual funds, Danareksa has the potential to become a model of BUMN governance that is not only modern, but also ethical and in accordance with Islamic principles.

Abstract

Flight delays remain a recurring issue that harms air transport consumers in both Indonesia and Malaysia. This study aims to comparatively analyze the consumer protection oversight mechanisms for flight delays in both countries in order to formulate an ideal supervisory model. The research employs a normative juridical method with statutory, conceptual, and comparative approaches, analyzed through Philipus M. Hadjon's theory of preventive legal protection and Lawrence M. Friedman's legal system theory. The findings show that oversight in Indonesia under PM 89/2015 remains administrative-reactive and involves multiple institutions (DJPU, BPKN, BPSK), while Malaysia's MACPC 2016 applies a more preventive and integrated continuous compliance monitoring system through MAVCOM/CAAM. The study recommends an ideal supervisory model for Indonesia that integrates administrative, operational, and continuous compliance oversight, supported by risk-based supervision and financial sanctions, to strengthen consumer rights protection preventively and sustainably.

Abstract

Usaha Mikro, Kecil, dan Menengah (UMKM) memegang peran penting dalam mendukung pertumbuhan ekonomi nasional. Namun, masih banyak pelaku UMKM yang belum memahami pentingnya perlindungan hukum terhadap merek yang digunakan dalam kegiatan usaha, sehingga berpotensi menimbulkan sengketa dan kerugian ekonomi. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan kesadaran dan pemahaman hukum pelaku UMKM mengenai pentingnya pendaftaran merek sebagai bentuk perlindungan hak kekayaan intelektual. Kegiatan dilaksanakan di Kelurahan Sendangadi, Kabupaten Sleman, dengan melibatkan 26 pelaku UMKM yang bergerak di bidang kerajinan tangan, olahan pangan, dan jasa berbasis komunitas. Metode yang digunakan meliputi penyuluhan hukum, diskusi interaktif, konsultasi, serta pendampingan pendaftaran merek melalui sistem elektronik Direktorat Jenderal Kekayaan Intelektual (DJKI). Evaluasi dilakukan menggunakan instrumen pre-test dan post-test yang terdiri atas 10 pertanyaan terkait fungsi merek, manfaat pendaftaran, prosedur pendaftaran, serta risiko hukum penggunaan merek yang tidak terdaftar. Hasil evaluasi menunjukkan adanya peningkatan rata-rata tingkat pemahaman peserta dari 41,2% sebelum kegiatan menjadi 84,6% setelah kegiatan. Selain itu, sebanyak 84,6% peserta mampu memahami prosedur pendaftaran merek secara mandiri dan 73,1% peserta menyatakan kesiapan untuk mengajukan pendaftaran merek atas usaha yang dimiliki. Temuan tersebut menunjukkan bahwa kegiatan penyuluhan dan pendampingan yang dilaksanakan efektif dalam meningkatkan literasi hukum, kesadaran hukum, serta kapasitas pelaku UMKM dalam memperoleh perlindungan hukum atas merek sebagai aset usaha yang memiliki nilai ekonomi dan daya saing.
