Abstract

The development of public service superapps in Indonesia, such as INA Digital and the Ministry of Law and Human Rights’ Super Apps, promises service efficiency through NIK-based SSO integration in accordance with Presidential Regulation No. 95/2018 on the SPBE. However, the management of large-scale data poses significant cybersecurity risks, including personal data breaches and ransomware attacks, which are regulated by the Personal Data Protection Act No. 27/2022 under the principle of ‘privacy by design’. This literature review analyses civil servants’ digital literacy as a crucial pillar, noting that only 44.9% of civil servants possess good competencies despite the Ministry of Communication and Information Technology’s LDSP programme reaching 80,000 participants. Findings indicate that synergy between data security (zero-trust architecture) and continuous civil servant training is necessary for digital trust and government transformation towards Indonesia Digital 2045.

Abstract

This article examines the optimisation of the role of law in the governance and supervision of State-Owned Enterprises (SOEs) as an effort to realise SOEs that are professional, efficient, and oriented towards the public interest. Through a literature review approach, the study analyses the legal framework governing SOEs, the implementation of Good Corporate Governance (GCG) principles, and the strengthening of legal oversight mechanisms by both internal and external bodies, including Commissioners/Supervisory Boards, the State Audit Agency, specialised supervisory bodies, the House of Representatives, and law enforcement agencies. The findings indicate that strengthening legal norms, harmonising regulations, enhancing the capacity of officials, and strengthening coordination among supervisory bodies are key to improving SOE governance and ensuring accountability in the management of state finances. Thus, optimising the role of the law serves not only as an instrument for preventing corruption and abuse of authority, but also as a foundation for SOEs to operate professionally, competitively, and in the public interest.

Abstract

Public administration in Indonesia faces a crucial challenge in maintaining a balance between the authority of civil servants and the protection of citizens’ rights through fair evidentiary mechanisms and effective dispute resolution, as stipulated in Law No. 5 of 1986 on Administrative Courts and Law No. 30 of 2014 on Government Administration. This article analyses the legal aspects of evidence under the principle of the reversed burden of proof, which requires civil servants to prove the validity of administrative acts through at least two valid forms of evidence (documents, witnesses, experts, admissions, and judicial knowledge), as well as the hierarchy of rights protection through preventive administrative measures, Ombudsman oversight, and remedial actions in the Administrative Court (PTUN) that guarantee the annulment of illegal decisions along with compensation for material and non-material damages. A normative legal approach using a statute approach and analysis of court rulings reveals key challenges such as unequal access to information, weak enforcement of rulings, and regulatory fragmentation that hinder good governance; consequently, recommendations include amending the Administrative Court Law to mandate digital evidence, strengthening enforcement sanctions, and digitising administrative processes to realise the rule of law and human rights-oriented bureaucratic accountability.
