Abstract

Although a marriage may be deemed valid under Islamic Sharia provided it fulfills the essential pillars (arkan) and conditions (shurut) (such as the presence of a guardian (wali) and witnesses) the practice of unregistered marriage (nikah siri) remains a profound socio-legal concern. This paper argues that while religiously legitimate, unregistered marriages often fail to serve as a sustainable solution for marital relationships. No religious framework inherently recommends bypassing legal registration. The absence of official documentation creates a significant legal vacuum, leading to detrimental consequences primarily for women and children regarding their civil rights and inheritance. This study emphasizes the urgency of preventing the normalization of unregistered marriages. It advocates for a deeper understanding of the "true meaning of marriage," which encompasses not only spiritual fulfillment but also legal certainty and social responsibility to ensure the welfare of the family unit.

Abstract

This study explores the integration of spirituality and faith values in the workplace to enhance productivity, psychological well-being, and the quality of interpersonal interactions among employees. The research background arises from the need for modern organizations to combine workplace spirituality with professionalism, enabling employees to have higher intrinsic motivation, stronger commitment, and greater job satisfaction. The study employs a literature review and conceptual analysis using an inductive approach, examining journals, scholarly articles, and books from the past five years. The findings indicate that the consistent application of spiritual practices, including spiritual leadership training, mindfulness, and faith-based employee development, significantly impacts work ethics, employee engagement, and organizational citizenship behavior. Integrating spirituality fosters an inclusive, harmonious, and productive work culture while enhancing psychological well-being and reducing stress. In conclusion, workplace spirituality is not merely a moral dimension but also an effective managerial strategy that supports performance, motivation, and the sustainable competitiveness of organizations.

Abstract

Penelitian ini bertujuan untuk mengkaji secara mendalam konsep akhlak dalam perspektif maqashid al-syariah serta menganalisis peran strategisnya dalam menjaga lima tujuan utama syariat (al-kulliyat al-khams). Penelitian ini menggunakan pendekatan kualitatif dengan metode studi pustaka, dengan menelaah literatur primer berupa Al-Muwafaqat fi Ushul al-Syariah karya Imam al-Syatibi dan Maqasid al-Shariah as Philosophy of Islamic Law: A Systems Approach karya Jasser Auda, serta didukung oleh literatur sekunder dari jurnal ilmiah dan buku akademik yang relevan. Hasil penelitian menunjukkan bahwa akhlak tidak hanya berfungsi sebagai nilai etika individual, tetapi juga sebagai mekanisme operasional dalam merealisasikan maqashid al-syariah. Secara lebih spesifik, akhlak berperan sebagai: (1) instrumen internalisasi nilai syariat yang mencegah formalisme hukum; (2) penggerak perlindungan lima aspek maqashid melalui nilai konkret seperti kejujuran dalam menjaga harta (hifz al-mal), empati dalam menjaga jiwa (hifz al-nafs), dan tanggung jawab dalam menjaga keturunan (hifz al-nasl); serta (3) mediator antara teks hukum dan realitas sosial dalam menghadapi tantangan globalisasi dan era digital. Temuan ini menegaskan bahwa integrasi akhlak merupakan prasyarat utama agar maqashid al-syariah dapat berfungsi secara substantif, kontekstual, dan transformatif dalam kehidupan modern.

Abstract

This research examines the strategic role of women within Indonesia’s halal economy, focusing on their contributions, structural challenges, and developmental opportunities in the digital era. Women have proven to be key actors in strengthening halal MSMEs (Micro, Small, and Medium Enterprises), particularly in the food, Muslim fashion, and cosmetics sectors, contributing significantly to family economic resilience and national economic growth. Using a qualitative-descriptive approach based on secondary data analysis, this study explores the dynamics of women’s contributions within the halal value chain as well as the obstacles they face. These include limited access to Sharia financing, uneven digital literacy, the complexity of halal certification, and socio-cultural barriers that restrict women’s participation in productive economic activities. The thematic analysis indicates that digitalization opens vast opportunities for women to expand their market reach through e-commerce and Sharia-based marketplaces, while the global trend of the halal lifestyle offers expansion opportunities at the international level. This research also highlights the importance of government policy support through the simplification of halal certification, improved access to Sharia financing, and community-based empowerment programs. Theoretically, these findings affirm that women act not only as economic players but also as moral agents who maintain the integrity of Sharia values in production and marketing. The implications of this research emphasize the urgency of multi-stakeholder synergy to create a halal ecosystem that is inclusive, responsive, and sustainable. Consequently, women's empowerment is a strategic element in strengthening the competitiveness of the national halal industry and achieving sustainable economic development based on Sharia values.
