Abstract

This study aims to analyse the digital transformation of fiqh education on labour for Indonesian migrant workers (PMI) in the United Arab Emirates from a transnational perspective, focusing on how Islamic legal literacy can be an instrument of empowerment and protection of workers' rights. This study uses a socio-legal approach that combines normative fiqh studies with the socio-legal reality in the field. Data was collected through in-depth interviews, observation, and documentation. Data analysis was carried out in stages of data reduction, data presentation, and conclusion drawing. The results of the study show that there is a significant gap between normative knowledge of fiqh labour and the reality experienced by PMI in the UAE. The transformation of digital-based fiqh education can be used as a solution to this gap, as it can expand access to legal literacy, strengthen awareness of transformative maqāṣid, and provide practical skills in negotiating rights. The digitisation of fiqh education on labour issues not only functions as a medium of education but also as a transnational advocacy strategy that strengthens the protection and empowerment of PMI in a global context. This research contributes empirically to overcoming barriers to the implementation of migrant workers' rights in the UAE and recommends a maqāṣid transformative-based digital fiqh education module and strategic policy measures to strengthen the protection of migrant workers' rights.

Abstract

Abstrak This study aims to analyze theological studies and regulations regarding the use of artificial intelligence (AI) in Islamic education. There has been a rapid change in digitalization and a lack of regulation. The use of AI in Islamic education presents challenges, including the moral interaction between students and technology. This research uses a qualitative approach with a literature study method, and the data analysis technique is carried out using descriptive-analytical techniques, namely by critically reviewing the content of the literature to identify patterns of thought and comparing the concepts of theological studies with regulations on the use of artificial intelligence in Islamic education. The results of the study indicate that artificial intelligence can enhance personalized learning, administrative efficiency, and facilitate access to religious resources; however, it also raises theological issues regarding the validity of interpretations generated by algorithms, as well as the need for supervision by scholars in the chain of knowledge. Meanwhile, from the regulatory concept, there appears to be ambiguity in the existing norms; current regulations and circular letters from the ministry only provide limited protection and there are no specific rules for AI in the context of religious education. AI can be used as a tool to support the roles of clerics and teachers, not to replace them, and to provide suggestions. It is recommended that specific regulations, transparency in algorithms, data protection measures, and oversight by teachers be implemented. Kata Kunci : Kecerdasan Buatan, Pendidikan Islam, Regulasi

Abstract

The rapid development of e-commerce has accelerated the circulation of products claiming halal certification. It has also shifted halal product distribution patterns to the digital realm. This shift raises issues related to verification and protection of consumer rights. Blockchain-based electronic evidence in the context of halal certification has become a fundamental issue for muslim consumer protection in the digital era. There are incomplete regulations governing the status and mechanisms for verifying blockchain evidence. These gaps pose challenges in providing evidence in court and create legal uncertainty for consumers. This study aims to analyze the validity of blockchain-based halal certificates as a legal evidentiary tool in consumer protection disputes. The goal is to strengthen muslim consumer protection in Indonesia. This study is a normative legal study using statutory and conceptual approach. The legal materials were obtained from primary and secondary sources by examining the Halal Product Guarantee Law, the Consumer Protection Law, and regulations related to electronic information. The analysis was conducted through systematic interpretation and literature review. The research results show that blockchain-based halal certificates have potential probative validity due to their transparency and decentralization. This can increase the transparency and authenticity of halal products. However, in practice, there are still no technical guidelines regarding the blockchain-based halal certificate verification mechanism. Therefore, comprehensive special regulations are needed from the government, particularly technical guidelines for blockchain-based halal certification, to ensure consumer protection in the digital era. their transparent and decentralized nature, which can enhance the transparency and authenticity of halal products.

Abstract

The dynamics of environmental governance in the perspective of theoretical contemporization indicate the need to reconstruct the paradigm of Indonesian environmental law from an anthropocentric-instrumental approach to an ecocentric-teleological one, integrated within the framework of maqashid sharia. The anthropocentric paradigm that dominates Indonesia's environmental regulations has proven incapable of preventing ecological degradation because it treats nature merely as an instrumental object for human interests. Through normative research methods with a juridical-normative and philosophical approach, this paper offers a paradigmatic reconstruction through three pathways: (1) the adoption of ecocentrism as the ethical-philosophical basis of environmental law; (2) the integration of hifz al-bi'ah (environmental preservation) as a component of dharuriyyat within the maqashid sharia framework; and (3) the development of a progressive environmental law discovery (rechtsvinding) methodology based on the principle of in dubio pro natura. This article concludes that the convergence between ecocentrism and the maqashid of Sharia can provide a solid ethical-teleological foundation for reconstructing Indonesian environmental law with ecological justice.
