Abstract

Internet dapat dianggap sebagai sumber informasi yang sangat besar yang dapat membantu dalam melakukan interaksi dan komunikasi. Penggunaan internet tidak terbatas pada pemanfaatan informasi, tetapi juga menciptakan jenis-jenis dan peluang bisnis yang baru dengan transaksi bisnis yang dilakukan secara elektronik. Unsur penting yang harus dipenuhi dalam bisnis online dengan bisnis offline yaitu pada proses transaksi (akad) dan media utama. Bentuk perjanjian jual beli yang dilakukan dengan menggunakan media internet tidak jauh berbeda dengan proses jual beli biasa. Transaksi online dibolehkan menurut Islam berdasarkan prinsip-prinsip yang ada dalam perdagangan menurut Islam, kecuali pada barang/jasa yang tidak boleh untuk diperdagangkan sesuai syariat Islam. Hukum dasar bisnis online sama seperti akad jual beli. Kedudukan hukum terhadap keabsahan akad transaksi jual-beli (perikatan atau al-‘aqdu) terdapat rukun dan syarat yang harus dipenuhi. Tidak ada ketentuan transaksi harus berbentuk tulisan, dengan ijab-qabul (serah-terima) melalui perkataan pun cukup mewakili untuk dikatakan suatu transaksi

Abstract

The 1945 Constitution (UUD) Article 33 paragraph (3) states, "The land and water and natural resources contained therein are controlled by the State and used for the greatest prosperity of the people. This writing uses normative juridical legal research methods (normative research). with a descriptive analytical research specification using secondary data. The data collection procedure is in the form of documentation of notes or quotations, tracing legal literature, books and others related to problem identification. The focus of the problem is how the provisions of Lex Fisheries Crime Handling Specialist in Indonesia? And how is the implementation of fisheries criminal law enforcement based on lex specialist provisions in Indonesia? Whereas the legal arrangements regarding evidence in criminal fisheries are regulated in Part Two A in Article 76 A, Article 76 B and Article 76 C of Law Number 45 of 2009 Tanteng Amendment to Law Number 31 of 2004 concerning Fisheries. Based on the sound of Article 76 A of Law Number 45 of 2009 Tanteng Amendment to Law Number 31 of 2004 concerning Fisheries, there are only two options for the choice of provisions regarding evidence in fisheries crime, the first is confiscated for the State or destroyed, based on this. , there is no provision for the return of evidence in a fishery crime against the perpetrator or his family. The system of criminal law enforcement in fisheries crime is included in specific provisions with provisions in specific laws. Not only on the provision that Fisheries Crime is regulated in a special law, because of the vast area of the Indonesian Sea, the government has given authority to various state institutions that oversee Indonesia's maritime sovereignty ranging from domestic threats to threats that come from within the country in particular. in fisheries crime, among others Polair, TNI-AL dan PPNS.

Abstract

Gadai adalah penyerahan barang bergerak sebagai jaminan kepada pegadaian, yang senilai dengan atau lebih tinggi dari jumlah pinjaman. Apabila pada waktu yang telah ditentukan (jatuh tempo) barang jaminan dapat dijual lelang guna menutup pengembalian pinjaman, dan jika masih ada nilai sisanya akan dikembalikan kepada peminjam. Lelang merupakan penjualan barang jaminan yang terbuka untuk umum dengan penawaran harga secara tertulis dan/atau lisan yang semakin meningkat atau menurun untuk mencapai harga tertinggi yang didahului pengumuman lelang. Sebelum dilakukan pelelangan pihak kreditur wajib melakukan somasi/peringatan terlebih dahulu kepada pihak nasabah somasi diatur pada Pasal 1238 KUHPerdata dan Pasal 1243 KUHPerdata. Namun pada kenyataan pihak kreditur tidak melakukan peringatan terhadap nasabah atas pelelangan objek jaminan gadai emas milik nasabah. bahwa perbuatan yang dilakukan pihak kreditur atas pelelangan pada dasarnya harus memenuhi syarat yang telah ditentukan salah satunya harus memberikan peringatan terhadap nasabah, perlindungan hukum yang diberikan pegadaian selama ini baik terhadap objek maupun nasabah dalam hal pelelangan tanpa adanya peringatan ini masih jauh dari sempurna

Abstract

Requests for suspension of detention can be granted with conditions that must be met. The requirements that must be met by the applicant for detention suspension are 2 (two) conditions, namely subjective conditions and objective conditions. The subjective condition referred to is the existence of subjective judgments made by the investigator or public prosecutor or judge to assess the reason for the applicant's suspension of detention granted or rejected. Whereas the objective requirement is that there is a guarantee in accordance with Article 31 of the Criminal Procedure Code which states that an authorized official at the examiner's level can suspend detention. This writing uses normative juridical legal research methods (normative research) with descriptive analytical research specifications that use secondary data. The procedure of data collection is in the form of documentation of notes or quotations, search of legal literature, books and others related to the identification of problems both offline and online, which are then analyzed through the content analysis method (centent analysis method) with a focus on the problem of how objective conditions are and the subjectivity of detention suspension in the Criminal Procedure Code (KUHAP) in Indonesia. From the results of the study it is known that the objective and subjective conditions of suspension of detention in Indonesia are suspects must fulfill the conditions specified in the explanation of Article 31 of the Criminal Procedure Code (KUHAP), which is the requirement for reporting, not leaving the house and / or not leaving town the terms of subjectivity include consideration of institutional officials asking for money guarantees and / or guarantees of people. Consideration of objectivity, namely the suspect is not worried about escaping, damaging or removing evidence and will repeat the action. Consideration of subjectivity, namely the suspect is willing to sign and fulfill the terms of detention suspension

Abstract

Wabah Covid-19 yang menyebar di penjuru Tanah Air telah memberikan pembelajaran tersendiri bagi sistem peradilan di Indonesia. Untuk itu persidangan online merupakan terobosan positif sebagai solusi di tengah perkembangan teknologi informasi. Metode penelitian yang digunakan pada Penelitian ini merupakan penelitian Yuridis Empiris (Field Research). Penelitian ini akan dilakukan dengan pendekatan Empiris didukung dengan data normative dan diperkaya dengan pendekatan sosiologis dengan harapan mendapatkan gambaran yang comprehensive. Undang-Undnag No. 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana (KUHAP) belum mengatur terkait dengan persidangan melalui elektronik. Terkait dengan penyelenggaraan Peradilan Pidana, Mahkamah Agung (MA) membentuk Perma tentang Administrasi dan Persidangan Perkara Pidana Secara Elektronik di Pengadilan, yaitu Peraturan Mahkamah Agung No. 4 Tahun 2020 tentang Administrasi dan Persidangan Perkara Pidana di Pengadilan Secara Elektronik (Perma Sidang Pidana Online) selanjutnya di dalam SEMA No. 1 Tahun 2020, seluruh pimpinan, hakim, dan aparatur peradilan pada MA dan badan peradilan di bawahnya diminta untuk melakukan penyesuaian sistem kerja dengan berpedoman pada Surat Edaran Menteri Pendayagunaan Aparatur Negara dan Reformasi Birokrasi No. 19 Tahun 2020 tentang Penyesuaian Sistem Kerja Aparatur Sipil Negara Dalam Upaya Pencegahan Penyebaran Covid-19 di lingkungan instansi pemerintah. Abstract

Through communication, there is a process of conveying ideas or ideas verbally or verbally writing so that create something understanding. This study aims to determine the effect of the Problem Based Learning learning model on mathematical communication skills and student learning outcomes in economics mathematics courses. The subjects in this study were third semester students at the Indonesian Community Development University. This study uses quantitative research, namely experiments. The results of the research that has been done show that the use of the model learning Problem based Learning influential to results Study economic mathematics and mathematical communication skills third semester students at Pembinaan Indonesia University. This is indicated by sig price . (2-tailed) is smaller than the alpha price, which is 0.000 (0.000 < 0.05) which means that there is a significant difference between the difference in pre-test scores with post-test on groups control and experimental group.

Abstract

: Consumption of packaged sweetened beverages (PSBs) among Indonesian children shows an alarming trend and contributes to the increase in cases of childhood obesity and diabetes. National data shows that nearly 20% of children aged 5–12 years are overweight or obese, while the prevalence of type 1 diabetes in children has also increased significantly in the last decade. This study aims to analyze the implementation of legal protection for children as vulnerable consumers of MBDK in elementary schools, with a case study at SD Muhammadiyah 13 in Medan City. The research method used a qualitative approach through in-depth interviews with 18 informants (principals, teachers, canteen managers, parents, and students) and a study of related documents. The results of the study show a gap between legal norms and field practices: although the Consumer Protection Law, Health Law, and Child Protection Law provide a strong normative basis, at the school level there are no internal regulations limiting the distribution of MBDK. Canteen economic factors, low nutritional literacy, and strong industry promotion weaken implementation. These findings confirm that legal protection has not been effectively implemented at the micro-school level. This study recommends an applicable protection model through binding technical regulations, economic incentives for canteens, integration of nutrition literacy into the curriculum, and multi-stakeholder supervision. Theoretically, this study enriches the discourse on consumer protection law by placing children as vulnerable legal subjects; practically, the results of this study can be used as a basis for formulating technical policies at the school and local government levels to reduce health risks due to MBDK consumption.

Abstract

Consumer disputes in motor vehicle financing often occur between consumers and business actors, especially regarding default, withdrawal of financing objects, and the application of standard clauses that are detrimental to consumers. To provide fast, simple, and low-cost dispute resolution, Law Number 8 of 1999 concerning Consumer Protection established the Consumer Dispute Resolution Agency (BPSK) as an out-of-court dispute resolution institution, but there is still a legal remedy for objections to the District Court which has the potential to raise legal certainty issues. This research is a normative legal research with a statutory approach and a case approach that aims to analyze the authority of BPSK, the mechanism for examining objections to BPSK decisions at the Medan District Court, and the form of legal protection for consumers and business actors.The research findings indicate that objections to BPSK decisions represent a form of judicial oversight by the District Court over the BPSK's authority and procedures. However, in practice, objection hearings often focus not only on legality and procedural aspects but also on reopening the underlying dispute, leading to inconsistent decisions and reducing legal certainty. Furthermore, the absolute boundaries of authority between the BPSK and the District Court in handling motor vehicle financing disputes remain unclear.

Abstract

The environment is crucial for human survival and therefore must be protected and managed sustainably. However, in practice, illegal gold mining activities often cause serious environmental damage. Mandailing Natal Regency is one of the regions with significant gold potential, but many mining activities are carried out without permits and without due regard for environmental aspects. These activities cause various impacts, such as river pollution, forest destruction, and landscape changes. Based on these conditions, this study formulates the problem of environmental damage caused by illegal gold mining, criminal law enforcement against perpetrators, and obstacles faced in the law enforcement process.This study employs an empirical legal research approach with a descriptive analytical approach. Data were obtained through fieldwork and literature review. Data collection was conducted through interviews with relevant parties and a review of primary, secondary, and tertiary legal materials, which were then analyzed qualitatively using a deductive approach.            The research results show that illegal gold mining activities in Mandailing Natal Regency have caused various forms of environmental damage, both physical and chemical. This damage includes changes in the landscape due to land clearing, the formation of former mining pits, erosion and landslides around rivers, and water pollution due to the use of hazardous chemicals such as mercury. Furthermore, mining activities also damage forest areas and disrupt the balance of the ecosystem. Criminal law enforcement against perpetrators of illegal gold mining has essentially been carried out by law enforcement officials through preventive and repressive efforts. However, in practice, law enforcement still faces various obstacles, such as limited apparatus resources, weak oversight, and socio-economic factors of communities that depend on mining activities for their livelihoods.

Abstract

The effectiveness of life insurance claim dispute resolution procedures through the Consumer Dispute Resolution Agency (hereinafter abbreviated as BPSK) is an important aspect in efforts to protect insurance service consumers legally. Life insurance claim disputes often arise due to claim rejection by insurance companies, differences in interpretation of policy content, and default in the implementation of insurance agreements. This study, BPSK plays a role as a non-litigation institution that provides alternative dispute resolution that is faster, simpler, and less expensive than court channels, however, the effectiveness of the implementation of dispute resolution procedures through BPSK remains a problem, due to resource constraints or a lack of public understanding of the functions and authorities of BPSK, limited competent human resources in the insurance sector, overlapping authorities with other institutions such as the OJK and the courts, and weak implementation of BPSK decisions in the field.The research method used is a normative juridical approach by examining applicable laws and regulations, legal doctrine, and relevant literature related to consumer protection and insurance law. This research is descriptive-analytical, with data collection through a literature study focusing on the provisions of Law Number 8 of 1999 concerning Consumer Protection, Law Number 40 of 2014 concerning Insurance, and other implementing regulations. The research analysis focuses on the extent to which dispute resolution procedures at the BPSK are able to guarantee effective legal protection for consumers, particularly in life insurance claim disputes.The research results show that the BPSK plays a strategic role in resolving life insurance claim disputes, but its effectiveness is not optimal. The main obstacles include limited competent human resources in the insurance sector, low public understanding of the BPSK's functions and authorities, overlapping authority with other institutions, and weak implementation of BPSK decisions. Efforts to increase the effectiveness of dispute resolution require strengthening the BPSK institution, improving coordination between institutions, increasing insurance company compliance, and enhancing consumer literacy so that legal protection can be more optimally realized.
