<![CDATA[Abstract: A worker who is bound by a work agreement is often ordered to create a creative work by the company. Issues arising from the creation of a copyrighted work in an employment relationship often raise questions regarding who is the party who has the right to be the creator and copyright holder. The core problem in this research is how the legal protection for companies as copyright holders of March song creations created by companies and workers who are bound by an employment relationship is based on Decision Number 279 K/Pdt.Sus-HKI/2020. This research uses a type of normative juridical legal research. In this thesis, the researcher analyzes using statutory regulations, especially Law Number 28 of 2014 concerning Copyright. Legal protection for the company as the copyright holder for the March song creation created by the company and workers who are bound by an employment relationship based on Decision Number 279 K/Pdt.Sus-HKI/2020 has been fulfilled as in the facts of the trial it was proven that it belonged to the company PT STA as copyright holder. In this case, the company is covered by the provisions of recovery theory, which essentially states that inventors/creators/designers who have spent time, money and energy to produce their intellectual work must get back what they have spentKeyword: Copyright, Mars Song, Company Abstrak: Seorang Pekerja yang terikat dalam suatu perjanjian kerja, kerap kali diperintahkan untuk membuat suatu Karya Cipta Oleh Perusahaan. Persoalan yang timbul atas pembuatan suatu Karya Cipta dalam hubungan kerja kerap kali menimbulkan pertanyaan mengenai siapa pihak yang berhak sebagai Pencipta dan Pemegang Hak Cipta. Inti permasalahan dalam penelitian ini adalah bagaimana pelindungan hukum terhadap perusahaan sebagai pemegang hak cipta atas karya cipta lagu mars yang dibuat oleh perusahaan dan pekerja yang terikat dalam hubungan kerja berdasarkan pada Putusan Nomor 279 K/Pdt.Sus-HKI/2020. Penelitian ini menggunakan jenis penelitian hukum yuridis normatif. Pada tesis ini, peneliti menganalisis menggunakan peraturan perundang-undangan khususnya Undang-Undang Nomor 28 Tahun 2014 tentan Hak Cipta. Pelindungan hukum terhadap perusahaan sebagai pemegang hak cipta atas karya cipta lagu mars yang dibuat oleh perusahaan dan pekerja yang terikat dalam hubungan kerja berdasarkan pada Putusan Nomor 279 K/Pdt.Sus-HKI/2020 telah terpenuhi sebagaimana dalam fakta persidangan terbukti merupakan milik perusahaan PT STA selaku pemegang hak cipta. Perusahaan dalam hal ini telah tercakup dalam ketentuan recovery theory yang pada intinya bahwa penemu/pencipta/pendesain yang telah mengeluarkan waktu, biaya, serta tenaga untuk menghasilkan karya intelektualnya harus memperoleh kembali apa yang telah dikeluarkannya.
