Abstract

ABSTRAKFenomena pelaku usaha yang menjual produk handphone tanpa memberikan informasi yang lengkap, jelas serta benar mengenai barang yang dijual pada akhirnya merugikan konsumen. Sehingga penelitian ini bertujuan untuk menganalisis bagaimana bentuk perlindungan hukum terhadap konsumen produk handphone bergaransi menurut hukum positif di Indonesia dan bagaimana pelaksanaan garansi handphone oleh pelaku usaha terhadap konsumen di Kota Mataram. Memberi kritikan serta saran tentang fenomena yang dihadapi oleh pembeli dalam menggunakan produk handphone bergaransi yang di jual-belikan perusahaan-perusahaan nantinya. Metode penelitian yang digunakan adalah penulisan normatif empiris. Pemberian garansi handphone di kota Mataram diberikan oleh pelaku usaha kepada konsumen dengan mengacu kepada Peraturan Perundang-undangan. Bahwa untuk melindungi hak-hak konsumen, pemerintah melalui berbagai Peraturan Perundang-undangan mewajibkan pelaku usaha untuk menyediakan layanan purna jual selama 1 tahun, kedua pelaksaan garansi oleh pelaku usaha di Kota Mataram telah berjalan cukup baik. Abstract. The phenomenon of business actors selling mobile phone products without providing complete, clear, and accurate information about the goods ultimately harms consumers. Therefore, this study aims to analyze the forms of legal protection for consumers of guaranteed mobile phone products according to positive law in Indonesia and how the implementation of mobile phone warranties by business actors is carried out for consumers in Mataram City. It provides critiques and suggestions regarding the challenges faced by buyers in using guaranteed mobile phone products sold by companies. The research method employed is normative-empirical writing. In Mataram City, mobile phone warranties are provided by business actors to consumers in accordance with applicable laws and regulations. To protect consumer rights, the government mandates through various regulations that business actors must provide after-sales service for one year. Furthermore, the implementation of warranties by business actors in Mataram City has been functioning quite well.
