Abstract

Abstrak. Penelitian ini bertujuan untuk mengevaluasi kesesuaian antara Kebijakan Upah Minimum Tahun 2025 di Provinsi Nusa Tenggara Barat dengan kebutuhan hidup riil para pekerja, serta implementasinya oleh perusahaan-perusahaan di Kota Mataram. Permasalahan utama yang dikaji adalah adanya kesenjangan antara ketentuan upah minimum yang ditetapkan secara hukum dengan praktik pelaksanaannya di lapangan, khususnya bagi pekerja pada posisi terbawah. Penelitian ini menggunakan metode empiris dengan mengumpulkan data primer dari pekerja seperti petugas keamanan dan petugas kebersihan, serta data sekunder berupa peraturan perundang-undangan dan literatur hukum. Hasil penelitian menunjukkan bahwa meskipun secara nominal upah minimum tahun 2025 mengalami kenaikan sebesar 6,5% dan melebihi ambang batas kebutuhan hidup minimum individu secara nasional, pelaksanaannya masih jauh dari harapan. Banyak perusahaan yang belum mematuhi ketentuan tersebut, sehingga pekerja menerima upah di bawah standar dan berada dalam posisi yang rentan, terutama mereka yang bekerja secara kontrak atau informal. Rasa takut kehilangan pekerjaan juga membuat pekerja enggan melaporkan pelanggaran yang terjadi. Penelitian ini menyimpulkan bahwa meskipun kebijakan upah minimum telah disusun secara normatif, namun belum mampu menjamin kesejahteraan pekerja secara substantif. Oleh karena itu, diperlukan pengawasan pemerintah yang lebih kuat serta mekanisme audit yang proaktif untuk menutup kesenjangan antara kebijakan dan praktik, serta menegakkan hak-hak tenaga kerja secara nyata. Abstract. This study aims to evaluate the suitability of the Minimum Wage Policy for 2025 in West Nusa Tenggara Province with the real living needs of workers, as well as its implementation by companies in Mataram City. The main problem studied is the gap between the minimum wage provisions stipulated by law and the implementation practices in the field, especially for workers in the lowest positions. This research uses an empirical method by collecting primary data from workers such as security officers and janitors, as well as secondary data in the form of laws and regulations and legal literature. The results show that although nominally the minimum wage in 2025 has increased by 6.5% and exceeds the threshold of the national minimum living needs of individuals, its implementation is still far from expectations. Many companies have not complied with the provisions, leaving workers receiving substandard wages and in a vulnerable position, especially those who work on a contractual or informal basis. Fear of losing their jobs also makes workers reluctant to report violations. This study concludes that although the minimum wage policy has been formulated normatively, it has not been able to guarantee workers' welfare substantively. Therefore, stronger government oversight and proactive auditing mechanisms are needed to close the gap between policy and practice, and enforce labor rights in real terms.
