Abstract

AbstrakSalah satu hak Dosen Tetap Bukan PNS pada Perguruan Tinggi yaitu memperoleh tunjangan profesi atau sertifikasi dosen. Belum terpenuhinya hak tersebut merupakan suatu perbuatan yang bertentangan dengan kepentingan hukum. Permasalahan penelitian ini adalah: bagaimana implementasi tentang hak dan kewajiban Dosen Tetap Bukan PNS berdasarkan Pasal 8 Peraturan Menteri Agama nomor 3 Tahun 2016 serta apakah faktor penghambat implementasi tentang hak dan kewajiban Dosen Tetap Bukan PNS berdasarkan Pasal 8 Peraturan Menteri Agama nomor 3 Tahun 2016. Metode penelitian secara yuridis normatif dan empiris, menggunakan data sekunder dan primer, yang diperoleh dari studi kepustakaan dan studi lapangan, dan analisis data dengan analisis yuridis kualitatif. Hasil penelitian membahas implementasi hak dan kewajiban dosen tetap bukan PNS berdasarkan Pasal 8 Peraturan Menteri Agama nomor 3 Tahun 2016 sudah dilaksanakan tetapi belum dilaksanakan secara maksimal dikarenakan terdapat salah satu hak Dosen Tetap Bukan PNS tidak tepenuhi, yaitu pemberian tunjangan profesi atau serdos. Ada 6 (enam) faktor penghambat dari implementasi Pasal 8 Peraturan Menteri Agama nomor 3 Tahun 2016, yaitu anggaran, SK Inpassing, belum tersedianya kuota bagi Dosen Tetap Bukan PNS untuk mengikuti sertifikasi dosen hingga saat ini, tidak adan aturan yang tegas mengenai sanksi atau lainnya yang mengharuskan (memaksa) agar pemberian hak Dosen Tetap Bukan PNS yaitu tunjangan profesi atau serdos, status kepegawaian bagi Dosen Tetap Bukan PNS di Perguruan Tinggi Negeri, dan kebijakan atau kewenagan pimpinan. Saran yang dapat diberikan antara lain kepada Pimpinan UIN Raden Intan Lampung beserta jajarannya hendaknya perlu diperhatikan mengenai kesejahteraan bagi Dosen Tetap Bukan PNS. Kepada Biro Kepegawaian diharapkan akan ada pengaturan mengenai pemberian tunjangan profesi bagi dosen tetap Bukan PNS. Kepada Kepala Bagian Kepegawaian diharapkan Dosen Tetap Bukan PNS bisa diikutsertakan atau bahkan menjadi “prioritas” untuk mengikuti seleksi PNS atau PPPK, sehingga status mereka pada Perguruan Tinggi Negeri lebih jelas dan bisa mendapatkan hak-haknya yang sesuai.Kata Kunci: Implementasi, Hak dan Kewajiban, Dosen Tetap Bukan PNS UIN Raden Intan Lampung AbstractOne of the rights of Permanent Lecturers Not Civil Servants in Universities is to obtain professional allowances or lecturer certification. The non-fulfillment of this right is an act that is contrary to the interests of the law. The problem of this research is: how to implement the rights and obligations of Non-Civil Servant Permanent Lecturers based on Article 8 of the Minister of Religious Affairs Regulation number 3 of 2016 and whether the inhibiting factors for the implementation of the rights and obligations of Non-Civil Servant Permanent Lecturers based on Article 8 of the Minister of Religious Affairs Regulation number 3 of 2016. Research methods are juridically normative and empirical, using secondary and primary data, obtained from literature studies and field studies, and data analysis with qualitative juridical analysis. The results of the study discussed the implementation of the rights and obligations of permanent lecturers who are not civil servants based on Article 8 of the Minister of Religious Affairs Regulation number 3 of 2016 has been implemented but has not been implemented optimally because there is one of the rights of Non-Civil Servant Permanent Lecturers is not fulfilled, namely the provision of professional allowances or serdos. There are 6 (six) inhibiting factors from the implementation of Article 8 of the Minister of Religious Affairs Regulation number 3 of 2016, namely the budget, the Inpassing Decree, the unavailability of quotas for Non-Civil Servant Permanent Lecturers to follow lecturer certification until now, there are no strict rules regarding sanctions or others that require (forcing) the granting of the rights of Permanent Lecturers Not Civil Servants, namely professional allowances or serdos,  employment status for Permanent Lecturers Not Civil Servants in State Universities, and the policy or authority of the leadership. Suggestions that can be given, among others, to the Head of UIN Raden Intan Lampung and his staff should need to be considered regarding welfare for Permanent Lecturers Not Civil Servants. To the Bureau of Personnel, it is hoped that there will be arrangements regarding the provision of professional allowances for permanent lecturers Not civil servants. To the Head of the Civil Service Section, it is hoped that Permanent Lecturers Not Civil Servants can be included or even become a "priority" to take part in the selection of civil servants or PPPK, so that their status at State Universities is clearer and can get their rights accordingly.Keywords: Implementation, Rights and Obligations, Permanent Lecturers Are Not Civil Servants UIN Raden Intan Lampung
