Abstract

Penulisan ini bertujuan untuk menganalisis implementasi prinsip the best interests of the child dalam perlindungan hukum terhadap anak di ruang siber berdasarkan Konvensi Hak Anak 1989. Prinsip tersebut merupakan prinsip fundamental dalam hukum internasional yang menegaskan bahwa setiap tindakan yang berkaitan dengan anak, baik oleh negara, lembaga publik, maupun institusi lainnya, harus mengutamakan kepentingan terbaik anak. Penulisan ini menggunakan pendekatan normatif dengan mengkaji instrument hukum internasional, khususnya Konvensi Hak Anak 1989, serta peraturan perundang-undangan yang berkaiatan dengan perlindungan anak di ruang siber. Fokus kajian dalam penulisan ini adalah: Pertama, Pengaturan prinsip The Best Interest of the Child dalam Konvensi Hak Anak 1989 sebagai dasar perlindungan hukum terhadap anak di ruang siber; Kedua, Implementasi prinsip tersebut dalam kebijakan serta pengaturan hukum nasional di Indonesia. Hasil pembahasan menunjukkan bahwa Konvensi Hak Anak 1989 telah menyediakan kerangka hukum yang komprehensif terkait pemenuhan ahak anak, termasuk perlindungan dari risiko eksploitasi digital. Oleh karena itu, diperlukan penguatan pengaturan hukum nasional dan integrasi yang konsisten terhadap prinsip the best interests of the child dalam seluruh pengaturan perlindungan anak di ruang siber agar bisa harmonis dengan standar internasional serta mampu menjawab kompleksitas ancaman digitak yang terus berkembang. Abstract: This paper aims to analyze the implementation of the principle of the best interests of the child in the legal protection of children in cyberspace under the 1989 Convention on the Rights of the Child. This principle constitutes a fundamental principle of international law, emphasizing that every action concerning children, whether undertaken by the state, public bodies, or other institutions, must prioritize the best interests of the child. This study employs a normative legal approach by examining international legal instruments, particularly the 1989 Convention on the Rights of the Child, as well as national laws and regulations concerning the protection of children in cyberspace. The study focuses on two main issues: first, the regulation of the principle of the best interests of the child under the 1989 Convention on the Rights of the Child as the legal basis for protecting children in cyberspace; and second, the implementation of this principle in Indonesia’s national policies and legal framework. The findings indicate that the 1989 Convention on the Rights of the Child provides a comprehensive legal framework for the fulfillment of children’s rights, including protection against the risks of digital exploitation. Therefore, it is necessary to strengthen national legal regulations and consistently integrate the principle of the best interests of the child into all legal frameworks concerning child protection in cyberspace in order to ensure harmonization with international standards and to effectively address the increasingly complex and evolving threats in the digital environment.
