Penerapan Restorative Justice terhadap Anak Pelaku Pencurian di Kota Bima

Abstract

This study aims to juridically analyze the implementation of restorative justice for juveniles as perpetrators of theft crimes in Bima City. The background of this research is grounded in the continued dominance of retributive approaches within the juvenile criminal justice system, which may adversely affect children’s development and contradict the principles of child protection and the best interests of the child as mandated by Law Number 11 of 2012 on the Juvenile Criminal Justice System. The urgency of this study lies in the need to evaluate the effectiveness and consistency of restorative justice implementation by law enforcement authorities, particularly in handling juvenile theft cases at the investigation stage. This research employs a normative legal research method using statutory, conceptual, and case study approaches, supported by an analysis of legislation, legal doctrines, and the practical application of restorative justice in Bima City. The novelty of this research lies in its comprehensive examination of the conformity between restorative justice practices and positive legal norms as well as substantive justice values within the local context of Bima City. The findings indicate that restorative justice has been applied to juvenile theft cases in Bima City; however, its implementation remains suboptimal due to structural, cultural, and procedural constraints. Therefore, strengthening the understanding of law enforcement officers and harmonizing policies are necessary to ensure the protection of children’s rights and the sustainable realization of restorative justice.. Penelitian ini bertujuan untuk menganalisis secara yuridis penerapan restorative justice terhadap anak sebagai pelaku tindak pidana pencurian di Kota Bima. Latar belakang penelitian ini didasarkan pada masih dominannya pendekatan retributif dalam sistem peradilan pidana anak, yang berpotensi menimbulkan dampak negatif terhadap tumbuh kembang anak serta bertentangan dengan prinsip perlindungan anak dan kepentingan terbaik bagi anak sebagaimana diamanatkan dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Urgensi penulisan tesis ini terletak pada kebutuhan untuk mengevaluasi efektivitas dan konsistensi penerapan restorative justice oleh aparat penegak hukum, khususnya dalam konteks penanganan perkara pencurian yang melibatkan anak di tingkat penyidikan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan studi kasus, yang didukung oleh analisis terhadap peraturan perundang-undangan, doktrin hukum, serta praktik penerapan restorative justice di Kota Bima. Kebaruan penelitian ini terletak pada analisis komprehensif mengenai kesesuaian praktik restorative justice dengan norma hukum positif dan nilai keadilan substantif, khususnya pada konteks lokal Kota Bima. Hasil penelitian menunjukkan bahwa penerapan restorative justice terhadap anak pelaku pencurian di Kota Bima telah dilakukan, namun belum optimal karena masih ditemui kendala struktural, kultural, dan prosedural, sehingga diperlukan penguatan pemahaman aparat penegak hukum serta harmonisasi kebijakan untuk menjamin perlindungan hak anak dan tercapainya keadilan restoratif secara berkelanjutan.
