Abstract

Abstract

This study aims to analyze the role and patterns of adolescent involvement as drug couriers in Sumbawa Barat Regency, identify the factors influencing adolescents' vulnerability within drug trafficking networks, and assess the effectiveness of law enforcement and prevention strategies implemented from the perspective of child protection and the juvenile justice system. The method of research used is a qualitative approach with a case study strategy thru in-depth interviews with law enforcement officers, field observations, and the study of official documents related to narcotics cases involving adolescents. The novelty of this research lies in its specific focus on examining the position of adolescents as drug couriers in the Sumbawa Barat Regency, which has been minimally studied in the literature on juvenile criminal law in Indonesia. The study's results indicate that law enforcement against juvenile drug couriers still faces various obstacles, including legal procedures that are not yet fully child-friendly, weak rehabilitative orientation, and lack of coordination between law enforcement agencies and rehabilitation institutions. This study concludes that there is a need to strengthen the capacity of law enforcement officers, optimize rehabilitation programs, and consistently apply preventive and restorative approaches so that the handling of drug cases involving adolescents is not only repressive but also capable of sustainably reducing the involvement of adolescents in drug trafficking.

Abstract

The rapid development of information and communication technology has significantly transformed students’ social interactions, particularly through digital platforms, which has also increased the risk of cyberbullying. This study aims to examine the role of educational policy in mitigating cyberbullying and its impact on students’ cognitive development. A quantitative approach with an ex post facto design was employed, involving elementary school students as research participants. Data were collected using Likert-scale questionnaires measuring educational policy implementation, cyberbullying experiences, and cognitive development, and were analyzed using descriptive statistics, multiple regression, and path analysis. The findings indicate that educational policy has a significant negative effect on cyberbullying, suggesting that better policy implementation contributes to reducing cyberbullying incidents. Furthermore, cyberbullying has a significant negative impact on students’ cognitive development, particularly in terms of concentration, critical thinking, and problem-solving abilities. The mediation analysis reveals that cyberbullying acts as an intervening variable in the relationship between educational policy and cognitive development. This means that educational policy not only has a direct influence on cognitive outcomes but also indirectly affects them through the reduction of cyberbullying. These results highlight the importance of strengthening educational policies that integrate digital literacy, character education, and preventive strategies to create a safe learning environment. Effective policy implementation can minimize the negative impact of cyberbullying and support optimal cognitive development among students. This study contributes to the existing literature by providing empirical evidence on the interconnected relationship between educational policy, cyberbullying, and cognitive development in the context of digital education.

Abstract

This study examines the problem of judicial discretion in the application of judicial pardon under Article 54 paragraph (2) of Law Number 1 of 2023 concerning the Indonesian Criminal Code (KUHP). Judicial pardon represents a significant reform in the sentencing system, as it allows judges to refrain from imposing criminal sanctions or measures even when the defendant has been proven guilty. However, the formulation of the provision contains broad and open-ended phrases such as “the minor nature of the offense,” “the personal circumstances of the offender,” “justice,” and “humanity,” which may give rise to subjectivity, sentencing disparities, and legal uncertainty if not accompanied by adequate control parameters. This study employs a normative-prescriptive legal research method using statutory, conceptual, and limited comparative approaches. The findings indicate that the application of judicial pardon should be guided by a substantive justice-based model encompassing four control mechanisms: proof of culpability, eligibility for pardon, consideration of the interests of victims and society, and explicit as well as reviewable legal reasoning. This model positions judicial pardon not as an act of subjective leniency, but as a rational, proportional, and accountable judicial mechanism.

Abstract

Restorative justice in resolving criminal cases requires justice with balance and peace. Balance obtains justice for perpetrators, victims, and affected communities. Peace aims to restore the situation or relationship that has been fractured between the perpetrator and the child victim and his family, including the recovery of the community affected by the criminal offense. Restorative justice is fundamental for child victims to obtain justice as part of recovery. The type of research used is normative juridical with descriptive-analytical research specifications and qualitative data analysis. Child victims of criminal acts require special protection and treatment to recover both physically and psychologically. Child victims obtain access to justice in a restorative justice approach with the fulfillment of elements including admission of guilt, forgiveness, and restoration of circumstances. For perpetrators of criminal acts, admission of guilt, forgiveness, and compensation are access to peace with the victim.

Abstract

This study aims to analyses the implementation of the auction of assets resulting from corruption in the Rafael Alun Trisambodo case, reviewed from the perspective of auction law in Indonesia. The background of the study begins with the importance of the execution auction mechanism as an instrument for implementing court decisions as well as a means of recovering state assets in corruption cases. The implementation of the execution auction must also be carried out in accordance with the principles of law and good governance. The urgency of writing this article lies in strengthening legal policies regarding the practice of auctioning confiscated state assets so that they are not only oriented towards the formality of execution, but also guarantee the protection of public interests through the principles of value for money, due process of law, and the principles of good governance. This study uses a normative juridical method with a statutory regulatory approach and a case approach to court decisions that have permanent legal force. The results of the study indicate that the implementation of the auction of Rafael Alun Trisambodo assets has fulfilled the normative principles of procurement law and auction law, particularly transparency, accountability, fair competition, and legal certainty. The execution auction mechanism in this case not only functions as an implementation of court decisions, but also as a means of recovering state assets in line with the goals of eradicating corruption and implementing good governance. The novelty of this research lies in the integration of auction law analysis with the principles of government procurement of goods/services and good governance in the context of auctions for the execution of corruption crimes, which have not been studied comprehensively in Indonesian legal literature.
