This study discusses the legal status of the click wrap agreement as a standard agreement on the Tokopedia platform and consumer protection in its use from the perspective of the principle of contractual equality. This study aims to analyze the legal status of the click wrap agreement based on Article 1320 and Article 1338 of the Civil Code and Article 18 paragraph (1) of the Electronic Information and Transactions Law, and examine consumer protection from the perspective of the principle of contractual equality. The research method used is normative legal research with a statutory approach and a conceptual approach through a literature study of primary, secondary, and tertiary legal materials. The results of the study indicate that the click wrap agreement on the Tokopedia platform meets the requirements for a valid agreement and has the power to bind as an electronic contract. However, its standard nature causes consumers to not have an equal role in determining the substance of the agreement. Therefore, the existence of the Consumer Protection Law is an important instrument to guarantee the protection of consumer rights and encourage the realization of balance in contractual relations in electronic transactions.
