Abstract

This study analyzes the implementation of the Job Creation Law in the employment sector in Indonesia, with an emphasis on employment law policies and efforts to achieve legal certainty in its implementation. The research problem formulation includes: (1) how the Job Creation Law is implemented after the Constitutional Court Decision Number 168/PUU-XXI/2023 from the perspective of implementation and legal protection for related parties; (2) what the obstacles and legal challenges faced in the implementation process, and the legal solutions that can be proposed. The research method applied is normative with a descriptive-qualitative approach, which includes an inventory, interpretation, and evaluation of laws and regulations, legal doctrine, jurisprudence, and related scientific literature, especially Law Number 6 of 2023 concerning Job Creation and the Constitutional Court Decision Number 168/PUU-XXI/2023. Secondary data collection was carried out through literature studies and document analysis, which were then analyzed critically and in depth. The research findings indicate that the implementation of the Job Creation Law in the employment sector requires comprehensive interpretation and evaluation to ensure legal certainty and worker protection. Pasca putusan MK, UU tersebut harus diterapkan secara holistik demi keadilan, kepastian hukum, dan perlindungan dalam hubungan industrial.

Abstract

Penelitian ini bertujuan untuk menganalisis status hukum pekerja borongan di PTPN I Regional 7 Lampung dan pemenuhan hak-hak normatif mereka ditinjau dari Putusan Mahkamah Konstitusi Nomor 168/PUU-XXI/2023 serta peraturan perundang-undangan terkait. Penelitian ini menggunakan metode hukum normatif-yuridis dengan pendekatan kualitatif. Data diperoleh melalui studi kepustakaan dan data lapangan berupa wawancara dengan perwakilan serikat buruh (FPSBI-KSN) serta kuesioner pekerja. Hasil dari wawancara akan dirumuskan dengan berdasarkan aturan perundang-undangan dan putusan MK NO. 168/PUU-XXI/2023. Penulis merumuskan permasalahan terkait status perjanjian kerja pekerja borongan dan hak normatifnya pekerja borongan. Hasil penelitian menunjukkan adanya kesenjangan antara regulasi (das sollen) dan realitas (das sein). Tujuan dari penelitian ini adalah untuk memberikan kepastian hak-hak yang seharusnya diterima oleh pekerja sesuai dengan hukum positif. Pekerja borongan di lokasi penelitian telah bekerja selama puluhan tahun dengan perjanjian tidak tertulis pada pekerjaan inti berupa penyadapan karet, namun statusnya tidak dialihkan menjadi karyawan tetap (PKWTT), melainkan dibiarkan dalam ketidakpastian tanpa perjanjian tertulis. Hal ini bertentangan dengan Putusan MK Nomor 168/PUU-XXI/2023 yang membatasi PKWT maksimal 5 tahun. Selain itu, ditemukan pelanggaran hak normatif berupa upah di bawah Upah Minimum Kabupaten (UMK) dan ketiadaan jaminan sosial (BPJS Ketenagakerjaan dan Kesehatan).

Abstract

This study examines the limits of the Administrative Court’s absolute jurisdiction over election disputes and factual administrative actions following the enactment of Indonesia’s Government Administration Act. The research analyzes how the expansion of administrative jurisdiction has influenced the adjudication of election-related disputes and the legal certainty surrounding the division of authority among judicial institutions. Employing a normative legal research method, the study adopts statutory, conceptual, and case approaches by examining the 1945 Constitution, the Government Administration Act, election laws, Supreme Court regulations, Constitutional Court decisions, and relevant judicial precedents. The findings reveal that although the Government Administration Act broadened judicial review over administrative actions, its implementation has generated overlapping jurisdiction between the Administrative Court, the Constitutional Court, and other electoral dispute resolution bodies. The inclusion of factual administrative actions within judicial review has further complicated the determination of jurisdiction in election cases, particularly where administrative decisions intersect with constitutional and electoral processes. This ambiguity has resulted in inconsistent judicial interpretations and procedural uncertainty, potentially undermining effective legal protection and democratic governance. The study argues that clearer jurisdictional boundaries are necessary to distinguish election administrative disputes from constitutional and political disputes while ensuring coherent coordination among judicial institutions. Legislative refinement, harmonization of procedural regulations, and consistent judicial interpretation are essential to strengthen legal certainty and prevent conflicting decisions. Ultimately, clarifying the Administrative Court’s jurisdiction would improve the effectiveness of electoral justice, reinforce the rule of law, and support a more accountable and transparent system of election administration consistent with Indonesia’s constitutional framework.
