The development of modern criminal justice systems has encouraged a shift in criminal case resolution through a negotiated justice approach. The introduction of the Guilty Plea mechanism (plea bargaining) under Law Number 20 of 2025 concerning the Indonesian Criminal Procedure Code expands the authority of public prosecutors in determining the direction of criminal case resolution. This development raises concerns regarding the limits of prosecutorial authority within the framework of the dominus litis principle, particularly concerning prosecutorial discretion and accountability mechanisms. This study aims to analyze the construction of prosecutorial authority in the implementation of plea bargaining and to formulate an appropriate model based on the dominus litis principle. This research employs a normative juridical method using statutory and conceptual approaches. The findings reveal that the New Criminal Procedure Code has expanded the meaning of dominus litis from controlling prosecution to determining criminal case resolution strategies. However, such expansion requires limitations through clear standards, legal accountability, and adequate oversight mechanisms. This study proposes the concept of Accountable Limited Dominus Litis as a model that maintains the prosecutor’s role as the controller of criminal proceedings while ensuring accountability, proportionality, and protection of defendants’ rights.
